Prof. Eugenio H. Villareal
Sections 3C and 3D
2nd Semester, SY 2019-2020
Course Objectives and Methodology
i
This Course introduces the law student to the means provided under the Rules
of Court (particularly, the Revised Rules on Evidence, as amended by Adminitinatine
Matter No, 19-08-15-SC, effective 01 May 2020)' to ascertain in a legal proceeding the
truth respecting a matter of fact. The law student is oriented about rules on relevance
and admissibility of evidence, the kinds of evidence, and the particular standards and
methods as regards their presentation and use as well as their exclusion, the weight
and sufficiency of evidence, as well as the burden of proof and presumption,
‘The course aims to create in the student a dig-deep understanding of the rules
of evidence (including their nature and rationale) and the fundamental ability to apply
these in the evaluation as well as resolution of legal problems and case
“Understanding ahd application” will hopefully make the law student more effective
in practice court and much later, as lawyers, in litigation work. The law student is also
trained to integrate the rules of evidence with other procedural rules as well as
statutory and constitutional provisions.
‘The course, which presents to the student not only the rules and jurisprudence
but also relevant law as well as recent developments in the law, makes use of the
Socratic Method in recitation (without prejudice to quizzes), In-depth analyses and
discussion of “legal-doctzinal” cases ate conducted. Supplementing all these are
lecturettes on special topics such as deposition and discovery as well as on any trends
in litigation, Final and mid-term written examinations are also required
