8 General Provisions

10 Section 1 This code shall be known as the Quezon City Science High School Supreme
11 Student Government Commission on Elections Standard Election Code
12 which shall hereinafter be referred to as SSG COMELEC.

14 Section 2 The SSG COMELEC shall govern all regular and special elections of the SSG.
15
16 Section 3 The SSG COMELEC shall make every effort to comply and to follow the
17 standards set for in this code. This shall include, but not limited to:
18 3.1 The review of the rules governing standard;
19 3.2 The adoption of rules to achieve and to maintain the maximum degree
20 of fairness, impartiality, and efficiency on the procedures of voting,
21 including write-in voting, counting, tabulating, and recording of votes
22 by voting system used in SSG elections.

24 Section 4 For the purposes of this code, the following words and phrases used shall have
25 the meaning as ascribed to them in this section:
26 4.1 “SSG COMELEC” refers to the Supreme Student Government
27 Commission on Elections.
28 4.2 “Homeroom Officers” shall refer to the set of officers elected in every
29 section of every year level, namely, President, Vice President, Secretary,
30 Treasurer, Auditor, and Peace Officer.
31 4.3 “CYL Officers” shall refer to the set of officers elected in every year
32 level, namely, the Grade Level Chairperson/Representative, Vice-
33 Chairperson, Secretary, Treasurer, Auditor, and Peace Officer.
34 4.4 “SSG ExeCom” shall refer to the Supreme Student Government
35 Executive Committee, composed of the President, Vice President,
36 Secretary, Treasurer, and Auditor, duly elected by the Student Body.
37 4.5 “Candidate” refers to a student whose application for candidacy to an
38 elective position was eligible and qualified to have his or her name
39 placed on a ballot and duly approved by the SSG COMELEC.
40 4.6 “Election Calendar” refers to the period of time from the
41 dissemination of information to the induction of newly elected
42 officers.
43 4.7 “Campaigning” means any intentional action in support of, or in
44 opposition to, a candidate or political party for an elective position,
45 including but not limited to, the distribution of literature and posting
46 of election-specific materials.
47 4.8 “Campaign Material” means any print or electronic material used for
48 the purpose of supporting a candidate or political party. Campaign
49 material shall include, but not limited to, filers, posters, social media
50 posts, and clothing.
51 4.9 “Disqualify” means the SSG COMELEC removes a candidate or
52 political party from the ballot.
53 4.10 “SSG Election” refers to the annual simultaneous election of SSG
54 Officers.
55 4.11 “CYL Election” refers to the annual CYL officers’ elections.
56 4.12 “Homeroom Election” refers to the annual election of Homeroom
57 officers.
58 4.13 “Ballot” means the printed sheet of paper or secure online database
59 containing the names of candidates.
60 4.14 “Polling Precinct” refers to the station where students write and cast
61 their votes.
62 4.15 “Officer-elect” refers to a candidate who was proclaimed as a winner
63 in an election but has not yet taken his/her oath of office.
64 4.16 “School” refers to Quezon City Science High School, Regional Science
65 High School for NCR.

70 Section 1 The name of this Supreme Student Government Commission on Elections shall be
71 known as the Quezon City Science High School Supreme Student Government
72 Commission on Elections which shall hereinafter be referred to as SSG COMELEC.

74 Section 2 The seat of the SSG COMELEC shall be located inside the premises of the school,
75 situated at Golden Acres Rd. cor. Misamis Street, Bago Bantay, Quezon City 1105.

82 Section 1 The SSG COMELEC shall uphold the values, principles, and ideals of the SSG By-

86 into action by ensuring a free, orderly, and honest election for the student body.

90 Section 3 The SSG COMELEC shall be an independent agency of overseeing the conduct,
91 complaints, and recommending validation or invalidation of the SSG Elections.

93 Section 4 The SSG COMELEC shall exercise jurisdiction over all matters pertaining to elections,
94 plebiscite, and referenda within the SSG COMELEC Standard Election Code.

99 Section 5 The SSG COMELEC shall be the highest governing body of the student elections.

101 Section 6 The SSG COMELEC shall pursue at all times, the values of impartiality, honesty, and
102 integrity in service, renouncing all forms of corruption and acts which are contrary to
103 the rules and regulations of the school and the Department of Education.

