AFFIDAVIT OF DESISTANCE
We, SULPICIO R. HINAYAS, Filipino, of legal age, widower, and a resident of
Mantacida, Catigbian, Bohol, Philippines and VICTORIA H. SALERA, Filipino, of
legal age, married and a resident of Mantacida, Catigbian, Bohol, Philippines, after
being duly sworn in accordance with law, depose and state;
1. That I am the private complainants in a criminal complaint docketed as NPS
No. VII-02-INQ-17F-00392 for Homicide filed before the Provincial
Prosecution Office, Hall of Justice, New Capitol Site, Tagbilaran City against
Nelson Barcinas y Hinayas of Mantacida, Catigbian, Bohol, Philippines;
2. That we are no longer interested in the prosecution of said complaint
considering that the respondent humbly and sincerely asked for forgiveness
and promised not to do it again, further, we are close relatives and
neighbours in our barangay;
3. That we understand that the dismissal of our complaint against the
respondent carries with it the dismissal of the civil aspect of the case, and
the same can no longer be re-instituted.
4. That we are executing this affidavit voluntarily and free from any form of
coercion, compulsion or undue influence.
IN WITNESS WHEREOF, we have signed this Affidavit this 19th day of June,
