User Content Principles
governing the ground rules and permissible nature of permissible information and data placed by the User on the Server
(part of the General Terms and Conditions for the provision of Uloz.to Disk data storage services)
- General Provisions
- This User Content Policy is an integral and binding part of the Terms and Conditions.
- Capitalized terms and definitions used in this User Content Policy but not defined herein shall have the meaning ascribed to them in the Terms.
- User Content Policy
- User has the following rights and obligations in relation to User Content:
- The User is entitled to choose the name of the data file uploaded to the Server. The name of the data file must not contain profanity or expressions that contradict Article 2.2 and/or 2.3 of this User Content Policy. If such name does not comply with the conditions set forth in the preceding sentence or is otherwise inappropriate in content or graphics, the Operator reserves the right to change the name or remove the data file so named from the Server or to restrict access to the data file so named.
- User shall, when placing a data file on the Server, decide whether to share the data file publicly or to restrict access to the data file.
- When placing a data file as an archive on the Server, the User may be asked to decide whether the data file (archive) will be automatically extracted/extracted. All contents of the extracted archive constitute User Content within the meaning of this User Content Policy.
- User agrees to refrain from posting erotic and/or pornographic User Content on the Server. In the event that User posts erotic and/or pornographic User Content on the Server in violation of this prohibition, such User Content may be removed or made unavailable.
- The Operator reserves the right to move User Content between different parts of the Server.
- Users may remove their data files uploaded to the Server.
- User may make the contents of data files inaccessible to other Users (e.g., through password protection or marking the file as a Private File) or restrict access to the data file. The specific methods of making unavailable and restricting access to an uploaded data file are governed by the Operator's current offer. By uploading data files to the Server, the User may not violate the rules set forth in this User Content Policy.
- The placement of User Content on the Server, in particular in relation to the name and content of the uploaded data files stored by the User on the Operator's Server, the texts of comments and/or the content of mail, must not contravene the law and the Terms and Conditions, in particular these User Content Policies, as well as the rights and legally protected interests of the Operator, other Users or third parties. In particular, the User may not, by placing User Content on the Server:
- infringe copyright, rights related to copyright, trademark rights, trade name, protected designation of origin or industrial rights;
- incite hatred against a group of persons or limit their rights and freedoms, defame a nation, ethnic group, race and/or beliefs;
- support or promote movements demonstrably directed at the suppression of human rights and freedoms;
- encourage a criminal offence, mass failure to perform an important duty imposed by law, or endorse a criminal offence;
- depict cruelty to an animal;
- contain a false statement about another that is likely to cause substantial damage to his/her reputation, good name or reputation, to damage his/her employment, to disrupt his/her family relationships or to cause him/her other serious harm;
- promote in any way a business in competition with the Operator or contain material likely to damage the reputation of the Operator;
- breach a statutory duty of confidentiality or violate or endanger the trade secrets of a third party;
- distribute inappropriate or harmful files and/or information, in particular viruses, Trojan horses, rootkits, backdoors, spyware, adware, or any other malware;
- distribute files and/or information that link directly or indirectly to content that does not comply with the requirements of this User Content Policy, including but not limited to URL links, URIs, trackers, torrents, and other links.
- In particular, a User may not place files on the Server that:
- allows persons under the age of eighteen to access any pornographic work or other content capable of impairing the healthy development and/or moral education of minors;
- contain pornographic works depicting or otherwise exploiting a child or a person appearing to be a child;
- contain pornographic works that display violence or disrespect for human beings or that describe, depict or otherwise depict sexual intercourse with an animal;
- The User shall not behave or misuse the Services provided by the Operator within the Server in a manner that would be contrary to the law, these Terms and Conditions, as well as the rights and legally protected interests of the Operator, other Users or third parties, e.g. by posting or sending unsolicited commercial messages ("spam") in any way or uploading User Content that limits the functionality of the Service or makes its use by other Users more difficult.
- Publishing advertising is reserved to the Operator. User may not post any paid or unpaid advertising or third party advertising on the Server. In the event of the User publishing advertising, the Operator reserves the right to block the User from publishing comments on files or to remove any uploaded data files that contain advertising. Violation of this provision shall be considered an extremely serious violation of the Terms.
- User has the following rights and obligations in relation to User Content:
Child Pornography Site
In accordance with Section 2.3 of the User Content Policy, Operator does not and will not tolerate child pornography posted in any form on the Server. If Operator becomes aware of the presence of child pornography on the Server, Operator will promptly take all steps that may be required of it to remove or make child pornography unavailable from the Server.
Operator expressly reserves the right to pursue all legal remedies against the User who has posted child pornography on the Server, including the rights under these Terms and/or to cooperate with law enforcement authorities to identify those involved in the distribution of child pornography.
