Delaware judge says Newsmax defamed Dominion Voting Systems

A judge in Delaware has issued a preliminary ruling in favor of Dominion Voting Systems in its ongoing lawsuit against right-of-center news outlet Newsmax over its airing of unsubstantiated conspiracy theories linked to the outcome of the 2020 presidential election.

The order was handed down by Delaware Superior Court Judge Eric Davis on Wednesday after both sides in the case sought summary judgments in their favor, which would have allowed the lawsuit to be resolved by on the judge’s opinion that the facts alleged were not in dispute.

Dominion’s motion for summary judgment was only approved in part, with Newsmax seeing its request denied in full. The order means some allegations may be decided by a jury trial in the future, should Dominion and Newsmax not settle the matter beforehand.

Newsmax has posted a new statement on its website about the settlement of Smartmatic’s defamation lawsuit, acknowledging that a court found that claims that the voting company was involved in rigging the 2020 election were untrue.

In a statement posted on Saturday, Newsmax said that it “has resolved the litigation brought by Smartmatic through a confidential settlement. Newsmax acknowledges that the Court found that ‘allegations regarding whether the [2020 U.S. presidential election] and its results were somehow altered or manipulated by Smartmatic are factually false/untrue.'”

“Newsmax reiterates its statement of December 2020 that made clear that there is no evidence that Smartmatic machines or software altered the votes in the 2020 U.S. presidential election and that Smartmatic is a U.S. company and not owned by the Venezuelan government, or any foreign official or entity.”

Newsmax reaches confidential settlement with Smartmatic, avoiding trial

Political affairs channel Newsmax says it has reached a settlement with Smartmatic over certain election-related misinformation that aired on some of its programming.

The settlement came about two days before Smartmatic’s defamation trial was set to begin, with opening arguments scheduled in the case for Monday.

The case centered around conspiracy theories floated by some Newsmax contributors and guests following the 2020 presidential election, including claims that Smartmatch machines helped rig the outcome of the election in favor of then-Democratic candidate and former Senator Joe Biden.

Those claims have never been definitively proven. Smartmatic’s voting machines were used in Los Angeles County, though the company claims Newsmax commentators and guests conflated their conspiracies to suggest it played a much-larger role in that year’s election.

Laughing Dragon Studios Digs Out Christmas Special Series ‘Coal’

Exclusive: Laughing Dragon Studios recently grabbed a skateboard for a Tony Hawk toon, and now the Canadian production house has switched focus to the festive season.

The company has unveiled Christmas series Coal, which is due to drop in December 2025. Shaftesbury is signed up for international distribution, with Muse Distribution handling Quebec. The Shaw Rocket Fund and Telefilm have provided funding.

The three-part special will follow Ethan Bishop, an eight-year-old boy navigating a difficult time in his life that lands him on Santa’s naughty list. In response, Santa implements ‘Plan C,’ sending a legendary Lump of Coal to guide Ethan on a “ho-ho-hilarious journey.” Through a series of positive and negative experiences with the coal, Ethan discovers a life-altering artistic talent.

Cast includes Lucinda Davis as Ethan alongside Zariah Ellis (Blue’s Clues & You), Briauna James, Ralph Prosper, Mara Lazaris, Eric Davis and Bruce Dinsmore as Santa Claus.

Laughing Dragon is billing it as a “playful 2D animated series, complete with specialized magical charcoal-style sequences” for kids aged 6-10, and is planning it as an “festive tradition that can be cherished year after year.”

Guillaume Chassé (Curious George, F Is for Family) is directing and René Veilleux from Vérité Entertainment oversaw the voice direction and casting. Astride Noel and Christopher Bernard are the writers. Laughing Dragon CEO Ryan Sohmer (Kabu, Disenchanted) is the executive producer.

“With an initial concept from our very own Ryan Costello and seeing what our Director of Original Productions Jeff Moss has molded Coal into over the last few years, I am thrilled to begin this next stage of production, and counting down until we can bring Ethan and his family to worldwide audiences,” said Sohmer.

Writer Noel added: “It was a blast working on Coal, and I immediately fell in love with the dilemma of this holiday film that takes traditional Santa lore and spins it on its head. ‘Finding who is naughty and nice’ is not always as easy as the song makes it seem. The story serves as a wonderful reminder that even in difficult times, there is joy, beauty, and… nice to be found.”

