FORMAL OFFER OF EVIDENCE

ACCUSED, through the undersigned counsel, before this Honorable


Court, respectfully offer the following exhibits:

EXHIBIT “1” – school ID of the accused issued by Sangley Point National


High School at Sangley Naval Base, Cavite for school year 2003-2004;

Purpose: To show that at the time of the alleged incident where the accused
was falsely charged of the alleged crime, he was then a 4th year high school
student of Sangley Point National High School;
- As part of the testimony of accused.

EXHIBIT “2” – Medico Legal Certificate dated December 28, 2004 issued by
the Makati Medical Center
“2-A” is the signature of Dr. Oranez, the Surgeon on Duty who signed
the said certificate.

Purpose: To prove that accused was brought to Makati Medical Center for
medical treatment for various serious injuries on many parts of his head;
- As part of the testimony of the accused.

EXHIBIT “3” – Certified True Copy of the blotter issued by Barangay


Comembo thru its Barangay Secretary Ms. Bernadette Federes, on the report
by Mrs. Godila Gajutos , mother of the accused.

Purpose: to prove to all and sundry the particular facts of what actually
happened to the accused in the early morning of December 25, 2004 as
narrated by him to his mother while he was in the hospital who caused the
“blotter” to the barangay.
- As part of the testimonies of the accused and witness Godilla
Gajutos.

EXHIBIT “4” (the marked evidence is on the records of the case) – is the
COUNTER AFFIDAVIT of the accused dated January 05, 2005.

Purpose: To prove what actually happened to the accused during the early
morning of December 25, 2004 while he was on the way home after attending
a Christmas Party;
- As part the testimony of the accused.
