Arun Kumar filed a complaint against Shiv Kumar with the Kashmere Gate Police Station in Delhi. [1] Arun Kumar had purchased a property worth Rs. 1,500,000 from Shiv Kumar and had given him some post-dated cheques as security. [2] Shiv Kumar is now threatening legal action against Arun Kumar regarding the refund of payments, even though the cheques were only meant as security. [3] Arun Kumar requests that no action be taken against him and his family based on Shiv Kumar's complaints, and for the police to take strict action against Shiv Kumar for misusing the security cheques.

I, Arun Kumar, S/o- Sh. Dharambir Singh and Mrs. Komal W/o- Sh. Arun Kumar

R/o- E-4/341, Gali No.-8, Sonia Vihar, Delhi-110094, ,

1. That the complainants are peace loving and law abiding citizen of India. They

are residing At House No. E-4/341,Gali no.8 Sonia Vihar, Delhi-110094.

2. That the complainants had purchased one property of Rs. 1,500,000 (Fifteen

lac Rupees Only) form Shiv Kumar S/o Lt. Hari Chand R/o 767/58, First

Floor, Prakashwati,` Motor Market, Chabi Ganj Chowk , Kashmere Gate,

Delhi-110006 on dated 22.12.2015 onward .

3. That the complainants had given some security cheques i.e ( cheque no.

465087, 465088, 465089), for security purpose of State Bank Of India to

the accused which was given at the time of registry of the flat.

4. That the payment details are , 16.01.2015 Rs. 50,000/-(fifthly thousand only ),

03.09.2015 Rs. 50,000/- (fifthly thousand only ), 12.10.2015 Rs. 1,99,000/-

( on lakh nineteen thousand only), 28.12.2015 Rs. 2,00,000/- ( two lakh

only ). Rest 10,00,000/- (ten lakh only) in form of loan.

5. That the accused namely Shiv Kumar was clearly informed that the above said

cheques are the security cheques even the complainant namely Sh. Arun

Kumar has deposited extra amount of installments to the accused which is not

mention in ever.

6. That the complainant has received payment details on builders letter head , in

which accused had promised for one double bed, Almirah, one RO, One
Inverter , One Modular Kitchen with chimani , Two Fans, one Designer wall

and parking for bike , showed in letter head and also showed the details of

extra payment to the accused letter head, even then the accused Shiv Kumar

threatened the accused Arun kumar and his wife Ms Komal for initiating the

legal proceedings against him in False cases.

7. That on 23.07.2018 the accused Shiv kumar through his advocate sent the legal

notice to the complainant regarding the refund of payment.

8. That on 04.08.2018 the complainant sent the reply of the Legal notice through

his advocate to the advocate of the accused by stating that these cheques are for

securities reason.

9. That the accused has misused the security cheques of the complainant for

harassment of the complainant.

It is, therefore, further requested not to take any action on the complaint of Sh.

Shiv Kumar against the complainant and his another family members.

It is, therefore, further requested kindly take the strict action against the

accused as he misused the security cheques of the complainant.

Copy of this complaint be taken on record.
