AFFIDAVIT OF DENIAL

I, xxxxxx, of legal age, ___________citizen, married and with


domestic residence at ___________________after having been duly
sworn to in accordance with law, depose and state:

1. That I was born on ____________ in____________;

2. That I was granted a Probationary Permanent Visa under Section


13 paragraph (a) of the Philippine Immigration Act by virtue of my
marriage to a Filipina, namely xxxxxx;

3. That I applied for a Record Clearance from the National Bureau of


Investigation and was cleared of any pending case/s;

4. That I am downgrading my probationary visa with the Bureau of


Immigration when I received an information that my namesake, a
certain xxxxxx, a government employee, has a pending criminal case
with the Sandiganbayan and was issued a Hold Departure Order
(HDO);

5. That I am scheduled to depart from the Philippines on xxxxxx;

6. That I hereby unequivocally deny I am the same individual or any


involvement in the aforementioned case considering that the accused
or respondent in the said case is Filipino citizen;

6. That I also declare under oath that I am not in any way involved in
any case proceeding as either plaintiff/complainant
or defendant/accused in the Philippines and abroad, specifically with
regard to the aforementioned case;

7. Moreover, I cannot be the subject of any complaint in the


Sandiganbayan or even be considered a government employee or
public officer employed in the government of the Republic of the
Philippines as I am a foreigner. This also lend credence that the person
involved in the said case is not me but a different individual bearing the
same name;

9. That I am executing this Affidavit to attest to the foregoing facts and


to deny absolutely and entirely any involvement in the case/s
aforementioned and for all legal intents and purposes.
