Kevin Costner does his own singing in the film. He has his own band, Kevin Costner and Modern West which released their first album in 2008.
According to co-screenwriter Jason Richman, the picture was inspired by the close result of the 2000 U.S. American Presidential election between Democrat Vice President Al Gore and Republican George W. Bush where the result came down to the southern American U.S. state of Florida and only around 500 votes.
The picture is an unofficial remake of El disputado voto del Sr. Cayo (1986) which had been made and released around twenty-two years earlier.
Madeline Carroll received an "introducing" credit despite appearing in at least three other feature films prior to this one: When a Stranger Calls (2006), The Santa Clause 3: The Escape Clause (2006), and Resident Evil: Extinction (2007).
