While their M.O. of videotaping their murders is similar to Canadian serial killers Paul Bernardo and Karla Homolka, the actual characters of Wayne and Andrea Montgomery are not based on any real-life serial killers.

Every scene in Head Case was improvised.

Yes. There are a total of six films in the Head Case film series:

Head Case (2007) Head Case: Last Days of a Serial Killer (2009) Head Case: Post-Mortem (2010) Head Cases: Serial Killers in the Delaware Valley (2013) Head Case: The Lost Tapes (2020) Head Case: Legacy (2020)

Possibly. Even in 2006, it was not uncommon for most people to have some form of video recording device, whether it be a cell phone, flash drive camera, or camcorder. However, a couple of deleted scenes featured on the DVD show that some of the victims do indeed find it odd. In one deleted scene, Wayne's first victim (the "bleach victim") is 'pre-screened' prior to her murder, during which she looks puzzled by the fact she's being filmed. In another deleted scene, the boyfriend of the pregnant woman asks why they're being filmed and gets visibly agitated by this.
