FACTS:
This is a case involving an agency of the government, the Angat River Irrigation
System, and its employees as represented by Angat River Workers Union. The
controversy arose when the Acting Prosecutor of the Court of Industrial Relations on
behalf of the Angat River Workers Union (PLUM) filed two cases against Angat River
Irrigation System for Unfair Labor Practices (Case No. 814-ULP) and a petition for
certification of said union as the sole and exclusive bargaining representative of the
employees of the aforementioned system (Case No. 313-MC).

ISSUES AND RULINGS:


The issues to be resolved are as follows:
1) Whether or not the Angat River Irrigation System committed unfair
labor practices.
No. The Angat River Irrigation System exercises government functions that
fall under the direct supervision of the President of the Philippines through
the Department of Public Works by virtue of the Commonwealth Act no. 87,
and it is primarily and chiefly connected with the general welfare of the
people.
2) Whether or not it may demand that the government enters into
collective bargaining agreements with the said union.
No . The Angat River Irrigation System, as an entity of the Bureau of Public
Works is merely a machinery of the government and has no personality to
sue or be sued. It is a fundamental principle of the law that there can be no
legal right against the authority that makes the law on which the right
depends.

3) Whether or not the Court of Industrial Relations acquired jurisdiction


over the person of the defendants in cases no 814-ULP and 313-MC
of the court.
No. As only natural or juridical persons may be parties in an action and as the
Angat River Irrigation System, as an agency of the government, cannot be
sued without its consent.
DECISION OF THE COURT:
Petitions and to enter in trial cases of the respondents of the court is hereby
set aside and said cases are dismissed.
