AFFIDAVIT OF ADVERSE CLAIM

I, GLICERIA ZARA CAPINIG, of legal age, Filipino, widow, and a resident of


Brgy. Espinosa, Masbate City, after having been sworn to in accordance with law, do
hereby depose and state:

1. That I am one of the heirs of the late Agapito Zara;

2. That Agapito Zara, during his lifetime, bought parcels of land with an area of
fifty six (56) square meters, more or less, located in Quezon St., Masbate City
from Lydia D. Guadayo and Leonora D. Guadayo, as evidenced by Deed of
Absolute Sale of a Portion of a Parcel of Unregistered Residential Land,
copies of which are hereto attached and marked as Annexes “A” and “B”;

3. That said transfers were duly annotated in the Tax Declarations covering said
parcels of land, copies of which are hereto attached and marked as Annexes
“C” and “D”;

4. That on July 2019, I learned that an Original Certificate of Title No.


2013000150 was issued in favor of Leonora D. Guadayo despite the fact that
such lot was already sold to my father, Agapito Zara, way back May 1990;

5. That unless an adverse claim is annotated on the aforedescribed Original


Certificate of Title, the heirs of Agapito Zara are in danger of being defrauded
and deprived of their just and valid right over the aforedescribed parcel of
land and, as such, I am executing this Affidavit in support of my request for
the annotation of an adverse claim over the parcel of land described herein.

FURTHER AFFIANT SAYETH NAUGHT.
