PETITION
PETITIONER, through counsel, unto this Honorable Court most
respectfully states:
1. That Petitioner is of legal age, Filipino and a resident of Centro
Ballesteros, Cagayan. Notices and legal processes of this Honorable
Court may be served to the undersigned’s office address;
2. That Petitioner authorized her son, JOEFREY ACEBEDO to initiate
the filing of this Petition for Reissuance of Owner’s Duplicate Copy of
Transfer Certificate Title No. T-12569;
Copy of the Special Power of Attorney is hereby attached as
Annex “A”
3. That Petitioner is one of the heirs of PEDRO CAFUGUANAN, the
registered owner of land situated in _________, Tuguegarao City,
Cagayan covered by Transfer Certificate of Title No. T-12569
particularly described as follows:
“A parcel of land, (Lot 3206 of the Cadastral Survey of
Tuguegarao), situated in the Municipality of Tuguegarao.
Bounded on the N. by Lot No. 3205; on the E. by Lot No. 2736;
on the S. by Lot No. 2735; and on the W. by Lot No. 3207.
Beginning at a point marked 1 on the plan, being N. 52 deg.
02’W., 1000, from B.L.L.M. No. 5; thence s. 2 deg. 33’E.,
102.35m, to point 2; thence S. 85 deg. 54’W., 65.14m, to pint 3;

thence h. 2 deg. 5g’W., 106.02n. to pint 4; thence N. 56 deg.
53’E., 69.50m. to point of beginning; containing an area of
SEVEN THOUSAND TWO HUNDRED FOURTY FOUR (7,244)
SQUARE METERS, more or less.”
Attached hereto is the Electronic copy of TCT No. T-12569
marked as Annex “B”.
4. Petitioner kept the copy of TCT No. T-12569 but was however lost in
her possession;

6. Petitioner tried to find the same and even asked her children if they
were able the secure the aforementioned title, but the same yielded in
negative;
7. Believing that the same was already lost beyond recovery, petitioner
executed an Affidavit of Loss and caused the annotation of the same
on the Transfer Certificate of Title No. T-12569under the custody of
the Registry of Deeds;
Attached hereto is the copy of the Affidavit of Loss and
marked as Annex “C” and the annotation of the Registry of
Deeds marked as Annex “C-1”.
8. That there was no co-owner’s duplicate copy of TCT No. T-12569that
was issued to any person and to the best knowledge of herein
petitioner said copy of Transfer Certificate of Title No. T-12569was
not delivered to any person or entity to secure payment or in
performance of any obligation whatsoever;
9. That there is no pending transaction or document relating to the said
title has been presented or pending registration with the Register of
Deeds;
10. That this petition is not intended to defraud any person or entity
whatsoever;
11. That this petition is filed by the Petitioner to respectfully ask this
Honorable Court to issue an owner’s duplicate copy of TCT No. T-
12569 in lieu of the lost one.
PRAYER
WHEREFORE, premises considered it is most respectfully prayed that
after due notice and hearing, an order be issued by this Honorable court
declaring the owner’s copy Transfer Certificate of Title No. T-12569which

was lost, as null and void and of no force and effect and that the Register of
Deeds of Cagayan be ordered to issue a new owner’s copy of TCT No. T-
12569 in lieu of the lost one.
