Affidavit Dumdum

This affidavit describes a police response to a disturbance call involving a drunk and unruly man armed with a broken glass shard. AFFIDAVIT OF WITNESS

I, PSSG JIMMY LIBRE DUMDUM, of legal age, married, resident of Sitio


Mabuni, Brgy. Guadalupe, San Carlos City, Negros Occidental, after having sworn in
accordance with law, do hereby depose and state THAT:

1. I am a Bonafide member of the Philippine National Police and presently


assigned at San Carlos City Police Station, San Carlos City, Negros Occidental;

2. That, on December 20, 2019, I was one of the duty police officers;
3. That, I was the one who drove the police car that responded to an
emergency call from concerned citizen at Ylagan corner Endrina St, San
Carlos City, Negros Occidental;

4. That, at on or about 11PM that day, we arrived at the scene of the


emergency and because of the well lighted street and fine weather, we
immediately noticed and saw a man who was holding a shard of broken
glass, about 6 inches long and wears nothing except his underwear;

5. That, the man who was holding the sharp object looks unruly and drunk. He
is of medium built and more or less 5 feet and 5 inches tall and according to
bystanders, he already has been drinking since the very morning of that day;

6. That, the place were the incident happened is a crowded area with houses
packed and crammed in the small areas of the said street and that the police
officers who responded can be subject to any unruly crowd;

7. That, because of the said situation, I advised my fellow officers, Rosagazo


and Martinez “ayaw mu og kumpyansa” don’t let your guards down;

8. That, police officers Rosagazo and Martinez were at least five (5) meters from
each other to fully cover each other in times of grave emergencies;

9. That, I saw officer Rosagazo tried to talked with the drunk and unruly person
(later confirmed to be Jayson Mata y Sayson), informing him that we are
police officers and that he should be calm. However, the drunk and unruly
person charged towards officer Rosagazo with the broken glass aiming to
hurt the latter officer which led the officer to backtrack his steps and
ultimately stumble on the ground. Because of the attacked and charge of the
person, the element of distance was no longer present because the person is
on the top of the fallen officer;

10. That, gunshot were then fired by the fallen officer to help defend his life
which at the moment is in grave danger and also led his fellow officer
Martinez to immediately assist the fallen officer who was on his back at the
ground with the drunk and unruly Jayson Mata on top of him and eager to
strike his deadly blow;

11. I executed this affidavit to attest the truthfulness of the foregoing facts and
to deny the allegations of the ADMINISTRATIVE CHARGE of GRAVE
MISCONDUCT against PSSG ROSENDO M. ROSAGAZO, JR; and PAT. NICOLAS
MARTINEZ and SERIOUS NEGLECT OF DUTY against PLTCOL FREDERICK P
MEAD.

AFFIANTS SAYETH NAUGHT.
