CAR HIRE AGREEMENT
This agreement is made and entered into this 1st day of April in the year 2007 by and
between: ………. New Delhi (here in called the “Owner” which expression shall
include successors, nominees and assigns of the First Part).
AND
XXXXXX. incorporated under the provisions on Companies act 1956, having its
corporate office at ----------------, herein called the “Hirer” which expression shall include
its successors, nominees, assigns and liquidators of the second part:
Wherein the Owner is the registered owner of a HYUNDAI SANTRO car (Model and
engine displacement 1300 cc) bearing the registration number ___________________
duly registered with the Regional Transport Authority, NEW DELHI on
(hereinafter called the “Car” which expression shall include all accessories, services and
offerings as per the Annexure to this agreement).
AND WHEREAS the Owner is agreeable to give on hire and the Hirer is also agreeable
to take on hire the said Car on the following terms and conditions:
1. That the Car is given on hire by the Owner for a period of one year and 24 hours
throughout the day from the first day of APRIL 2007 .The agreement will
automatically extend for another year unless terminated.
2. That the hirer shall pay to the Owner a fixed monthly rent @ Rs 15000/-. This
monthly rent would be payable by the 5 th day in the following month through
account payee cheque by the Hirer to the Owner. The monthly rent amount
would arise on the rental of the car.
3. That the Owner would be solely responsible for the payment of the Road Tax as
well as any other tax or levy and also responsible for getting the vehicle insured,
in an amount satisfactory to Hirer, and paying for the insurance. A copy of the
said insurance certificate shall be submitted to the Hirer at or before the
execution of this agreement. In case the Hirer makes any such payment under
this paragraph, the Hirer shall get the same reimbursed from the Owner.
4. That the Owner would be solely liable for any civil or criminal liability for any
default under Motor Vehicles Act, 1988 or under any law for the time being in
force in respect of any offence relating to the Car.
5. That the Hirer shall be free to use the Car, in any manner they like in any part of
India, and that will be within its rights to give the use of Car to any person and
the Owner shall have no right of objection thereof.
6. That the Owner as well as the Hirer can terminate this agreement by giving one
month’s notice.
7. That the Owner and the Hirer can add, delete, substitute or modify any of the
aforesaid conditions by a mutual agreement in writing.
