DEED OF DONATION
KNOW ALL MEN BY THESE PRESENTS:
This Deed of Donation made and entered into by and between:
BARANGAY DIDADDUNGAN, PALANAN, ISABELA, represented by Brgy.
Chairman ROMAR A. DEL ROSARIO, of legal age, Filipino, married, and a
resident Didadungan, Palanan, Isabela (hereinafter referred to as the "DONOR");
- and -
LOCAL GOVERNMENT OF PALANAN, ISABELA, represented by Municipal
Mayor ELIZABETH B. OCHOA, likewise of legal age, Filipino, married, and a
resident Didadungan, Palanan, Isabela (hereinafter referred to as the "DONEE");
WITNESSETH: That
WHEREAS, the DONEE is the true and registered owner of a parcel of land
declared with Tax Declaration No. 15-19-0008-00321, located at Logpond, Diddadungan,
Palanan, Isabela, more particularly described as follows:
“A parcel of residential lot situated in the Barrio of Diddadungan, Municipality of
Palanan, Province of Isabela, Island of Luzon. Bounded on the NW by PIN 29, on the NE
by PIN 27, on the SE by Pacific Ocean and on the SW by PIN 45 covered by Tax
Declaration No. 15-19-0008-00321 (PIN 011-19-0008-018-28) and assessed in the amount
of P29, 160.00, containing an area of TWO THOUSAND FOUR HUNDRED SQUARE
METERS (2,400) sq. m. more or less.”
WHEREAS, Barangay Diddadungan has been pre-selected as the site for the
establishment of a Community Fish Landing Center.
WHEREAS, the DONOR supports the establishment of a Community Fish Landing
Center within their jurisdiction as evidence by a Resolution of the Barangay Council
(Annex “A”).
NOW, THEREFORE, for and in consideration to support to the establishment of
Community Fish Landing Center, the DONOR hereby voluntarily GIVES, TRANSFERS
and CONVEYS, by way donation, unto the said DONEE, and his assigns, the above
described parcel of land, including all the improvements found and standing thereon, free
from all liens and/or encumbrances, subject to the following conditions:
1. The above described parcel of land shall EXCLUSIVELY be used as site for
construction of a Community Fish Landing Center.
2. That if the above described parcel of land shall no longer be used by the
DONEE as construction site for Community Fish Landing Center, the same
shall be reverted to the DONOR.
The DONOR hereby undertakes that he, his heirs, successors and assigns shall
warrant and defend the title to the real property subject of this Deed against all claims of
all persons or entities. The DONOR also guarantees the right of the DONEE to take
possession of the property subject of this agreement upon the signing and execution of this
agreement and will defend the latter against all judicial or administrative actions for
eviction.
Capital gains tax, transfer tax and other taxes, fees and charges that may be imposed
on the transfer of title in favor of the DONEE shall be for the sole account of the DONEE.
This Agreement shall be valid and binding not only on the parties herein but also on
their heirs, agents, representatives, successors and assigns.

ACCEPTANCE
The DONEE, for and in behalf of the Local Government of Palanan, Isabela, hereby
accepts and acknowledges the donation from Diddadungan, Palanan, Isabela, and
expresses her most sincere appreciation for the benevolence of the DONOR.