105 Section 7 The SSG COMELEC shall strive to pursue an independent stand, impartial and not
106 dictated by any other sector, other than the students, as long as these are not contrary
107 to the SSG By-laws and Constitution, the Mission-Vision Statement, and Core Values
108 of the Department of Education.

110 Article IV
111 Duties and Functions of the SSG COMELEC

113 Section 1 In accordance with the SSG By-Laws and Constitution, the SSG COMELEC shall
114 have the following duties and responsibilities:
115 1.1. Conduct fair, honest, and systematic elections;
116 1.2. Adhere to the Standard SSG Election Code;
117 1.3. Validate the electoral proceedings and results;
118 1.4. Accept or revoke candidacy;
119 1.5. Proclaim the new set of officers;
120 1.6. Keep all pertinent election papers/documents;
121 1.7. Decide on protests relative to the conduct and results of elections;
122 1.8. Prepare and distribute the necessary election paraphernalia, certificate of
123 candidacy forms, and other election related materials before, during, and after
124 the election; and,
125 1.9. Disqualify candidates who have violated any of the guidelines, which have
126 been promulgated.

128 Section 2 The Commission on Elections may create additional rules and guidelines, by a majority
129 vote at the SSG COMELEC Meeting, to ensure a fair and efficient election, provided
130 that any and all rules must complete the rule making process by no later than one week
131 prior to the start of the election cycle. Any rule created by the SSG COMELEC must
132 comply and be consistent with the SSG By-Laws and Constitution.

134 Section 3 At least ten (10) days prior to enacting any rule, the SSG COMELEC shall post a
135 Notice of Proposed Rulemaking in the SSG Office. The SSG COMELEC shall ensure
136 that any Notice of Proposed Rulemaking contains the following:
137 3.1. General subject matter of the proposed rulemaking;
138 3.2. The place of the meeting to collect information about the proposed area of
139 rulemaking;
140 3.3. The time of the meeting and that any student is welcome to comment on the
141 general subject matter.

143 Section 4 The SSG COMELEC Chair shall ensure that any student who wishes to offer to the
144 SSG COMELEC shall be given the opportunity to do so.
145 Section 5 If the SSG COMELEC enact any rule, the enacted rule must conform exactly to the
146 proposed rule.

148 Section 6 If a rule takes effect during an election, the SSG COMELEC Chair shall provide notice
149 to all parties and to all independent candidates of the newly promulgated rule.

151 Section 7 The SSG COMELEC shall have the power to penalize violations or any other rules
152 properly promulgated by the SSG COMELEC.

155 Composition, Qualification, Term of Office, and Vacancies of the SSG COMELEC

157 Section 1 The composition of the members in the SSG COMELEC shall be three (3) students
158 from each Grade level.

160 Section 2 All members applying for SSG COMELEC shall be approved by a majority vote by
161 the SSG General Assembly.

163 Section 3 The officers of the SSG COMELEC are the duly elected SSG COMELEC Chair, Co-
164 Chair, and Board Members.

166 Section 4 Members for the SSG COMELEC shall:
167 4.1. Be bona fide students;
168 4.2. Be of good academic standing with a general average of 85 and above without
169 any failing grade during the 1st to 3rd grading period of the current school year;
170 4.3. Be of good moral character;
171 4.4. Have not been subjected to any disciplinary sanction;
172 4.5. Have not been involved in any position or affiliation with an SSG Political
173 party or as an independent candidate during the previous election cycle;
174 4.6. All other qualifications as specified in the SSG By-laws and Constitution by
175 are not specified herein are included in the qualification of the SSG
176 COMELEC Members.

178 Section 5 All SSG COMELEC Officers shall be considered ineligible to run for the SSG
179 Elections.

181 Section 6 No residency shall be required for all the members of the SSG COMELEC.

183 Section 7 The officers of the SSG COMELEC shall hold office for one (1) school year.

185 Section 8 Vacancies on the Commission on Elections, occurring prior to the end of qualifying,
186 shall be immediately filled for the duration of that specific term by appointment
187 through a majority vote from the SSG General Assembly. Vacancies occurring after
188 qualifying and before the election shall remain unfilled until after the end of the
189 election.

