The Pimachiowin Aki World Heritage Fund Act

WHEREAS Pimachiowin Aki Corp. ("the corporation") is a registered charity that seeks to create a network of protected areas that is worthy of designation by UNESCO as a World Heritage Site;

AND WHEREAS the establishment of a dedicated fund will enable donations to be made to support the goals of the corporation;

AND WHEREAS on October 13, 2009, the Government of Manitoba announced a commitment to contribute $10 million over four years beginning in 2012 to a new fund that will support the Pimachiowin Aki World Heritage Project;

AND WHEREAS The Winnipeg Foundation has considerable expertise in managing funds for charitable purposes;

THEREFORE HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

Definitions

The following definitions apply in this Act.

"corporation" means Pimachiowin Aki Corp., a corporation incorporated under the Canada Corporations Act. (« Corporation »)

"foundation" means The Winnipeg Foundation continued under The Winnipeg Foundation Act, S.M. 2004, c. 45. (« Fondation »)

"fund" means the Pimachiowin Aki World Heritage Fund established under section 2. (« Fonds »)

"minister" means the minister appointed by the Lieutenant Governor in Council to administer this Act. (« ministre »)

"UNESCO" means the United Nations Educational, Scientific and Cultural Organization. (« UNESCO »)

Fund established

The Pimachiowin Aki World Heritage Fund is hereby established.

Purpose of fund

3(1)

The purpose of the fund is to generate income to be used

(a) to protect, preserve and celebrate the natural features and the cultural landscape of an area east of Lake Winnipeg; and

(b) if UNESCO designates an area east of Lake Winnipeg as a World Heritage Site, to support programs and initiatives that are consistent with the management plan established for that site.

Fund to support community-driven projects

Income from the fund may be used to support community-driven projects that will achieve the objectives set out in subsection (1).

Agreements to administer fund

4(1)

The corporation and the minister, on behalf of the government, may enter into agreements with the foundation to have the foundation

(a) manage and administer the fund; and

(b) pay out income from the fund to make grants or other payments to achieve the objectives set out in section 3.

Matters covered by agreements

4(2)

The agreements may include provisions dealing with one or more of the following:

(a) donations to the fund;

(b) the management and administration of the fund;

(c) reporting to the corporation and the minister respecting the management and performance of the fund;

(d) information to be provided by persons and organizations seeking grants or other payments from the fund;

(e) the process of making grants and other payments from the fund;

(f) reports to be provided respecting the use of money paid from the fund.

Alternate agreements

The corporation and the minister, on behalf of the government, may enter into agreements with another entity acceptable to the corporation and the minister to have that entity perform the roles set out in subsection 4(1).

Administration in accordance with agreements

The fund is to be administered and grants and other payments are to be made from the fund in accordance with the terms of agreements made under section 4 or 5.

This Act may be referred to as chapter P70 of the Continuing Consolidation of the Statutes of Manitoba.

Coming into force

This Act comes into force on a day to be fixed by proclamation.
