Definition of Land

Definition of Land

In general sense, Land means the solid portion of the earth’s surface. The word
“land” includes not only the soil, but everything attached to it, whether attached by
the course of nature, as trees, herbage, and water, or by the hand of man, as
buildings and fences.

Land is the solid material of the earth, whatever may be the ingredients of which it
is composed, whether soil, rock, or other substance.

Coke stated that, Land in the legal signification comprehendeth any ground, soil
or earth whatsoever, as meadows, pastures, woods, moors, waters, marshes,
furzes and heath. It legally includeth also all castles, houses and other buildings.

The modern legal concept of land embraces not only the physical surface of the
earth but also the buildings, minerals etc.

In Rogers vs. Longsdon(1967) it was held that an artificial heap of waste could
become part of the land when grass and trees grows on it.

According to Cambridge Dictionary, Land means the surface of the earth that is
not covered by water.

According to Section 2(16) of the State Acquisition and Tenancy Act,1950,


“land” means land which is cultivated, uncultivated or covered with water at any
time of the year, and includes benefits to arise of land, houses or buildings and
also things attached to the earth, or permanently fastened to anything attached to
the earth.
