2. General Information on Data Processing
We process personal data only to the extent necessary to provide a functioning website, operate the Vinto bot, communicate with users, and ensure security and stability. Processing is carried out in particular on the basis of Art. 6(1)(b) GDPR where it is necessary for the performance of a user relationship, and on the basis of Art. 6(1)(f) GDPR where there is a legitimate interest in the secure, efficient, and technically reliable operation of the service.
3. Accessing the Website
When you access this website, the web server processes technically necessary connection data. This may include your IP address, date and time of access, requested file, amount of data transferred, referrer URL, browser type and version, operating system, and requesting provider. This processing is carried out to deliver the website, ensure technical operation, analyze errors, and defend against misuse and attacks.
The legal basis is Art. 6(1)(f) GDPR. Our legitimate interest lies in the secure and stable provision of the online service.
4. Hosting
This website is operated through an external hosting provider. As part of hosting, the data generated when accessing the website is processed on the hosting provider's servers. This may include IP addresses, server logs, connection data, and technical metadata.
The website and related infrastructure are currently hosted by Hetzner Online GmbH, Industriestr. 25, 91710 Gunzenhausen, Germany. Where required, processing is carried out on the basis of a data processing agreement.
The legal basis is Art. 6(1)(f) GDPR. Where a data processing agreement has been concluded with the hosting provider, processing is carried out on the basis of Art. 28 GDPR.
5. No Analytics or Advertising Trackers at This Time
At the current time, this website does not use any non-essential analytics, marketing, or tracking tools. In particular, no external webfonts, embedded analytics scripts, or advertising networks are loaded through this website. If additional services are integrated later, this Privacy Policy must be updated accordingly.
6. Cookies and Local Storage
At the current time, this website does not use non-essential cookies. To the extent that the hosting provider or technical infrastructure uses strictly necessary cookies or similar technologies, this is based on Section 25(2) TDDDG and Art. 6(1)(f) GDPR insofar as it is technically necessary to provide the website.
7. Contacting Us
If you contact us by email, phone, or other means, we process the data you provide, especially your name, contact details, message content, and other communication data, in order to handle your request.
The legal basis is Art. 6(1)(b) GDPR where the request relates to the conclusion or performance of a contract; otherwise Art. 6(1)(f) GDPR applies. Our legitimate interest lies in the efficient handling of inquiries. Statutory retention obligations remain unaffected.
8. Use of the Vinto Bot
If you use Vinto on Fluxer or add it to a server, we process the data required to operate the bot. This may include server IDs, channel IDs, user IDs, role information, command contents, queue information, playlist data, favorites, technical status data, configuration data, and operational log data. Processing is carried out exclusively to provide the bot's functions, troubleshoot issues, prevent abuse, and ensure stability and security.
To the extent that the bot stores user-related music lists, favorites, queue data, or server-related settings, this is done in order to provide the functions requested by users or server administrators. The legal basis is Art. 6(1)(b) GDPR and/or Art. 6(1)(f) GDPR.
Please review and complete this section based on the data your bot actually stores, especially database contents, log rotation, moderation or telemetry data, and retention periods.
9. Recipients and Categories of Recipients
Personal data is disclosed to third parties only where this is necessary for contract performance, required by law, based on your consent, or justified by a legitimate interest. Recipients may in particular include hosting providers, server operators, database or infrastructure providers, and technical service providers involved in maintenance and operations.
At the current time, the primary service provider used for website and infrastructure hosting is Hetzner Online GmbH, Industriestr. 25, 91710 Gunzenhausen, Germany. If additional processors or infrastructure providers are added later, this Privacy Policy must be updated accordingly.
10. External Links and Third-Party Services
This website contains links to external services, including Fluxer, GitHub, Ko-fi, and possibly other third-party websites. When you click such a link, you leave this website. The respective operators are solely responsible for data processing on those external sites. Please review their privacy notices.
11. Retention Period
Personal data is stored only as long as necessary for the relevant processing purposes or as required by statutory retention obligations. Server log data is generally retained only for a limited period where necessary for security and error analysis. Communication data is deleted once processing is complete, unless statutory retention obligations apply. Bot-related data remains stored as long as required to provide the relevant function or until deletion is initiated, provided no legal or technical reasons prevent deletion.
12. Data Processing in Third Countries
Where service providers outside the EU or EEA are used, or where data is transferred to a third country, this takes place only in compliance with the legal requirements of Art. 44 et seq. GDPR, in particular on the basis of an adequacy decision or appropriate safeguards such as EU Standard Contractual Clauses.
13. Your Rights
Subject to the applicable legal requirements, you have the right of access to the personal data concerning you, the right to rectification of inaccurate data, the right to erasure, the right to restriction of processing, the right to data portability, and the right to object to processing. Where processing is based on consent, you may withdraw that consent at any time with effect for the future.
14. Right to Lodge a Complaint with a Supervisory Authority
You have the right to lodge a complaint with a data protection supervisory authority. In particular, you may contact the supervisory authority of your habitual residence, place of work, or the place of the alleged infringement. For the company in Bavaria, this may in particular be the Bavarian State Office for Data Protection Supervision.
15. Obligation to Provide Data
The provision of certain data is necessary for the technical operation of the website and for the use of the bot. Without this data, individual functions or the entire service may not be available.
16. No Automated Decision-Making
At the current time, no solely automated decision-making, including profiling within the meaning of Art. 22 GDPR, takes place.
17. Important Note on Finalization
This Privacy Policy has been adapted to the currently known setup, including hosting through Hetzner. It should still be reviewed and updated if additional processors, databases, monitoring tools, email providers, analytics services, or other third-party infrastructure are introduced later, or if the actual scope of bot data processing changes.
