Abstract
Consumer rights are the rights given to a consumer to protect him from being cheated by
unscrupulous traders and service providers. Consumer rights are designed to ensure fair trade
competition, free flow of truthful information in the market place and may provide additional
protections for the weak and those unable to take care of themselves. These rights are well
defined by the Consumer Protection Act and there are agencies like the government, consumer
courts and voluntary consumer organizations that work towards safe guarding the consumer
rights. Even though the Consumer Protection Act has been in operation since 1986, yet the
consumers are not fully aware about the various provisions of the Act particularly the rights as
consumers. In this study an attempt is made to determine the evolution of consumer rights and
the level of awareness of sample respondents of Dindigul district on consumer rights. The level
of awareness about the consumer rights and the prevalence of various redressal machineries will
be an indication of the successful performance in consumer protection movement.
Introduction
The Consumer Protection Act was enacted in 1986 to provide protection to the consumers. But
even after 30 years of its enactment, the Consumer Protection Act still faces certain problems
and consumer protection still remains questionable in India. Though several steps have been
initiated at the central and state government level, still much remains to be achieved. One of the
lacunae is the lack of awareness about their rights. Akram in his study entitled “Consumer
Protection in India under the Shadow of Legislations “argues that consumerism in our country
has not yet reached the take off stage. It is because a large number of Indian consumers are
poor, illiterate ignorant, ill-informed and unorganized. In order to check the state of affairs, it is
important to educate the consumers about their rights and the remedies available to them. With
the technological advancements, malpractices and unscrupulous practices against the consumers
have increased manifold. Even the educated people are not fully aware about their rights as a
consumer and how to protect themselves from the exploitations. Whenever there is some defect
in goods, the traders and manufacturers blame each other but none of them provides any relief
to the consumers. Such a scenario necessitates that education and awareness regarding the rights
of the consumers must be inculcated among the general public. They must know about their
rights and how to make them meaningful. Unless the awareness reaches the whole population
consumerism is a myth and it will not be helpful. Evolution of the Concept of Consumer Rights
Consumers had a little protection in the world market place before the1950s. On March 15,
1962, John F .Kennedy, the then President of United States of America put forth the Consumer
Bill of Rights to help consumers understand their rights and responsibilities. The rights are
Right to Safety, Right to be Informed, Right to Choose and Right to be Heard. Further
worldwide consumer movement led by Consumer International, a global federation added four
more rights that is Right to Basic Needs, Right to Redress, Right to Consumer Education and
Right to Healthy Environment. In 1985, eight basic consumer rights were adopted by the United
Nations Assembly, which resulted in consumers having stronger consumer protection policies
worldwide. On April 9, 1985, the General Assembly of the United Nations passed a resolution
adopting a set of guidelines for consumer protection and authorized Secretary General, United
Nations to persuade the member countries, especially the developing ones to adopt policies and
laws for better protection of the interests of the consumers. Moreover Right to Boycott is the
latest addition to the rights of consumers. These rights declared and recognized internationally
added a new dimension to consumer protection. At present the consumers have all these rights
for better protection. But in India the Consumer Protection Act 1986 recognizes only six of
these nine rights. They are Safety, Information, Choice, Representation, Redressal and
Consumer Education.
Need for Consumer Protection
(a) Social Responsibility
The business must be guided by certain social and ethical norms. It is the moralresponsibility of
the business to serve the interest of consumers. Keeping in line withthis principle, it is the duty
of producers and traders to provide right quality andquantity of goods at fair prices to the
consumers.
(b) Increasing Awareness
The consumers are becoming more mature and conscious of their rights against the malpractices
by the business. There are many consumer organisations and associations who are making
efforts to build consumer awareness, taking up their cases at variouslevels and helping them to
enforce their rights.
(c) Consumer Satisfaction
Father of the Nation Mahatma Gandhi had once given a call to manufactures and
traders to “treat your consumers as god ”. Consumers satisfaction is the key to success of
business. Hence, the businessmen should take every step to serve the interests of consumers by
providing them quality goods and services at reasonableprice.
(d) Principle of Social Justice
Exploitation of consumers is against the directive principles of state policy as laiddown in the
Constitution of India. Keeping in line with this principle, it is expectedfrom the manufacturers,
traders and service providers to refrain from malpractices
and take care of consumers‟ interest.
(e) Principle of Trusteeship
According to Gandhian philosophy, manufactures and producers are not the realowners of the
business. Resources are supplied by the society. They are merely thetrustees of the resources
and, therefore, they should use such resources effectivelyfor the benefit of the society, which
includes the consumers.
(f) Survival and Growth of Business
The business has to serve consumer interests for their own survival and growth. Onaccount of
globalisation and increased competition, any business organisation whichindulges in
malpractices or fails to provide improved services to their ultimate consumershall find it
difficult to continue. Hence, they must in their own long run interest, become consumer
oriented.
Causes of Consumer Exploitation
1. Illiteracy and Ignorance: Consumers in India are mostly illiterate and ignorant. They do not
understand their rights. A system is required to protect them from unscrupulous businessmen.
2.Unorganised Consumers: In India consumers are widely dispersed and are not united. They
are at the mercy of businessmen. On the other hand, producers and traders are organized and
powerful.
3.Spurious Goods: There is increasing supply of duplicate products. It is very difficult for an
ordinary consumer to distinguish between a genuine product and its imitation. It is necessary to
protect consumers from such exploitation by ensuring compliance with prescribed norms of
quality and safety.
4. Deceptive Advertising: Some businessmen give misleading information about quality, safety
and utility of products. Consumers are misled by false advertisement and do not know the real
quality of advertised goods. A mechanism is needed to prevent misleading advertisements.
5. Malpractices of Businessmen: Fraudulent, unethical and monopolistic trade practices on the
part of businessmen lead to exploitation of consumers. Consumers often get defective, inferior
and substandard goods and poor service. Certain measures are required to protect the consumers
against such malpractices.
Lack of knowledge: The main reason for exploitation of consumers is lack of knowledge.
Several consumers do not have the knowledge about the price, quality, services related
commodities. Therefore, consumers simply trust the facts told to them by the sellers and
purchase goods, thus become trapped and are exploited.
6. Consumer's indifference towards the market: There is a large group of such consumers who
behave indifferently regarding purchasing. There are some consumers who think as- what to do,
everything is alright, leave it , why to take cash memo, whatever goods the shopkeeper gives is
good, things should be cheap, good and durable , What is the need of the standardization marks
like ISI and AGMARK etc. The producers take full advantage of this indifferent behaviour of
consumers and succeed in exploiting them.
7. Tele Marketing Today in the age of computers, tele- marketing and e-commerce have
become very popular. You also must have seen the advertisement on T.V. The information
about the goods and the prices is also given in the advertisement. The consumer can send the
required money and get the commodity through parcel. But very often the consumers feel
cheated by this deal.
8. Limited Information: In this age of globalization there are several types of products in the
market. Producer is free to produce. There is no fixed law for quality and rate. There is lack of
knowledge about several aspects of goods like rate, quality, rules for usage, rules for selling etc.
Therefore a consumer makes wrong choice and suffers financial loss.
9. Monopoly : Monopoly means the right on the production and distribution of a commodity of
a producer or a group of producers. In the state of monopoly producers have arbitrary behavior
regarding the prices and the quality and availability of the goods. As a result, producers
succeeded in exploiting consumers.
Rights and Duty of Consumers In India (Consumer Court)
Right to Safety: The right to be protected against goods which are hazardous to life and
property.
Right to Information: The right to be informed about the quality, quantity, purity, price, and
standards of goods.
Right to Choose The right to be assured access to a variety of products at competitive prices,
without any pressure to impose a sale, i.e., freedom of choice.
Right to be Heard: The right to be heard and assured that consumer interests will receive due
consideration at appropriate forums.
Right to Seek Redressal: The right to get relief against unfair trade practice or exploitation.
Right to Education: The right to be educated about the rights of a consumer.
Duties of consumers in India
Along with the Rights of the consumer, here are some responsibilities of the consumer, which
should be followed.

