(A.B.V.M.INDIA)
This deed of declaration of Akhil Bhartiya Vishwakarma Mahasabha India (a.b.v.m. India) is made of this
(15.11.2018) Fifteenth day of November two thousand eighteen A.D. by Mr. Satish Kumar Sharma S/o
Late J.P. Sharma Vill. Judakhurd, Post-Jamilpur, Tehsil-Sagari, Distt. Azamgarh, U.P. India, Pin-276139,
(hereinafter called and referred to as the "Settler Trustee" being the founder of the (a.b.v.m. India), which
expression shall unless excluded by or, recognition to the subject or in context to deem to include this
slues as assigns nominees or representative whereas the "Settler trustee" is keen and eager to slues
mankind in general and the people to India in particular by creating a trust out of the money which he has
sized and possessed of and which is set apart for the purpose as detailed in the object clause.
Whereas the trustees have contributed a sum of Rs.10,000 (Rs. Ten Thousand) as donation for the trust
and together it all the contribution, conversion the root and investment in which the same may from time
name be investment in which the same may from time name be invested and all other movable and
immovable properties and as set that may from time to time be vested in the trustees or be received by
them or may come into their hands by virtues of "THESE PRESENTS" or by operation all lace of
otherwise incarnation of the trust hereby created.
NOW THIS DEED OF DECLARATION OF TRUST WITNESSES AS UNDER:
1. NAME OF THE TRUST:
The name of the trust would be AKHIL BHARTIYA VISHWAKARMA MAHASABHA INDIA abbreviated
as (A.B.V.M. INDIA)
2. AREA OF OPERATION:
The area of operation of the trust would be all over India and its union territories and shall not be
extended anywhere outside India.
3. REGISTERED OFFICE:
The registered office of the trust will be House No. 551Ka/350, Madhuban Nagar, Alambagh, Lucknow,

4. AIMS AND OBJECTS:- The trust cherishes for the achievement at the following objectives.
AIMS & OBJECTS OF THE TRUST:
(1) From the Vishwakarma Community has five Cadres i.e. Manu, May, Twashtha, Shilpi, Davagya
and other sub-categories. All these cadres comes under the Vishwakarma Community.
(2) Vishwakarma Community shall unite all the above cadres/sub- categories to aware the spirit of
unity, service, mutual cooperation and also of heartedly spirit with each other.
(3) To provide the honour to persons/people of Vishwakarma Community and also for the
development uneducated and weaker sections by economically and poorest persons and making
them prosperous.
(4) For their development Vishwakarma Community shall make attempts for the same in every
manner from time to time.
(5) The Trust shall establish its own Vishwakarma Bhawan/ Vishwakarma Sadan in the National
Capital New Delhi as well as in all states capital of the country for the development of this
community.
(6) The trust will establish its own hospitals, and arrange camps, mobile vans and ambulances for
the benefit of the poorest people of the community.
(7) The trust will provide to the poorest people of this community dowerless marriages and motivate
them for the same and such marriage programmes shall be organized by the Trust.
(8) The trust will provide the educational social, mental, moral, adhyatmik etc. knowledge for their
development.
(9) The trust will organize cultural programmes, by arranging meetings, seminars, games,
competitions from time to time.
(10) Trust shall also aware this community in respect of harassment of women, crimes upon children,
Bal Apradh, Vaishyavriti, dowry, drinking of Liquor, smoking etc.
(11) Trust shall provided industry of Resham (Silk), Stitching, plantation of Shahtoot Trees, production
of honey to the community in their local areas under various schemes.
(12) Trust shall provide for the welfare of the community in different sectors likewise Aids, Cancer,
T.B., Pulse Polio under Family Welfare Scheme by the Ministry of Health, Govt. of India and also
aware them about population control.
(13) To provide free medical services to people of backward rural area.
(14) To provide help to the Farmers, Painters, Labours, Shilpkars and Writers.
(15) To establish training centers for small udyog, Shilpkala, Handicraft, Computer, Typing,
Stenography, Beauti Parlour, Mobil Repairing, Modeling, Painting etc.
(16) To provide alternate medical services likewise Biochemica, Acupressure, Yog, Natural Chikitsa,
Ayurvedic, Homeopathic, Unani and also establish training centers, seminar, Camps, Swasthya
Mela, Research Centers etc.
(17) To establish small scale industries through U.P. Khadi Gramodyog Board/Commission.
(18) To establish projects for Cold Storage, Pulse & Rice Mills, Aata Mills etc. with the help of
National Garden Directorate.
(19) To make arrangement for Orphanages for unsupport Childs, olds men and women and also
arrange marriage programmes for unsupported youngs.
(20) To provide clean and good Environmental situations by plantation of trees and also pollution
control.
(21) For development of rural and illiterate people they shall be trained to latest technology for
farmers.
(22) For the awareness of rural women they should be trained under the government different
schemes.
(24) To organize National Women Kosh, National Bal Kosh etc. under the different schemes.
(25) To make organize of Nehru Yuva Kendra, Unicef, Cancer, I.C.D.S. etc.
(26) To establish Family Welfare Centres for the blinds, handicapped, Widows women through
Praudh Shiksha Kendra, Shishu Palan Kendra, Pariwar Kalyan Kendra etc. free of cost.
(27) Through Saksharta Niketan Programmes to literate the illiterate people of the society.
(28) To develop employment for the unemployed people of rural areas.