193 Article VI
194 Duties and Functions of the SSG COMELEC

196 SSG COMELEC Chair

198 Section 1 The SSG COMELEC Chair shall be filled by the nomination of the SSG COMELEC
199 Board Members, subject to the approval of two-thirds of the vote of the
200 aforementioned body.

202 Section 2 The SSG COMELEC Chair shall conduct and supervise the elections of the SSG.

204 Section 3 The SSG COMELEC Chair shall faithfully execute the duties and responsibilities as
205 designated in the SSG COMELEC Standard Election Code and other duties that are
206 deemed necessary for the proper conduct of an election.

208 Section 4 In the event of a vacancy in the office of the SSG COMELEC Chair, a new Chair shall
209 be chosen pursuant to Section 1.

211 Section 5 The SSG COMELEC Chair shall conduct a meeting immediately preceding the first
212 day of elections. The purpose of this meeting shall be to inform all students wishing
213 to participate in the upcoming elections of the rules, procedures and proper conduct
214 required during the election cycle as stated in the SSG COMELEC Standard Election
215 Code.

217 Section 6 The SSG COMELEC Chair shall be responsible for receiving the qualifying papers
218 and documents of the candidates.

220 Section 7 The SSG COMELEC Chair shall approve the campaign materials of the candidates,
221 whether printed or digital material.

223 Section 8 The SSG COMELEC Chair may grant a preliminary order that a political party or
224 candidate cease and desist from the distribution of campaign material where the SSG
225 COMELEC deems that a preponderance of available evidence leads to a conclusion
226 that:
227 8.1. There is a strong likelihood of a violation on a complaint brought by the
228 offended party; and
229 8.2. Where the material is so offensive that it may irreparably harm the offended
230 party or candidate.

232 Section 9 The SSG COMELEC Chair shall distribute all information concerning the SSG
233 COMELEC standard election code which includes, but not limited to, the required
234 documents, deadlines, campaign rules and campaign laws.

236 Section 10 The SSG COMELEC Chair shall be responsible for the preparation and reproduction
237 of the ballot, with the help of the designated school officials.

239 Section 11 The SSG COMELEC Chair shall ensure that all candidates for a given office are listed
240 in alphabetical order within party groups on the ballot. For the purpose of listing
241 candidates, all independent candidates shall be grouped together in alphabetical order
242 as if they were a party.

244 Section 12 In the event that a polling location becomes unavailable due to an event or
245 circumstance outside the control of the elections staff, the SSG COMELEC Chair, at
246 his or her discretion, may add or change a polling location to the nearest available
247 building so long as it is properly noticed at the original polling location.

249 Section 13 The SSG COMELEC Chair shall provide the poll workers with written instructions
250 on how to assist students with disabilities. The instructions shall be read as follows:
251 “Students with sight, vision or physical impairments may request a companion or poll
252 worker to read and mark their ballot. You are to help any student that requests this
253 service.”

255 Section 14 The SSG COMELEC Chair shall announce the election results no earlier than one (1)
256 hour after the closing of polls.

258 Section 15 The SSG COMELEC Chair shall ensure all ballots are stored until all complaints are
259 resolved.

261 SSG COMELEC Co-Chair and Board Members

263 Section 16 The SSG COMELEC Chair shall appoint a Co-Chairperson and Board Members prior
264 to the general election. The Co-chairperson and the Board Members’ term shall end
265 in conjunction with the expiration of the natural term of the SSG COMELEC Chair.

267 Section 17 The SSG COMELEC Co-Chairperson and Board Members shall assist the SSG
268 COMELEC Chair in the performance of his or her duties during the elections.

270 Article VII
271 SSG COMELEC Adviser

273 Section 1 The SSG COMELEC Chair shall endorse an adviser to the school head/principal
274 prior to the general election. Adviser’s term shall end in conjunction with the
275 expiration of the natural term of the SSG COMELEC Officers.