Earlier this year, we reported that Laughing Dragon was working with skateboarding legend Tony Hawk on animated series Skatebirds, as part of the Montreal-based company’s push into original production. Initially beginning as a full-service 2D animation studio, Laughing Dragon has worked on projects such as Apple TV+’s Central Park and Disney’s Disenchanted, and is developing an internal slate also including madcap mythologic title Isaac & Friends and an animated adaptation of Least I Could Do, a webcomic created by Sohmer and Lar deSouza.

Dominion Voting Systems’ defamation lawsuit against right-wing news outlet Newsmax will get its day in court this fall — right before the 2024 voting begins.

A Delaware judge scheduled the $1.6 billion suit to go to trial in late September 2024, CNN reported. Dominion sued Newsmax, One America News (Oan) and former Overstock CEO Patrick Byrne for defamation in August 2021 over its coverage of the 2020 election.

The voting machine company already emerged victorious in a similar suit against Fox News, walking away with a $787 million settlement, believed to be the largest defamation settlement in US history.

Oan also settled with Dominion earlier this month, CNN reported. Terms of the settlement were not disclosed. The Byrne case, along with a series of other suits Dominion brought against Trump allies like Rudy Giuliani and “My Pillow” CEO Mike Lindell are still pending, Reuters reported.

Fox Corp. CEO Lachlan Murdoch is dropping his defamation claim against Australian news site Crikey over a column that connected him to the January 6th attack on the Capitol.

In a statement, Murdoch’s attorney, John Churchill, cited the recent settlement of Dominion’s lawsuit against Fox Corp. and Fox News in dropping the litigation. In the proceedings, which might not have started until next year, Crikey was poised to introduce material gathered during the discovery process in the Dominion suit, in which Fox agreed to pay $787.5 million to settle the claim and avoid a trial.

According to a report from Lever News, Fox News could potentially write off a massive portion of the $787.5 million settlement it has agreed to pay Dominion Voting Systems as a tax deduction.

In talking to reporters afterward, attorneys for Dominion suggested that the whopping settlement sum and the proceedings up to this point held the network accountable for amplifying false allegations that the election software company was involved in rigging the 2020 election in Joe Biden’s favor.

The media defamation case of the century has settled before the opening arguments.

Fox Corp. has settled the high-profile defamation case brought against it by Dominion Voting Systems, effectively putting an end to the suit.

Judge Eric Davis announced the resolution in court Tuesday, after the start of the trial was delayed by two hours. “The parties have resolved their case,” Davis said.

Terms of the settlement were not immediately disclosed, though Dominion had been seeking $1.6 billion from Fox in its suit. In a press conference after court was adjourned, Dominion’s lawyer said the settlement was for $787 million and that it represented “accountability.” A source familiar with the terms said they did not dictate an on-air apology.

“We are pleased to have reached a settlement of our dispute with Dominion Voting Systems,” a Fox spokesperson said Tuesday. “We acknowledge the court’s rulings finding certain claims about Dominion to be false.

Without citing a reason, the Delaware judge overseeing a voting machine company’s $1.6 billion defamation lawsuit against Fox News announced late Sunday that he was delaying the start of the trial until Tuesday.

The trial, which has drawn international interest, had been scheduled to start Monday morning with jury selection and opening statements.

The case centers on whether Fox defamed Dominion Voting Systems by spreading false claims that the company rigged the 2020 presidential election to prevent former President Donald Trump’s re-election. Rupert Murdoch can breathe easy for at least one more day.

The judge overseeing the much-scrutinized defamation trial brought against Fox News and its parent, Fox Corp., has delayed its start by a day, according to a statement issued by Delaware’s Superior Court, where the case is being heard. The decision is sure to raise speculation that the two sides may be seeking a settlement.

“The Court has decided to continue the start of the trial, including jury selection, until Tuesday, April 18, 2023 at 9:00 a.m. I will make such an announcement tomorrow at 9:00 a.m. in Courtroom 7E,” Judge Eric Davis said in a note Sunday evening.

A spokeswoman for Dominion declined to comment on the prospect of settlement talks and Fox representatives could not be reached for immediate comment. Dominion is seeking $1.6 billion in damages.

Jury selection started on Thursday in Dominion Voting Systems’ $1.6 billion defamation lawsuit against Fox News, as both sides appear to be headed for a trial next week.

