Jai Prakash took over a school by the name of Lal Bahadur Shastri
Senior Secondary School at RK Puram, New Delhi. The members
of the Lal Bahadur Shastri family were invited to various school
functions
1994 Jai Prakash discussed with the Respondent to expand the school for
higher education. The Respondent requested to become a part of
the trust though according to him he neither had any money nor
any resources
20.12.1994 Lal Bahadur Shastri Trust was created and the trust deed was
registered.
Elaborate rules of the trust were framed which mandated as per
clause 29 of the just deed that the transfer, disposal or mortgage of
the the corpus of any trust properties will be deal with only with the
consent of atleast 3/4th Majorities of all trustees and all proceedings
shall be signed by the chairman
1995 Jai Prakash contributed significant resolute and helped the
establishment of Lal Bahadur Shastri Institute and Management
01.04.1996 Trust was paid 5% of the charge from students.
The Complainant (wife of Jai Prakash) and Manju Shastri (wife of
Shri Lal Bahadur Shastri) became permaenet trustees
2002 Trust made an application for allotment of land to DDA
27.11.2002 DDA allotted the plot of land at admeasuring 3000 Sq. Mtr. In
sector 11 , plot 11/7, Dwarka, New Delhi
29.12.2003 Possession was handed over to the Trust.
12.05.2005 Trust made another request for allotment of land and DDA vide
letter allotted another portion of land admeasuring of 1000 on the
same day.
07.09.2005 The possession of the above mentioned was handed over to the
trust
2005-2007 The construction was carried out under the complainant’s
supervision and 25 crores were borne by the trust. The complainant
provided signed checks to the office of the trust which were
delivered to him in the hospital along with other papers concerning
the Trust due to the complainant being seriously ill
27.06.2007 DDA granted the building plans and the trust applied to get additional Floor
Area Ratio.
26.11.2008 Trust applied for change in master plan from 2001 to 2021.
20.10.2009 Sri Sandeep Shahtri and Sumit Aggarwal were also inducted as
member.
31.5.2010 DDA issued revised .
2011 Jai Prakash suffered from medical problems. The respondent
approached Jai Prakash to form a new society for the weaker
section of society to which the complainant agreed. The
respondent with T.N. Kapoor and Priscilla Mohan who have
nothing to do with the trust, illegally represented themselves as
the trust and used the last page of subscription to illegally
convert the trust into a society by the name of Lal Bahadur
Shastri Educational Society thereby cheating the Registrar of
Society seeking registration.
20.07.2012 The three accused persons got the plots and immovable
assets constructed by the trust in the name of newly
registered society vide perpetual lease deed dated
20.07.2012. It was done so by the Respondent fraudulently
creating a memorandum by which the trust was converted
into a registered society without the consent of the 3/4th
trustees.
The land owned by LBSET transferred to LBSES by way of
perpetual lease
13.10.2013 The Hon’ble High Court in writ petition no. (3099/2010), filed
by Trust and its trustees allowed z refund of Rs 7.67 crores to
the Trust
12.09.2014 Mr. Anil Shastri misused a signed undated blank cheque series
of small payments, after 2 years of its signing, by writing the
blank cheque putting the date 12.09.2014 and siphoned off a
sum of Rs 1,61,25,303/- and closed the bank account soon
after.
October Anil Shastri sworn an affidavit in SLP 31548 before the
2014 Supreme Court that land belongs to the Trust.
2015 Jai Praksh found out that the Lal Bahadur Educational Society
was set up and that he had lost control of the Trust by forging