277 Section 2 The SSG COMELEC Adviser shall have the following qualifications:
278 2.1. Have an experience in organizational management;
279 2.2. With good character and reputation in the school and community;
280 2.3. Must be a teaching faculty of any department in the school;
281 2.4. Must be non-partisan, and shall not hold nor have held any position as an
282 adviser of the SSG;
283 2.5. All other qualifications as specified in the SSG By-laws and Constitution but
284 are not specified herein are included in the qualification of the SSG
285 COMELEC adviser.

287 Section 3 The SSG COMELEC Adviser shall monitor all activities and meetings of the SSG
288 COMELEC at all times.
289 Article VIII
290 Penalties and Complaints

292 Section 1 The SSG COMELEC shall issue penalties in accordance with the SSG COMELEC
293 Standard Election Code.

295 Section 2 Any Candidate or political party who does not comply with the SSG COMELEC
296 Standard Election Code or the proposed Rules and Regulations of the SSG
297 COMELEC shall be subject to any or all of the following penalties:
298 2.1. Warning;
299 2.2. Reprimand;
300 2.3. Suspension of a political party from fielding a candidate or candidates for
301 offices in an election;
302 2.4. Disqualification from the current election cycle;
303 2.5. Any penalty deemed appropriate by the SSG COMELEC.

305 Section 3 Any student or student organization who intends to bring a complaint before the SSG
306 COMELEC alleging a violation of the SSG Standard Election Code must identify all
307 of the following:
308 3.1. The defendant individual, organization, or political party;
309 3.2. The specific section of the By-Laws and Constitution of the SSG COMELEC
310 Standard Election Code that the plaintiff alleges the defendant violated;
311 3.3. A detailed statements of the facts surrounding the alleged violation, and any
312 material evidence related to the complaint;
313 3.4. The date and time that the complaint was filed.

315 Section 4 Any election complaint must be filed to the SSG COMELEC before the election
316 results are read. Filing a complaint to the SSG COMELEC means that the aggrieved
317 party delivers their complaint to the SSG COMELEC Chair.

319 Section 5 The SSG COMELEC shall dismiss without prejudice any complaint failing to comply
320 with Section 3.

322 Section 6 Upon receipt of the complaint that meets all of the requirements of Section 3, the SSG
323 COMELEC shall determine whether probable cause exists to believe that a violation
324 has occurred.

326 Section 7 If warranted, the SSG COMELEC may assess a reasonable penalty under Section 2.

328 Section 8 The SSG COMELEC shall keep a written record of all its meetings, including evidence
329 and testimony heard, the findings of the SSG COMELEC and the rulings made within
330 forty-eight (48) hours of a meeting.

335 Article IX
336 Election Qualification

338 Section 1 Any group or individual who wishes to qualify as candidate(s) for the SSG must
339 comply with the provisions of the SSG COMELEC Standard Election Code and must
340 adhere to the policies set forth by the Chair of the SSG COMELEC and its board
341 members.

343 Section 2 The qualifications for the position in the SSG shall be in accordance with the Standard
344 Constitution and by-laws of the Supreme Student Governments in Secondary Schools.

346 Section 3 Election Application Packets shall be distributed to the interested candidates by the
347 SSG COMELEC. The candidates must provide the following to qualify for the
348 elections:
349 3.1. Certificate of Candidacy;
350 3.2. Five (5) Copies of 2x2 photograph;
351 3.3. Report Card;
352 3.4. General Plan of Action;
353 3.5. Essay (based on the given set of questions in the Election Application Packet);
354 3.6. Reference form (in a signed and sealed envelope) from a current teacher and
355 an adult outside of the school community that is not a relative;
356 3.7. Parental Consent.

358 Section 4 No candidate’s name shall appear on the ballot when that candidate fails to qualify as
359 a candidate with SSG COMELEC prior to the time of the closing of the qualifying
360 period.

362 Section 5 No candidate shall qualify for more than one office. If a person qualifies for an
363 additional office or change of party, the previous qualifying shall be deemed void.

365 Section 6 Falsification of information may result in disqualification. Each candidate shall
366 determine that all information regarding his or her qualifications are correct prior to
367 his or her qualifying for election.

369 Section 7 Political Parties are not liable or punishable for an individual candidate’s intentional or
370 grossly negligent falsification of information during the qualifying stages of the
371 election if they did not encourage the individual’s behavior. The SSG COMELEC shall
372 allot the political party twenty-four (24) hours to replace a candidate who intentionally
373 or with gross negligence falsified information during the qualifying stages. The political
374 party must choose a replacement for the disqualified candidate from those candidates
375 who have already qualified.