At the 7th floor of the Leonard Williams Justice Center in downtown Wilmington, De, jurors are being questioned one by one behind closed doors in proceedings led by Judge Eric Davis and up to four attorneys and other representatives from each side. Fox plans to bring in a jury consultant to that part of the process.

The judge said that, in an initial raised-hand query of 82 jurors on whether they could be impartial, 23 did not raise their hand, leaving 59 to be questioned further.

If the attorneys for Dominion issue trial subpoenas to force testimony from the Fox leaders, Delaware Superior Court Judge Eric Davis said at a public hearing Wednesday he “would not quash it and I would compel them to come,” per NBC News. “It would be my discretion that they come,” Davis said.

Fox News cut ties with Abby Grossberg Friday, Variety has learned, citing disclosure of privileged corporate information, after the booker and producer for such hosts as Tucker Carlson and Maria Bartiromo alleged in court filings earlier this week that she was coerced by executives into providing misleading testimony in the $1.6 billion defamation suit that Dominion Voting Systems has levied against the Fox Corp.-backed outlet.

2Nd Update, 10:05 Am: A Delaware court judge did not rule in favor of either Fox or Dominion as each side seeks a ruling ahead of the election systems company’s $1.6 billion defamation suit.

During the past two days, attorneys for both sides have asked Judge Eric Davis to rule in their favor on motions for summary judgment, potentially forestalling a trial that is set to begin April 17.

It’s unclear which way Davis will rule on the motions, but he told attorneys Wednesday that he will decide before a scheduled pre-trial hearing on April 11 “so you know how to narrow certain issues.”

Fox News is citing newly found emails from Maria Bartiromo’s personal account that they intend to use in their defense of Dominion Voting Systems’ defamation lawsuit.

In one email exchange, Tony Fratto, who in November, 2020 was acting as a spokesman for Dominion, wrote to Bartiromo after watching an interview with Sidney Powell, the attorney and Fox News guest who had been one of the most visible figures pushing the conspiracy theory that the voting systems company rigged the election.

“I just watched the whole interview with Sidney Powell. It’s sad,” Fratto wrote to Bartiromo on Nov. 21.

Bartiromo responded, “Tony. She is pushing on this. Do you want to have dominion ceo on?”

Fratto did not respond to the offer, but wrote, “She is pushing a lot of things and trime [sic] after time they’re proving to be untrue. WSJ editorial board has it right — again today on Georgia handcount.

Dead by Midnight (Y2Kill) is the unexpected follow-up to Dead by Midnight (11pm Central). And I say unexpected because despite being a fun collection of stories, it pretty much stayed under everyone’s radar. But enough people did see it that a second film got greenlighted, and with a big enough budget to include a couple of genre heavyweights.

The film opens with The Mistress of Midnight sitting around hell, googling for reviews of the first film and unleashing her wrath on those who didn’t give it a thumbs up.

A Delaware judge declined to toss out a $1.6 billion defamation lawsuit against Fox News filed by Dominion Voting Systems, which claims that the network “sold a false story of election fraud” in the aftermath of the 2020 presidential race.

The ruling on Fox News’ motion to dismiss means that Dominion’s litigation can proceed.

Judge Eric Davis wrote in his opinion (read it here) that Dominion’s lawsuit “alleges facts that Fox made the challenged statements with knowledge of their falsity or with reckless disregard of their truth.”

He added, “The Complaint also alleges facts that there were signs indicating the reports were false. From these, the Court can infer that Fox intended to avoid the truth. Whether Dominion ultimately will prove Fox’s actual malice by clear and convincing evidence is irrelevant on a motion to dismiss. At this stage, it is reasonably conceivable that Dominion has a claim for defamation per se.

ESPN’s “E60” will take a look at baseball great Barry Bonds as he approaches his last year of eligibility on the writers’ ballot for candidates for the Baseball Hall of Fame, a sign that allegations around his use of performance-enhancing drugs have tarnished some parts of his legacy.

The ESPN program will present “Bonds” on Nov. 7 at 9:30 p.m. Et, with Jeremy Schaap reporting. Over the course of his 22-season career, Bonds amassed a record 762 career home runs, a record 73 home runs in a single season and eight Gold Gloves. But, he was indicted in 2007 on charges of perjury and obstruction of justice during the federal government’s investigation into a steroid manufacturer.
