JUDICIAL AFFIDAVIT OF COMPLAINT
I,Felix Z. Lumagpas, 30 years old, male, married, and a resident of
SanRoque,Zamboanga City, after having duly sworn to in accordance with law
do hereby depose and say.
PRELIMINARY STATEMENT
I am being questioned by PO1 Reinz Jason P Jumawan, Investigator at
Zamboanga City Police Station 7 (Sta. Maria) situated at Gov. Ramos Avenue,
Sta. Maria, Zamboanga City. The questioning is being held at the same
address. I am answering his question fully conscious and that I do so under
oath and may face criminal liability for false testimony.
QUESTION AND ANSWER
Q1: Do you swear to tell the truth and nothing but the whole truth in
this investigation?
A1: Yes, Sir.
Q2: Please state your names and personal circumstances?
A2: I,Felix Z. Lumagpas, 30 years old, male, married, and a resident of
San Roque, Zamboanga City and also a Barangay Captain by
occupation.
Q3: What is your purpose in coming to the Investigation Section of
the office of Sta. Maria Police Station?
A3: I am hereto file a complaint againstRomulo G. Macapula, 26 years old,
single, male, a seaman by occupation and a resident of San Roque,
Zamboanga City for violation of Article 148 of the Revised Penal Code.
Q4: When and where did the incident happened?
A4: On Dec.16, 2017 between 8:00PM in front of the San Roque
Barangay Hall, Zamboanga City.
Q5: Do you know him personally?
A5: No sir, but I know him by face.
Q6: Will you please narrate to me the facts surrounding the said incident?
A6: That on or about 8:00 o’clock in the evening ofDec.16, 2017, I was in
the Barangay hall making some paper works when I heard the suspect
making some trouble nearby particularly at the Videoke of Luther Van
Droza and I immediately respond to pacify him.
Q7: What happened next?
A7: When Iwent to pacify Romulo G. Macapula, he attacked and assaulted
me and I was able to parry and hold the bolo. I have struggled
pacifying the suspect until I was able to disarm the suspect.After
which, my co-barangay official prompt to help me and I immediately
call for a police assistance thru cellular phone to the Chief of Police of
Sta. Maria Police Station and in that moment the suspect suddenly run
and fled away to unknown direction covered in the darkness of the
night until the police arrived and not to avail ordered the Barangay
officials and Tanods together with the Police Officers to find the
suspect on the whole night until they were able apprehend him at
about 01:00 o’clock in the morning of 17 December 2017 when they
spotted the suspect walking along Estrada Drive in a drunkard manner
and they immediately brought and turn-over him to Sta. Maria Police
Station.
