Sub: Strong Objection of my client Murlidhar R. Yadav for


redevelopment under S.R.A. Scheme of Plot of Land bearing CTS
No.280/1 to 14, Village Kurar, Taluka Borivali, Mumbai Suburban
District, Sub-District, Mumbai

Dear Sirs,

I am concerned for my client Shri Murlidhar Raghunandan


Yadav, residing at Room No.3, Gajanand Vartak Chawl, Datt Mandir
Road, Malad (East), Mumbai 400 097, I have to lodge this complaint and
write to you as under:

1. My client says that he is the lawful owner of the


chawl/structure known as Murlidhar Chawl situated at Bandongri,
Kurar Village, Malad (East), Mumbai 400 064 situate, lying and being at
CTS No.280/1 to 14 of Village Kurar, Taluka Borivali, Mumbai Suburban
District, Sub-District, Mumbai. My client says that his name as structure
owner is more particularly reflected in the Property Register Card. My
client says that the said property was declared slum by your good self
office No.4 i.e. by the Dy. Collector (ENC) and the Competent Authority,
Borivali and the slum declaration of the said property has been set aside
by the Hon’ble Slum Tribunal vide judgment and order dated 22.7.1992
upon an Appeal No. 150 of 1991 copy thereof is annexed hereto and
marked Exhibit-A;

2. My client says that your good self office is very much aware that the
slum declaration is set aside and the slum declaration is not in force by
virtue of the judgment and order passed in the aforesaid appeal.
However, recently one false committee known as Sankalp C0-operative
Housing Society (Proposed) has been formed and the said alleged society
are misguiding your good self office, and thereby they are in the process
of redevelopment of the said property knowing fully well that the said
property is not under slum. My client further says that moreover, the
said alleged society in collusion with Rizvi Builders are making false
representations to my client’s tenants and thereby instigating them to
enter into an agreement for redevelopment without disclosing the fact
that the said property is no more under slum.

3. My client says that your good self office is very much aware and
moreover, it is not necessary to interpret the law that no property can be
redeveloped under SRA until and unless the property is declared slum
and in the present complaint, it is a matter of record as my client has
annexed the copy of the judgment and order of the Honourable
Maharashtra Slum Tribunal that the said chawl of my client is already
set aside from slum declaration and hence, the question of
redevelopment of the said property under S.R.A. Scheme does not arise at
all and moreover, it cannot be ruled out that your good self office is not
aware of the judgment and order in the said Appeal No.150 of 1991
whereby the declaration of the slum was set aside by the Honourable
Maharashtra Slum Tribunal.

4. In the aforesaid circumstances, my client hereby requests your
good self office not to entertain any application or proceeding with respect
to redevelopment of my client’s aforesaid property viz. chawl/structure
known as Murlidhar Chawl situated at Bandongri, Kurar Village, Malad
(East), Mumbai 400 064 situate, lying and being at CTS No.280/1 to 14
of Village Kurar, Taluka Borivali, Mumbai Suburban District, Sub-
District, Mumbai for redevelopment under slum rehabilitation scheme to
be processed through your good self office upon the application of M/s.
Rizvi Builders. My client hereby expects that necessary
intimation/correspondence with regard to the complaint lodged hereby,
would be intimated to the said alleged Sankalp C0-operative Housing
Society (Proposed) and M/s. Rizvi Builders.
