🔥The devil has always been in the detail with respect to international data transfers. That devil is working harder than ever. 1️⃣8️⃣5️⃣ In its devilishly-detailed 185 page ruling (linked below), the Irish High Court upheld significant aspects of the Data Protection Commission Ireland enforcement against TikTok related to TikTok's data transfers to China. However, the Court has sent back to the DPC, for reconsideration, the issue of whether TikTok's purported remediations, via its flagship Project Clover initiative, are such that the DPC erred in ordering the suspension of data transfers to China. 🍀Project Clover, as with so many other hyper-scale technology company initiatives, represents a bamboozling capital, legal, governance, and technological investment in data privacy and, more broadly, sovereignty. Is it enough, however, in the eyes of regulators and policymakers? If not, what more should and can be done, at what cost, and to what end for companies, customers, and consumers? 🧱Increased organisational investment in legal controls, physical infrastructure (e.g., data centres), governance, and state of the art privacy-enhancing (or sovereignty-securing) technological tools might shape the trajectory of international data transfers, just as much foreign laws related to government access to data have proven over the last 15 years. Privacy pros will, therefore, be closer to the action than before, navigating and genuinely shaping this trajectory. It was terrific being back at Ditchley for probably some of the most exposing and expansive conversations on digital sovereignty I’ve been a part of. We unpacked the state and trajectory of the AI stack and of the many many flavours and approaches to sovereignty, mapped some of the most consequential points of risk and vulnerability across infrastructure, cloud, models, and infrastructure, and teased out potential tactics for “middle powers” and indeed companies across the stack to gain leverage and move away from dependence to strategic indispensability. There’s an urgency to digital sovereignty issues like never before. The litany of policy initiatives (especially those from the last few weeks on both sides of the Atlantic) is being matched by increasing investment and prioritisation within organisations to implement governance, technical, and legal controls. Thank you to James Arroyo and the Ditchley Foundation team for the warm and convivial hospitality, the thoughtful and engaging programme, and for convening such a diverse, deep, and committed group of thinkers and doers.
