“TAKE WOLLONGONG TO THE WORLD LOGO” PROMOTION

TERMS AND CONDITIONS

1. Information on how to enter and the prize(s) form part of these Terms and
Conditions. Participation in this promotion is deemed acceptance of these Terms and
Conditions.

2. Entry is only open to individual NSW residents and school students entering on
behalf of a primary or secondary school in NSW in which they are enrolled.

3. Entrants under 18 years old must have parental/guardian approval to enter and
further, the parent/guardian of the entrant must read and consent to these Terms and
Conditions. Parents/guardians may be required by the Promoter to enter into a further
agreement as evidence of consent to the minor entering this promotion.

4. Employees (and their immediate families) of the Promoter and agencies associated
with this promotion are ineligible to enter. Immediate family means any of the following:
spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by
adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece,
nephew, brother, sister, step-brother, step-sister or 1​st ​cousin.

5. Promotion commences on 08/05/19 and entries close at 5pm AEST on


28/06/19 (“Promotional Period”).

6. To be eligible to enter, eligible entrants must design a logo for the 2022 UCI
Road World Championships (“Logo”).

7. To enter, eligible entrants must then, during the Promotional Period, visit
https://www.illawarramercury.com.au/​, follow the prompts to the promotion entry page,
include all requested details and upload a copy of the Logo in pdf or jpeg format.

8. The Promoter reserves the right, at any time, to verify the validity of entries and
entrants (including an entrant’s identity, age and place of residence) and reserves the
right, in its sole discretion, to disqualify any individual who the Promoter has reason to
believe has breached any of these Terms and Conditions, tampered with the entry
process or engaged in any unlawful or other improper misconduct calculated to
jeopardise fair and proper conduct of the promotion. Errors and omissions may be
accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its
rights at any stage does not constitute a waiver of those rights. The Promoter's legal
rights to recover damages or other compensation from such an offender are reserved.

9. Incomplete, indecipherable or illegible entries will be deemed invalid.

10. Multiple entries permitted, subject to the following: (a) each entry must be
substantially unique; and (b) each entry must be submitted separately and in
accordance with entry requirements.

11. If there is a dispute as to the identity of an entrant, the Promoter reserves the
right, in its sole discretion, to determine the identity of the entrant.

12. This is a game of skill and chance plays no part in determining the winner(s). Each
entry will be individually judged based on artistic and creative merit of the Logo
submitted by each entrant.

13. The judging will take place at 77 Market Street, Wollongong NSW 2500 on
05/08/19 from midday AEST.

14. Entries will be divided into two categories, being individual entries and school
student entries, as indicated on the entry form.

15. One overall winner will be selected initially. In the event the best overall entry as
determined by the judges is from an entrant from the school student category, that
entrant will be awarded the major prizes and the school prize, as set out below. In the
event the best overall entry as determined by the judges is from an entrant from the
individual category, that entrant will win the major prizes only and the judges will select
the next best entry from all entries in the school student category only in order to award
the school prize.

16. The Promoter’s decision is final and no correspondence will be entered into.

17. The best overall Logo as determined by the judges may be adopted by Wollongong
2022 Ltd (the local organising committee of the 2022 UCI Road World Championships)
as the official logo subject to UCI approval.
18. Subject to clause 15, the major prizes to be awarded to the entrant that
submitted the best Logo are as follows:

● Local travel/tourism experience package facilitated by Destination


Wollongong including:
o ​Symbio Wildlife Park Family Pass valued at $96. Valid until
15/2/2021. ​o ​Just Cruising Trike Tours 1hr Grand Pacific Drive Tour for four
people, valued at $440. Valid until November 2020. ​o ​Science Space 12 month
membership for a family of four,
valued at $110. Valid until November 2020. ​o ​Breakout Bar Room Experience
for up to 8 people on a weekend day (dependant on availability),
valued at $130. Valid until April 2020

o ​Illawarra Fly Treetop Adventures Family Pass, valued at $70.


Valid until April 2022 ​o ​Grilled Burgers Wollongong $100 Lunch Voucher. Valid
for three
months from date of issue. ​o ​Steelers Club Wollongong $100 Food and
Beverage Voucher.
Valid anywhere within the club until 31/12/2020. ​o ​Novotel NorthBeach
Wollongong 1 night’s accommodation including buffet breakfast for 2
valued at up to $350. Valid until November 2020, dependent hotel
availability.

● A VIP Package to the 2022 UCI Road World Championships including VIP
Hospitality for 2 people to each day of the Championships (7 days), meet and
greet with the Australian Cycling Team and tickets for 2 to the UCI Dinner.
Total prize valued at $18,150. Winner is responsible for their own travel to
and from the Championships.

19. Subject to clause 15, the school prize to be awarded is a full day learning skills
experience for up to 7 classes (max 30 students in each session) and international
cyclists to come and speak at a school assembly. Total prize valued at $1980.
20. Any ancillary costs associated with redeeming any voucher/gift card/ticket are not
included. Any unused balance of any voucher/gift card will not be awarded as cash.
Redemption of any voucher/gift card/ ticket is subject to any terms and conditions of the
issuer including those specified on the voucher/gift card/ ticket.

