AMMENDED
INFORMATION

The undersigned Prosecutor accuses Puma Naw of the crime of


Frustrated Murder under Article 248 in relation to Article 6 of the
Revised Penal Code, committed as follows:

That on or about December 25, 2018, at Dimakita St., Digos City,


Davao del Sur, Philippines and within the jurisdiction of this Honorable
Court, the aforementioned accused, armed with an icepick, with intent
to kill qualified with treachery and evident premeditation, which are
hereby alleged as qualifying circumstances to the crime of Murder, did
and there, willfully, unlawfully and feloniously attack, assault and stab
Tomi Rick hitting his LOWER BACK area, while the victim was seated
inside his house and without any warning, thus, he was not in a position
to defend himself, a mode of attack which the accused consciously and
deliberately adopted, thereby inflicting upon him a mortal wound which
may cause his death, but the accused despite performing all acts of
execution which would produce the felony but which nevertheless, did
not produce it by reason of causes independent of the will of the
perpetrator as it might have caused his death were it not for the timely
medical intervention.
