1, Mr. Rocky isa resident of HIMALA which issituated in VINDYACHAL PRADESH and Mr. Rocky has completed his
under graduation from University of TUCKLAND in engineering in 2011 and has been working in MIPROSoftware
Company situatedin KYDERABAD as asenior software engineer.
2. Ms. Ruby has been working as a junior engineer in KIKO Software Companysituated in RAMBALA in TEPSU
STATE. Ms, Ruby has completed her graduation from ZATHANKOT situatedin TEPSU.
3. Mr. Rocky and Ms. Ruby metin the marriage of the common friend named Mr. Roe which was situated in TIMPAL
in STATE of SIMPAYA.
4, Mr.Rocky and Ms. Ruby had a good talk in the marriage ceremony, due to which they developed friendship, and
they started regular talks on phone, andby this they decided to get married.
5. Mr. Rocky and Ms. Ruby got married in 2016 and settled in SIGNORE in SARNATAKA state as they were working
there nan IT Company. After2years of marriage Mrs. Ruby became pregnant but underwent severe miscarriage,
6. After3 years of miscarriage, Mrs. Ruby became aware that she could not give birth toa healthy child, Mr. Shresth
used tobe very helpfulto Mrs. Ruby when she was struggling with herhardtimes.
7. Mr. Gopi was a divorcee and was very close to Mr. Rocky, who was a neighbor to Mr, Rocky. They had a good talk
and good relation with each other and at times, Mr. Gopi used to spend night to share the family problems with Mr
Rocky.
8.Afteralong time Mr. Rocky and Mrs. Ruby celebrated their marriage anniversary and organized party fortheir well
known friends and colleagues and in that party Mr. Gopi, Mr. Shresth and Mrs. Ruhi Shresth were also invited. On
that day Mrs. Ruby saw that Mr. Gopi and Mr. Rocky were in the bedroom of Mr. Gopi and they werein compromising
positions, when Mrs. Ruby entered into the room. On that day only she also came to know that her husband was not
able to reproduce. Mrs. Ruby had seen the medical report of the Mr. Rocky also, which confirmed that her husband
could notreproduce.,n spite ofall this Mrs. Ruby was interested in adoption, but her husbandwas not.
9. By being so much upset and disturbed with these incidents, Mrs, Ruby went to her maternal house, and Mrs. Ruby
told her parents that her husband never told her about his health problem either prior to their marriage or after the
‘marriage and he kept the information secretly. Mrs. Ruby remained at her maternal house and her husband went for
employment training programme toTOCHIN for two months.
10.Mrs. Ruby wrote about her status on her face book talking about the gay relation and homosexuality of Mr. Rocky,
by wich it was presumed by everyone that Mr. Rocky might bea gay. After some time Mr. Rocky got the information
thathiswife, hasa healthy child, due to extra marital relationship with, Mr. Shresth, but Mr. Rocky did not object tothe
same.
11.Mr.Rocky, Ms. Ruby, Mr. Shresth, Mrs. Ruhi Shresth and Mr. Gopi were of SONDHEIM religion and they were
the members of TRISCO Trust which was situated in KOBEE STATE.txto %