place.

consumer have to know about the product.
Malpractices of Businessmen: Only a consumer can avoid and stop the malpractices of the
businessmen by opposing them. So this is one of the duties of consumer

The complete FAQ on Consumer ACT
Consumer Court Complaints are generally categorized into three sections.1
Where the value of goods and services involved is less than Rs. 20 Lakhs in value, you will
have to file the complaint in the District Forum constituted in the specified districts of a
State.
Where the value of goods and services involved is more than Rs. 20 Lakhs in value but does
not exceed Rs 1 crore you will have to file the complaint with the State
Commission (Address of Consumer Court in India) constituted in the capital cities of the
different states
Where the value of goods and services involved is more than one crore in value, then you
can file a complaint with the National Commission which has been constituted only in New
Delhi.
What are the particulars that should be furnished along with the complaint?
The following details should be prepared before filing a complaint in Consumer Court.
Name and complete address of the complainant
Name and full address of the opposite party/parties.
Date of purchase of goods or services availed.
Amount paid for the above purpose.
Particulars of goods purchased with numbers or details of services availed
Details of complaint, whether it is against Unfair Trade Practice/supply of defective
goods/deficiency in service provided / collection of excess price, should explicitly be
mentioned in the complaint petition.
Bills/receipts and copies of connected correspondence, if any.
The relief sought for under this Act.
The complainant or his authorized agent should sign a complaint.
What is the time limit for filing a complaint?
A complaint has to be filed within two years in the Consumer Court from the date on which the
cause of action/ deficiency in service/defect in goods arises. However, a complaint may also be
filed after two years, if the complainant satisfies the District Forum that he/she has sufficient
reasons for not filing the complaint within such period.
