Jamaica: I am Jamaica Mabini Y Meramonte, 10 years old, Grade 5 student of Villaba
Central School and a resident of Sitio Can-apong Brgy. Suba Villaba, Leyte.
Prosecution: We offer the testimony-complainant of the complainant to prove that the accused
committed the crime upon this person.
Prosecution: Jamaica/ Ms. Witness/ Iday, how long have you been staying at Sitio Can-apong
Brgy. Suba Villaba, Leyte?
Jamaica : Since birth.
Prosec: Where were you on the evening of July 26, 2017?
Jamaica: I am in the house of my friend Christine.
Prosec: What were you doing?
Jamaica: Watching TV.
Prosec: What is the purpose of going there?
Jamaica To hang out with Christine and watch TV
Prosec: Who were there?
Jamaica: Christine
Prosec: Have you executed an affidavit?
Jamaica: Yes

J: Same affidavit I made.
Prosec: We manifest that the witness identified the signature found in the affidavit. We

J: His signature
Prosec: How did you know that it is his signature?
J: I was there when he affixed his signature.

Prosec: In your affidavit, you said that while watching TV at your friend Christine’s
house, JN entered the house. How is he related to you?
Defense: Objection! The question is irrelevant.
Court: Sustained.
Prosecution: We would like to ask how they are related to know if the extent of their
relationship to each other.
Prosec: After entering the house of Christine, what did he do, if any?
J: He suddenly grabbed me and brought me to his house.
Prosec: After bringing you at his house and forcibly embracing you, what else did he do?
J: He undressed me and laid me on top of my body and he also pull down his shorts
and took his penis out and he also touches my vagina using his hands.
Prosec: What else did he do?
J: He threatened me not to tell anyone otherwise he would kill me.
Prosec: What was your reaction when he was doing the acts and threatened you?
J: I was crying and afraid because he was so strong. I never had the chance to
escape him at that time.
Prosec: Did he do something else?
J: Nothing else. He was not successful because my friend Christine arrived at his
house and she saw Joven on top of me undressed.
Prosec: What else happened?
J: Joven suddenly went out of his house and I immediately ran fast going back to
the house of my friend Christine.
Prosec: How did you feel at that time?
J: I feel nervous and was trembling.
Prosec: After the incident, what happened?
J: I went home.
Prosec: At first, did you tell anyone about what happened?
J: No, I never told anyone because I was afraid that Joven would kill me.
Prosec: How did your Aunt and Grandmother knew about the incident?
Defense: Objection! The question is misleading.
Court: If it is alleged in the affidavit, the question is not misleading.
Prosec; How did your Aunt and Grandmother knew about the incident?
J: I told them everything that happened to me on the night of July 26, 2017 because
my playmates bullied me about what happened on that night.

J: My friend, Christine.

Christine: I am Christine Poster y Alvez, 11 years old, Grade 5 student of Villaba Central
School and a resident of Sitio Can-apong Brgy. Suba Villaba, Leyte.
Prosecution: We offer the testimony of Christine Poster y Alvez to prove that the accused
committed the crime against the person of the victim.
Court: Proceed.
Prosec: May I approach the witness?
Court: You may.
Prosec: With regards to Criminal Case 1234, did you execute an affidavit?
C: Yes.
Prosec: Showing to you an affidavit, marked as Exhibit B, what is the relation of this
affidavit to you?
C: My affidavir.
Prosec: Above the affiant, Christine Poster y Alvez, whose name is this?
C: My name.

C: I was at my house.

P: What were you doing on the night of July 26, 2017?
C: I was watching TV with Jamaica when I personally saw accused, JN, entered our
house, suddenly grabbed my friend, and dragged her with him out of our house.
P: What did you do after?
C: I went out of our house and saw Jojo half dragging Jamaica towards the direction
of his house.
P: What else did you do?
C: I followed them slowly and silently. When I was near JN’s house I heard
somebody crying and assumed it was Jamaica so I silently entered his house.
P: What did you see when you entered the house?
C. I saw an undressed Jojo on top of Jamaica who is crying.
P What did you do after witnessing the act?
C: JN saw me and ran after me so I ran faster towards my house and quickly shut
the door when I arrived.
P: How did you know that it was JN?
C: I saw him personally.
P: How did you know JN?
C: I always saw Jojo loitering around the basketball court on my way to and from
school. My parents told me to study harder if I don’t want to become like JN who
does not have job and family.
P: After witnessing the incident, what did you do?
C: I was still shocked so I told my playmates at school about what happened with
Jamaica and Jojo on July 26, 2019.

Jamaica: I am Dr. Oliver Razo, of legal age, married, a municipal health officer of RHU
Villaba, and residing at.Brgy. Poblacion Villaba, Leyte.
Court: State the purpose of presenting your witness.
Prosecution: We offer the testimony of Dr. Razo to as corroborative evidence to formally
testify the contents of the medico-legal.
May I approach the witness?
Court: You may.
Prosec: Dr. Razo, what is your highest educational attainment?
Dr: I finished medicine.
P: In what school?
Dr: UP Manila
P: What licensure did you take?
Dr: Licensure examination for physicians
P: When did you took it?
Dr. 1989
P: After that, did you have formal training?
Dr. Yes, I was a resident doctor at Eastern Visayas Medical Center for 5 years.
P: After that?
Dr. I was hired as municipal health officer at RHU Villaba, Leyte
P: What do you do as municipal health officer?
Dr: I attend to the administration of the rural health service, provide epidemiological
and environmental health services to the community, serve as clinician of the
unit, and act as medico-legal officer of the community.
P: How many medico-legal have you executed?
Dr: More or less 50.
P: Did you issue a medico-legal on July 31, 2017 involving Jamaica Mabini Y
Meramonte?
Dr: Yes.
Court: Showing to you a document, marked as Exhibit C, whose signature appears
above the name of Razo, is this your signature.
Dr. Yes
Prosec: We manifest that the witness identified the signature found in the document. We
pray that the signature be marked as Exhibit C-1.

P: Why did you execute a medico-legal?
Dr Because the patient suffers injury and it is my duty to examine her and execute a
medico-legal.
Prosec: Have you examined rape victims or persons alleging to be rape victims before?
Dr: Yes
Prosec: We pray Your Honor that he is qualified as an expert witness.
Prosec: Could you describe Jamaica’s physical built?
Dr: She was of small built, 4’10 feet flat in height, and a fair complexion.
Prosec: What was your finding after conducting medical examination of her?
Dr: After examining her body, I found that there’s a slight hymenal abrasion on her
organ.
Prosec: Can you describe fully your findings on your medical examination with the
victim?
Dr: The victim suffered a slight laceration since the object used to penetrate on her
organ did not completely enter to meet the depth of the vagina.
Prosec: How do you say that the victim only suffered a slight laceration?
Dr. Because the victim was still a virgin, that’s why it was easily for me to identified
the depth of the laceration.
Prosec: Apart from her private organ, did you examined other parts of her body?
Dr: Yes. I found also that the victim suffered a slight physical injury due to her
spontaneous desistance from the perpetrator.
Prosec: What kind physical injuries had the victim suffered from the perpetrator?
Dr: The victim obtained strain on her arms and it’s difficult for her to move it.
Prosec: What are your other findings?
Dr: That’s all Ma’am.