12. TRISCO trust had been established in 1901, and managed by @ Government appointed trustee. Taking into
consideration its growing popularity the Government of KADIA in 1980, constituted the TRISCO CORPORATION
SOCIETY Trustandappointed the committeetlookafterits day-to-day running.
13. Mr, Shresth confessed tohis wife that he hadilicit relationship with Mrs, Ruby and after listening this statement
{rom Mr, Shresth, Mrs. Ruhi Shresth filed a petition in the Family Court of SINGORE district for ‘divorce’ from her
husband underThe SONDHEIM MARRIAGE ACT, 1955.
14. The Additional District Judge, of SINGORE, SARNATAKA allowed the petition fled by Mrs. Ruhi Shresth under
Section 13(1) (ofthe SONDHEIM MARRIAGE ACT by following the judgment of Hon'ble Supreme Court inthecase
cof NAVTEJ SINGH JOHAR & ORS V. UNION OF INDIA THR. SECRETARY MINISTRY OF LAW AND JUSTICE AND
JOSEPH SHINEV.UNIONOFINDIA.
15. KADIA isa country where societal system is influenced more by customs and traditions which are religion based.
Inspite of this KADIA proclaims to protect the right of homosexuals by incorporating gender equality in Adultery.
However, in KADIA, Adultery and homosexual rights are not recognized by restrictive law.The constitution of KADIA
‘guarantees its citizens their privacy rightas their fundamentalright..
16. TRISCO has made a clause for exclusion and termination of those people who are in practice of adultery and
homosexuality. The object of the TRISCO trust isto practice SONDHEIM religion on the basis of custom and tradition,
‘and build the temple for public worship under the supervision of TRISCO trust whichis open toll sectionsand classes
of people of SONDHEIM religion, who are subject tospecial rules for religious denominations.
17. TRISCO is a popular trust in KOBEE STATE which does not approve legally the practices of adultery and
homosexuality in SONDHEIM Culture, TRISCO trust isa registered trust under KADIA Trusts Act as public trust and it
confers numerous reimbursements upon the trustee for financial assistance. With this recognition TRISCO act in
accordance with strategy of non discrimination, on grounds of religion, race, caste, sex/sexual orientation, place of
birth, age, disability, descent and residence, The TRISCO has an option for extending membership to persons
irrespective of theirstatus or belief.
18, TRISCO Js a renowned Trust of KOBE funded by the governmental organization and it has great followers
throughout the country. TRISCO is primarily a supporter of SONDHEISM promoting practice of radical Sondheism
and targets the Indian for its support. TRISCO enjoys a sect of Hindu member who have created Faith on TRISCO
CORPORATION SOCIETY (TCS) in several educational institutions. TRISCO members are of the opinion that
homosexuality and adultery are incurable practice of the Sondheism culture. It also believes that homosexuals and
persons who go for adultery have no right to practice radical Hinduism, TRISCO members are also against the view of
Supreme Court's judgment in NAVTEJ SINGH JOHAR & ORS V. UNION OF KADIA THR. SECRETARY, MINISTRY OF
LAW AND JUSTICE AND JOSEPH SHINE V, UNION OF KADIA which, according to them are against Sondhelsm and
Sondheim culture.
19, In Jan 2019, TRISCO CORPORATION SOCIETY clearly stated that homosexuals and persons who go for adultery
arenon-Hindus and are not eligible to seek membership. The people whoare practicing and are indulged in such type
of practice are not the part of SONDHEIM Culture becauseiithurts the integrity and feelings of the SONDHEIM culture
and they arenotallowed to follow the SONDHEIM culture and goto the SONDHEIM templein whole of KADIA.
20, TRISCO has cancelled the membership of Mr. Rocky, Ms. Ruby, Mr. Shresth and Mr. Gopi and rejected the
membership of TRISCO trust and put the lifetime ban on them to become member of SONDHEIM religion trust and
they are accordingly not allowed to enter in the religious place made by the trust because they were in practice of the
homosexuality and adultery which is against the TRISCO members who are strong believers of the SONDHEIM

21. By the refusal of membership by TRISCO and lifetime ban on Mr. Rocky, Mr. Shresth and Mr. Gopi, they have
decided to consult TAPI NGO. The legal advisor of TAPI NGO has suggested to file a writ petition in the Supreme
Court of KADIA contending that the refusal of membership and lifetime ban by TRISCO violates the fundamental
right to equality, right to life and personal liberty, and right to freedom of religion, TRISCO'S refusal groundshave also
been challenged that practicing homosexuality and adultery are against the religious beliefs of the SONDHEIM
religion,
22. The TRISCO consulted the advocate GAKI of the KOBE STATE. The advocate GAKI was of the opinion that
TRISCO has placed the conditions on the conferral of Hindu religious status in terms of the Prohibition of
Discrimination according to the trust. The termination of membership which was imposed by the trust was reasonable
and was not meant to harm any person or group. The mere fact that such ban is not operated to disadvantage the
SONDHEIM religious practice; it does not make it unconstitutional, as the TRISCO does not guarantee any
constitutional and Fundamental rightto selective preferences of behavior ike homosexuality and adultery,
23. MrRocky, Mr.Shresth and Mr. Gopi have decided to move to the Supreme Court of KADIA for their violation of
theirfundamentalrights.

bench. However the written submissions must addressall theissues.
Any citations, without actual para/page references, will invite negative marking. Unnecessary citations and
passim references are to be avoided. In case of oral arguments, a primary reference for all case-laws being
referred is mandatory.