21. If the winner of any prize is under the age of 18 years, the prize will be
awarded to the winner's nominated parent or guardian.

22. If for any reason a winner does not take or redeem a prize (or an element of the
prize) at or by the time stipulated by the Promoter, then the prize (or that element of the
prize) will be forfeited.

23. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion,
reserves the right to substitute the prize (or that part of the prize) with a prize to the
equal value and/or specification.

24. The Championship ticket prizes are subject to the event venue and ticket terms and
conditions, including any applicable age restriction. The Promoter and event organisers
hereby expressly reserve the right to eject any winner (and/or his/her companion/s) for
any inappropriate behaviour, including but not limited to intoxication, whilst participating
in any element of the prize.

25. The “meet & greet” element awarded as part of the major prize provides the winner
(and their companions) with an opportunity to meet one or more members of the
Australian Cycling Team. These elements of the prize are not guaranteed and are

subject to the goodwill of the team members on the day. ​3

The Promoter accepts no responsibility and will not offer any alternative in the
event that these elements of the prize cannot be offered for any reason.

26. Prizes, or any unused portion of a prize, are not transferable or exchangeable
and cannot be taken as cash, unless otherwise specified.

27. As a condition of accepting any prize, the winner agrees to assign all of their rights,
title and interest (including copyright) in and to their entry (which shall include their
Logo) to the Promoter and its assigns, and to execute any documents to confirm such
assignment. Entries will not be returned to any entrant.

28. As a condition of entering this promotion, each entrant licenses and grants the
Promoter, its affiliates, sub-licensees and assignees a non-exclusive, royalty-free,
perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify,
adapt, publish and display their entry (which shall include Logo) for any purpose,
including but not limited to future promotional, marketing or publicity purposes, in any
media, without compensation, restriction on use, attribution or liability.

29. Entrants consent to the Promoter using their name, likeness, image and/or voice in
the event they are a winner (including photograph, film and/or recording of the same) in
any media for an unlimited period without remuneration for the purpose of promoting
this promotion (including any outcome), and promoting any products manufactured,
distributed and/or supplied by the Promoter.

30. If this promotion is interfered with in any way or is not capable of being conducted
as reasonably anticipated due to any reason beyond the reasonable control of the
Promoter, including but not limited to technical difficulties, unauthorised intervention or
fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent
permitted by law (a) to disqualify any entrant; or (b) to modify, suspend, terminate or
cancel the promotion, as appropriate.

31. Any cost associated with accessing the promotional website is the entrant’s
responsibility and is dependent on the Internet service provider used.

32. Nothing in these Terms and Conditions limits, excludes or modifies or purports to
limit, exclude or modify the statutory consumer guarantees as provided under the
Competition and Consumer Act, as well as any other implied warranties under any
similar consumer protection laws in the States and Territories of Australia
(“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded,
including the Non-Excludable Guarantees, the Promoter (including its respective
officers, employees and agents) excludes all liability (including negligence), for any
personal injury; or any loss or damage (including loss of opportunity); whether direct,
indirect, special or consequential, arising in any way out of the promotion.

33. Except for any liability that cannot by law be excluded, including the Non-Excludable
Guarantees, the Promoter (including its respective officers, employees and agents) is
not responsible for and excludes all liability (including negligence), for any personal
injury; or any loss or damage (including loss of opportunity); whether direct, indirect,
special or consequential, arising in any way out of: (a) any technical difficulties or
equipment malfunction (whether or not under the Promoter’s control); (b) any theft,
unauthorised access or third party interference; (c) any entry or prize claim that is late,
lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter)
due to any reason beyond the reasonable control of the Promoter; (d) any variation in
prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by
a winner or entrant; or (f) use of a prize.

34. The Promoter collects personal information ("PI") in order to conduct the promotion
and may, for this purpose, disclose such PI to third parties, including but not limited to
agents, contractors, service providers, prize suppliers and, as required, to Australian
regulatory authorities. Entry is conditional on providing this PI. The Promoter will also
use and handle PI as set out in its Privacy Policy, which can be viewed at
https://www.fairfaxmedia.com.au/company/privacy/privacy​. In addition to any use that
may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite
period, unless otherwise advised, use the PI for promotional, marketing, publicity,
research and profiling purposes, including sending electronic messages or telephoning
the entrant. The Privacy Policy also contains information about how entrants may opt
out, access, update or correct their PI, how entrants may complain about a breach of
the Australian Privacy Principles or any other applicable law and how those complaints
will be dealt with. All entries become the property of the Promoter. The Promoter will not
disclose PI to any entity outside of Australia.

35. The Promoter is Illawarra Newspapers Holdings Pty Ltd (ABN 95 000 075
025) of 77 Market Street, Wollongong NSW 2500.
