AFFIDAVIT OF DESISTANCE

I, Raymart Domasig y Lucero, Filipino, of legal age, and resident of Blk-8, Lot-
19B, Ferrari Road, Luxury Villa. Brgy. San Isidro, Angono, Rizal, after having been
duly sworn to in accordance with law, depose and state:

1. I am one of the complainants in a criminal case for Reckless Imprudence Resulting in


Homicide with Multiple Physical Injuries and Multiple Damage to Property and
Violation of RA 4136 against respondent Ruben Memoria Y Gardose, docketed as
IS No. XV-18 m-INQ-18 before the Office of the Provincial Prosecution of Rizal,
Taytay, Rizal;

2. That after a thorough analysis of my memories of the incident that occurred


on or about 1:00 am of October 14,
2018, I have realized that I cannot point out, beyond reasonable doubt that
the respondent committed the above stated crime as it was too dark to
discern the features of the same with any degree of certainty;

3. Since I could not state with certainty and without doubt the liability of the respondent
I feel compelled to withdraw my complaint against him and I clear him of whatever
responsibility or liability to me.

4. In addition, there was a financial assistance given by the respondent. In view thereof, I
would like to manifest that I now completely and absolutely exonerate the respondent,
his employer or any person, entity, corporation or otherwise, that may be reasonably
connected to him or involved in this case, from any liability in connection with the
above-mentioned case and that I am no longer interested.

5. I hereby desist, in prosecuting the said case;

4. As such, I respectfully pray that the aforementioned case against Ruben Memoria Y
Gardose be withdrawn and/or dismissed.