RULES OF THE COMPETITION
‘These rules shall be the official rules for Moot Court Competition to be held 10th, 11th and 12th May 2019
at Indore Institute of Law. All the participating teams must strictly adhere to these rules in every
circumstance.
1. Competitioncommitteeand forum
+ MootCourt Society willbe the Competition committee for the purpose ofthis competition,
+ Incase of any dispute or difficulty arising out of or during the course of the competition, the Competition
Committee shall have thesole and absolute authority to remove such difficulty and resolve the dispute.
+ The Competition committee's decision as regards the interpretation of these rules or any other matters
related to the Moot Court competition shall be final and binding. If there is any situation, which is not
covered by these ules, the decision ofthe Competition committee shall be inal.
+ The Competition committee reserves the right to amend, modify or repeal any of the rules ifso required
and as they deem appropriate. Participating teams shall receive adequate notice of any/all such
amendments or modificationstothe rules.
+ TheCompetition committee shall not be held responsible for any loss ornon-delivery of the Memorials.

‘The following terms shall have the corresponding meanings unless otherwise specified:
+ Bench Memorandum means the memorandum of lawsand authorities conceming the problem.
+ Compendium’ means the complied research material.
Competition Rules’ means the official rules and regulations of the competition as amended from time to
time.
+ Competition’ means the Smt Nirmala Devi Bam MemorialNational Moot Competition 2018.
[S.T: means Indian Standard Time.
+ Memoria! means theWritten Submissions ofa team, submitted pursuant totheserules.
+ Moot Court Society’ (hereinafter MCS) for the purpose of this moot court competitionmeans the committee as
for the administration and conduct of the competition, Including any other authorised person and of all
eventsleadingtothe competition.
+ Oral Pleading’ means the pleading before @ panel as explained under “Evaluation Criteria for Written
Submission"
Panel means the adjudicators of an Oral Pleading Session collectively
Participant’ means any member ofthe participating team,
+ Penalty’ meanstheconsequence ofarule violation, whether disqualification or the deduction of points
Petitioner’ means the side of the team which argues on behalf of the applicant at any given point In the
competition,
+ Rebuttals’ refer to the set of arguments /challenges that the applicant shall raise at the end of the main
pleadings ofall the orators. This shallbe replied ton theappropriate mannerby the respondent.
Researcher means the member of the team who Is not speaker.
Respondent’ means the side of the team which argues on behalf of the Respondent at any given point in the
competition,
Speaker means the designated speaker ofthe team.
+ Team Code’ means the cade allocated to a team through a draw of lots.
1. Students enrolled in an undergraduate & postgraduate law course or its equivalent by any recognized
college/ univesity/institution areeligibletopartcipateinthe Competition,
2. Any college/universityinstitution, whose students full the eligibility ctiterla or for exceptional circumstances
hhave been deemed by the organizers to be eligible for this Competition, shall be entitled to send only one team
to the Competition, subject to the completion of registration formalities as detailed in the ‘Invite! to the
Competition.
3. Each team may comprise @ minimum of two (2) and not more than three (3) members. The team composition
shall be of two (2) speakers only (in case of ‘two speakers’ team, anyone of the speakers would be
designated as researcher’ for appearing in the Researchers Test. the team composition is of three (3) member than it shall
comprise oftwo 2) speakers and one Researchers (Who shal the designatedas aresearcher for appearing the Researcherstest)
4. Each team shall prepare one memorandum for each side, that is, the Petitioner(s/ Appellant(s) and the
Respondent(s). The soft copy of the memoranda must be emailed to iilmootcourtsocietyagmallcom, on of
before 20th Apri, 2019 (at or before23-59hoursiST).

3. Theteamsthat proceed to the Quarter Rounds, withthe highest round pointsin each courtroom, each team shall argue only

teamwith higher aggregate speaker scores willbe declared the winner for that round. fthe aggregate speaker scores ofthe
teams are the same, then the team with higher gross memorandum score ie, the score of the memorandum without

SCOUTING
No member of any team will be permitted to hear the arguments in any court room in which that team is not one
of the contesting teams whilst that team is still in the Competition. The organizers may take appropriate action,
including disqualification from the Competition, against any team found to be scouting through a team member
forthrough any other means.
EXCHANGE OF MEMORANDUMS
Thete shall be an exchange of memoranda between the respective opposing teams, in accordance with the
foxturesasdeterminedbya draw oflots prior toalltherounds ofthe Competition.