377 Section 8 If a candidate or candidates who has/have qualified for office and has/have been
378 placed on the ballot by the SSG COMELEC wishes to withdraw from the election,
379 the candidate/s may withdraw if the candidate/s informs the SSG COMELEC in
380 writing that the candidate/s no longer wishes to remain on the ballot no later than the
381 day immediately preceding the first day of the election. If a political party slated a
382 candidate, that political party may replace that withdrawn candidate with a candidate
383 who has already been qualified as an independent, prior to the finalization of the ballot.

385 Section 9 If campaign material in violation of the SSG COMELEC is observed for fifteen (15)
386 minutes or greater, the SSG COMELEC Chair or Co-chair shall attempt to contact
387 the offending candidate, the president of the offending political party or his/her
388 running mates. If the SSG COMELEC is unable to make contact to the offending
389 political party, the SSG COMELEC Chair or his/her board members shall remove the
390 offending material; in case of a digital format, the SSG COMELEC may impose the
391 appropriate sanction.

393 Section 10 No candidate, group of candidates, political party personnel, staff member, faculty
394 member, administrator, or any other student or visitor may use the school’s copy
395 machines, computer or other materials in the SSG Office at any time for any type of
396 partisan political purpose or use in any type of election campaign.

399 Article X
400 Election Campaign

402 Section 1 Campaign period shall cover five (5) school days beginning on the Announcement of
403 the official list of candidates and ends immediately before Election Day. If this proved
404 impossible, the campaign period may be extended to not more than eight (8) school
405 days.

407 Section 2 Campaigns shall only be allowed during the prescribed period of the SSG COMELEC
408 and done in such a manner that on-going classes, conferences and other school
409 functions will not be drastically affected, disturbed, hampered or disrupted.

411 Section 3 The maintenance of a campaign website or social media page shall be permitted five
412 (5) days prior to the election.

414 Section 4 No candidate shall give, offer, or promise to any student or student organization any
415 benefit not authorized by the Standard by-laws and Constitution of the SSG in order
416 to influence the votes of that student or members of that organization.

418 Section 5 Candidates shall ensure that all campaign material shall be labeled with the phrase
419 “Registered Political Advertisement” or a phrase of similar import approved by the
420 SSG COMELEC. The phrase shall be followed by the name of the individual who
421 authorized the creation of, disbursement of, or payment for, a piece of campaign
422 material.

424 Section 6 All campaign materials must be registered to the Chair of the SSG COMELEC.

426 Section 7 Procedures for distribution and posting of campaign material not provided for by the
427 SSG COMELEC Standard Election Code may be established by the SSG COMELEC
428 for purposes not contrary with the SSG COMELEC Standard Election Code.

430 Section 8 Any impersonation of another political party/independent candidate by a candidate,
431 representative, or campaign material of another political party/independent candidate
432 shall be considered an election violation.

434 Section 9 Campaign materials may only be posted in campus properly, in compliance with the
435 laws and regulations of the school.

437 Section 10 No unauthorized person may post or remove any campaign material of any candidate
438 or political party.

440 Section 11 No candidate or political party shall destroy, remove, or steal any campaign material
441 of another candidate or political party.

443 Section 12 Candidates or representatives of a political party shall attach campaign materials only
444 to areas designated by the SSG COMELEC.

446 Section 13 Candidates or representatives of a political party may engage in classroom door-to-
447 door campaigning only upon the approval of the classroom adviser or concerned
448 teacher and limited to a maximum of ten (10) minutes.

450 Section 14 Candidates may not campaign or distribute campaign materials in any library or
451 designated study area.

453 Section 15 No campaigning shall take place within fifty (50) feet of the door of any polling
454 location or within fifty (50) feet of any queue of voters during the Election Day itself.
455 Thus, candidates and political party members should remove or dispose of their
456 campaign materials on the day before the election period. Otherwise, campaign
457 materials posted, displayed, and distributed during the election itself shall be held
458 against the candidate or political party responsible. Social media campaign and
459 advertisements through text or e-mail messages to voters should likewise cease on the
460 day before the elections.

