AND ABSOLUTE SALE
THIS DEED MADE AND EXECUTED BY:
APOLINARIA TUBOG MORIONES married to Genaro Paer Moriones,
LEBERATO ALEJADO TUBOG, single, CARMELITO ALEJADO TUBOG married to
Carmelita Bandoquillo Tubog, and HONORATA TUBOG VEÑALES married to Paterno
Sojor Veñales, all of legal ages, Filipinos, with residence and postal address at Dauin,
Negros Oriental, Philippines, hereinafter referred to as the HEIRS OF BASILIO
AVANZADO TUBOG;
LUCIO TUBOG MORTE married to Elgina Ejercito Morte, and HERMENIA
MORTE SIBAS married to Jolito Perez Sibas, both of legal ages, Filipinos, with
residence and postal address at Dauin, Negros Oriental, Philippines, hereinafter
referred to as the HEIRS OF CATALINA TUBOG MORTE; and
SERBERTA PAGBUNOCAN VENTRUSA married to Gehino Ventrusa, and
CARMELO TUBOG PAGBUNOCAN married to Enriqueta Ventura Pagbunocan, both of
legal ages, Filipinos, with residence and postal address at Dauin, Negros Oriental,
Philippines, hereinafter referred to as the HEIRS OF EULOGIA TUBOG
PAGBUNOCAN;
All hereinafter referred to as HEIRS-VENDORS.
In favor of:
ADRIANO TRUITA married to _________________, of legal age, Filipino with
residence and postal address at Dauin, Negros Oriental, Philippines, hereinafter
referred to as VENDEE;
WITNESSETH:
WHEREAS, EUSTAQUIA AVANZADO married to ________________ is the
registered owner of a parcel of land, Lot No. 3358, Pls-759 situated in Bolocboloc,
Dauin, Negros Oriental, covered by Original Certificate of Title No. F-V-13964, which
parcel of land is more described and bounded as follows:

“A parcel of land (Lot No. 3358, Pls-759 situated in Bolocboloc,
Dauin, Negros Oriental, Philippines. Bounded on the SE.., along line 1-2
by Lot 3366, Pls-759; on the SW., along line 2-3 by Lot 3359, Pls-759; on
the NW., along line 3-4 by Public Forest; on the NE., along line 4-5 by Lot
3356, Pls-759; along line 5-6 by Lot 3357, Pls-759; and on the SE., along
line 6-1 by Lot 3367, Pls-759. Containing an area of THREE THOUSAND
FOUR HUNDRED EIGHTEEN (3,418) SQUARE METERS, more or less.”
WHEREAS, EUSTAQUIA AVANZADO married to ________________ died
intestate and without debts on ________________ and _________________,
respectively, at Dauin, Negros Oriental, and at the time of her/their death(s) she/they
was/were survived by her/their children, namely BASILIO AVANZADO TUBOG,
CATALINA TUBOG MORTE and EULOGIA TUBOG PAGBUNUCAN as her/their only
forced and surviving compulsory heirs;
WHEREAS, BASILIO AVANZADO TUBOG married to Restituta Alejado Tubog
died intestate and without debts on ________________ and on _________________ at
Dauin, Negros Oriental, respectively, and at the time of his/their death(s) he/they
was/were survived by his/their children namely APOLINARIA TUBOG MORIONES,
LEBERATO ALEJADO TUBOG, CARMELITO ALEJADO TUBOG and HONORATA
TUBOG VEÑALES, as his/their only forced and surviving compulsory heirs;
WHEREAS, CATALINA TUBOG MORTE married to Sofio Santillan Morte died
intestate and without debts on ________________ and on _________________ at
Dauin, Negros Oriental, respectively, and at the time of her/their death(s) she/they
was/were survived by her/their children namely LUCIO TUBOG MORTE and HERMINIA
MORTE SIBAS, as her/their only forced and surviving compulsory heirs;
WHEREAS, EULOGIA TUBOG PAGBUNOCAN married to Dionesio Moriones
Pagbunocan died intestate and without debts on ________________ and on
_________________ at Dauin, Negros Oriental, respectively, and at the time of
her/their death(s) she/they was/were survived by her/their children namely SERBERTA
PAGBUNOCAN VENTRUSA and CARMELO TUBOG PAGBUNOCAN, as her/their only
forced and surviving compulsory heirs;
WHEREAS, invoking Section 1, Rule 74, of the Rules of Court, and the laws on
intestate succession, the herein HEIRS, hereby adjudicate unto themselves the above
described parcel of land, free from all liens and encumbrances whatsoever, subject
however, to Section 4, Rule 74, re: The liabilities imposed therein.
WITNESSETH FURTHER:
WHEREAS, for and in consideration of the sum of TWENTY-FIVE THOUSAND
PESOS (PHP25,000.00), in Philippine Currency, receipt in full of which the HEIRS-
VENDORS, hereby acknowledged and confessed to their entire satisfaction from the
VENDEE, do, by these presents, hereby SELL, CEDE, TRANSFER and CONVEY, in
free simple and in a manner absolute and irrevocable, unto and in favor of the aforesaid
VENDEE, the above described parcel of land together with all the improvements found
thereon, his heirs, successors and assigns, free from mortgages and liabilities
whatsoever;
WHEREAS, the HEIRS-VENDORS warrant clean registration and lawful
possession and ownership over the above described parcel of land, and that notices of
sale were given to adjoining owners and possible redemptioners but who refused to buy
the same.
