Re: Marine Protest
Dear Sir:
I, _______________________, Captain of General Cargo Vessel MV win 12
(with Port of Registry in Cagayan, Philippines) , duly licensed by the
Maritime Industry Authority with License no. SRN 509876543 as Master
Mariner;
On June 14, 2018 our ship arrived at Cagayan Anchorage and I dropped
anchor at around 14:45 ballast condition while waiting for our schedule.
However, on June 16, 2018 at around 16:00, I noticed that there was a
build-up of bad weather and I noticed the presence of strong wind and
waves at the Anchorage. So I decided to pull up the anchor to facilitate
the movement of our ship as I noticed that there was another MV Lady
Amy which was moving neared towards our ship. I tried to call the
attention of the captain of the other ship through Channel 16, however I
was not able to get any response.
So at around 18:45, I decided to maneuver our Vessel to avoid any
collision with MV justice. However, due to the huge waves and wind, our
Vessel was drifting portside despite careful maneuver towards the
direction of another vessel identified as SF alpha bow-anchored and
eventually came in contact with the vessel’s forward part railings as I
continue moving my vessel towards the vacant part of Sta. Ana
Anchorage.
After I have dropped my anchor, I conducted an inspection of my vessel
MV win and noticed that the vessel’s lifeboat davit was damaged and the
hull’s portside was dented measuring to the following measurement:
Height: 1.60 m; Width is 0.70 meters, and Depth is 9.5 cm, Frame # 27
was affected- 3.80 meters from Deck level including DB/TS #3 Sounding
Pipe was likewise affected.
Thereafter, I informed the owner of MV win about the incident and the
extent of the damage of the vessel.
On the next day, I intend to file a marine protest however since the
attorney’s office was closed, I was constrained to re-schedule the
submission of the marine protest. That we have settled the incident with
the owner of MV Alpha and I had a talk with its Chief Officer Bernard
Bernardo that the incident cannot be avoided despite exercise of caution
since the bad weather condition is beyond any man’s control.
Likewise the damage incurred by MV Win does not affect its
seaworthiness since the same is merely superficial.
I attest to the truth of the foregoing statement and for whatever legal
purpose this may serve.