462 Section 16 Campaign materials may include a banner not to exceed 4x4 meters, and a poster not
463 exceeding 8.5x11 inches.

465 Section 17 Threats to bodily harm, intimidation, coercion, and acts of the like are strictly
466 prohibited.

468 Article XI
469 General Elections

471 Section 1 All polling places shall be opened from 8:00AM to 5:00pm with no lunch break. All
472 those within the premises of the polling places will be allowed to vote.

474 Section 2 Political parties and independent candidates are entitled to one (1) poll watcher in the
475 polling place. The poll watcher shall present to the SSG COMELEC a written
476 appointment as watcher from the candidates or party whose interests he/she
477 represents.

479 Section 3 No qualified elector may vote or be admitted to a voting booth unless the elector
480 presents to a poll worker from the SSG COMELEC, his or her identification card.

482 Section 4 Each qualified elector shall be responsible for ensuring that his/her registration and
483 address are current and correct on school’s records.

485 Section 5 The Chair of the SSG COMELEC shall ensure that all polling locations have the
486 following:
487 5.1. A building, room, or area that can accommodate voters especially those with
488 disabilities;
489 5.2. Have a readily accessible tables, chairs, certified list of voters, ballot boxes,
490 official ballots and other necessary materials;
491 5.3. The list of candidates shall be written in bold letters on a manila paper and be
492 displayed in the voting area highly visible to the students writing their votes.

494 Section 6 Any elector who casts or attempts to cast more than one ballot, or tampers with an
495 election system, in any election shall be guilty of a violation and shall be investigated
496 by the SSG COMELEC.

498 Section 7 Ballots shall be uniform in size and color. The ballot shall contain:
499 7.1. A space for the voter’s thumb mark and signature;
500 7.2. Voting instructions;
501 7.3 Names of the candidates.

503 Section 8 The SSG COMELEC shall prepare the official ballots for all students. No ballot other
504 than the official ballots shall be used or counted except in the event of failure to receive
505 the official ballots on time, or when they were destroyed accidentally, and it is
506 impossible to provide new official ballots.

508 Section 9 The SSG COMELEC alone shall keep the key/s to the padlock/s of the ballot boxes
509 in the polling precinct; it shall remain padlocked until the casting of votes is finished
510 and the counting of votes begins.

512 Section 10 No member from the SSG COMELEC shall make any statement regarding the state
513 of the polls or the candidate/s voted for by a particular student.

515 Article XII
516 Election Tabulation and Validation

518 Section 1 As soon as the casting of votes is finished, the poll clerks shall count the votes in the
519 place designated by the SSG COMELEC. The counting of votes shall not be delayed
520 or be postponed unless directed by the SSG COMELEC on account of a pending
521 case, or complaint of protest to the election campaign or the casting of votes.

523 Section 2 Candidates are prohibited from entering the place where the counting of votes is held
524 and its surrounding area for the whole duration of the aforementioned activity.

526 Section 3 If two or more competing candidates tied, the position/s being contested shall
527 undergo a special elections organized by the SSG COMELEC. In case only one
528 candidate runs for a particular office, he/she needs 50%+1 of the total votes cast to
529 assume his/her post.

531 Section 4 The SSG COMELEC shall have sole responsibility for validation of elections by a
532 majority vote provided any decision to invalidate is based upon fraud or gross
533 unfairness as supported by the findings of fact from the SSG COMELEC.

535 Section 5 Every ballot is presumed to be valid unless there is a clear and convincing reason to
536 justify its rejection.

538 Section 6 The SSG COMELEC shall proclaim the winner/s accumulating the highest number
539 of votes.

547 election campaign malpractices. However, a decision to disqualify an officer-elect must

553 Section 1 This Code may be amended or modified in full or in part once every three (3) years
554 from its official issuance through a DepEd Order or Memorandum.

558 Section 2 If any provision or part thereof is held invalid and unconstitutional, the remainder of
559 this Code not affected by such move shall remain valid.

563 Section 3 All other laws, decrees, orders, issuances, rules and regulations which are inconsistent
564 with the provisions of this Code are hereby repealed, amended or modified
565 accordingly.
