    When I testified before the U.S.-China Economic and Security Review Commission, I talked about how low-value shipments had become one of the biggest blind spots for brand protection. It was a system that made it easier for counterfeit goods to enter the market undetected, and in high volumes.That blind spot just got a little smaller. The U.S. has now officially closed the de minimis loophole, ending duty-free treatment for parcels under $800, regardless of origin. In the days following the change, international postal traffic to the U.S. dropped by 80%. For brand protection teams, this means new risk vectors: sellers trying to reclassify shipments, divert through other countries, or hide origin details to avoid duties. Teams will need to rethink how they triage threats, align with customs and logistics partners, and plan for a Q4 where counterfeit flows may look different, but won’t slow down.

  • Why do some brands win name disputes while others don’t? It usually comes down to intent. In the Lamborghini vs. Lambo.com case, there was no real use, no genuine connection to the name, and later a $75M domain price built on someone else’s reputation. The court saw the pattern and called it bad-faith registration. We’re seeing the same theme elsewhere. The USPTO recently canceled 52,000+ fraudulent trademark filings for the very same reason: no real business, no real identity, just attempts to gain leverage. If your brand carries value, others will eventually try to borrow it. ✅ Claim the names tied to your identity ✅ Monitor the ones you don’t own yet ✅ Act early, before a dispute exists