(29) To work on different schemes issued by Manav Sansadhan Mantralaya, Unicem, W.H.O. , Sidbi,
Nabard, Duda, Suda, DRDA, IRDP, SJRY, SJSy, JRY, UGC, NCERT, World Bank etc. To train
the people for Watershed Management under the different schemes of the Govt. of India.
(30) Operated by the Ministry of Home Department, F.C.R.A. operating all its schemes and also to
develop people of the country and society and also Ex-Army deceased (Shaheed) and
dependants of them for the welfare of their family members to do the work and self help Groups
organized and operation of them.
(31) In the development of Institution Form of 12A & 80G after detaining the reconization thereafter
operation of their programmes and accordingly for development of Institution/Society B.Ed., B.P.
Ed., B.T.C. etc. to establishment of such as Training Centres and its operation.
(32) For the development of the Trust, a12A, 80G, 23AC, 35AC 1 & 2, F.C.R.A. etc. after registration,
to get the funds from them.
(33) For the development of the Society/Institution establishment and operation of Engineering
Colleges, Medical Colleges, Para Medical Colleges, Nursing College, Universities of private
sector and also of private sectors, Industrial Training Centres to establish them and its operation.
(34) Under the jurisdiction to establishment and operation of C.S.E. schools, I.C.S.C. schools, Indira
Gandhi Open School, Pharmacy Colleges, Midical Colleges, Engineering Colleges etc. and also
to theProgrammes of 35A.C. Programme tried to be established and operated.
(35) To establish Para Medical Colleges, Nursing Homes, Pharmacy, Pathology, Radiolgy,
Phisiotherapy, Cardiology, C.T./M.R.I., Odiometery Equipments, Hospital, Administration, O.T.
Tech. A.N.M., J.N.M., B.Sc. Nursing Training etc. and its operation.
MAIN OBJECTS:
4.1 To promote general awareness regarding education especially in rural areas and urban slums so
that common men may be benefited from the fruits of development and progress.
4.1 To establish, run and manage education institutions such as school, college and madarsa, etc.
for imparting general, scientific, cultural and vocational education.
4.3 To provide free education, upto secondary level to the students of excluded and marginalized
people and accelerate educational awareness among youth.
4.4 To organize campaigns and programmes for the promotion of literacy and adult education among
the educationally backward communities, rural people and slum dwellers.
4.5 To establish canters for the promotion of rural technology and indigenous talents.
4.6 To run and manage schemes of financial assistance, scholarships, book banks, study grants for
the deserving students in order to help them in their knowledge pursuits.
4.7 To establish hostels, short stay homes, crèches, lodge homes, asylums, activity centers, centers
of handicaps, rehabilitation centers, counseling centers and victims of juvenile delinquency.
4.8 To organize competitions, science fairs, tournaments, cultural programmes and award
ceremonies for the enhancement of group activities, team spirit, competitive attitude etc. among
the targeted people like youth, etc. and also organize coaching and remedial classes, special
education centers, information, libraries, reading rooms, activity clubs, etc. for improving youth to
complete in life in a better way.
Education and Promotion of health and Hygiene
4.9 Organize campaign for the promotion of general health and hygiene in the area and cooperate in
this regard with governmental agencies and NGOs.
4.10 Establish public health centers, rural clinics and preservative medicine centers, education
centers, etc.
4.11 Operate mobile clinics, ambulances and other medical facilities for the needy and poor people
and provide them financial helps in the form of medical relief.
4.12 Organize campaigns and mass awareness programmes against drug abuse, epidemic diseases.
4.13 Organize health melas, eye-camps, medical check up camps, vaccination, campaigns for the
eradication of mal-nutrition and mass diseases like Tuberculosis and Cholera, etc. and to make
efforts for the reduction and control of common and Chronic diseases like AIDS, Hepatitis etc.
4.14 Promote rural based economic and holistic health promotion system while dressing traditional
and indigenous knowledge.
Enrichment of Environment
4.15 Propagate technical and traditional environment awareness among the target people and to
make their life more eco-friendly.
4.16 Provide information to the rural people and develop their resistance against environmental
hazardous of the modern agriculture and husbandry practices.
4.17 Promote social forestry, wasteland development, environment enhancement processes, etc. for
the preservation of environment in the target areas.
Economic Progress and Reformation
4.18 Promote over all socio-economic reformation desired for the upliftment of originals and
backward communities through special schemes, campaigns and to operate people to fight
against various social evils.
4.19 Manage social counseling centers for better guidance of the people to resolve inter and intra
family and other disputes out of court elements.
4.20 Organize income enhancement schemes, rural production centers, cooperative properties,
marketing units, etc. for the economic advancement of people.
4.21 Educate people and prepare about their constitutional and empower them with dignity, position
and resources.
4.22 Print and publish pamphlets, books, magazines and journals for the element of the above
objectives.
4.23 Organize meetings, seminars, conferences, workshop etc. to disseminate the sage of the trust.
4.24 Conduct surveys, researches and studies for better understanding of the current problems and in
devising their pertinent solutions, provide relief and rehabilitations at the time of natural and man
made amities.
4.25 To cooperate and collaborate with local, national or international organizations working for the
similar cause.
4.26 To undertake all other programmes and activities incidental to the achievement of the above said
objectives.
OTHER OBJECTS:
4.27 To pay to the government or to any public authority rent, taxes, assessment dues, and
outstanding that may from time to time be levied in respect of the trust assets or any part thereof.
4.28 To accept donations (in cash or kind), subscriptions, grants, presents, and to collect dividends,
rent, and other income of the trust found, etc., for being utilized to further the objects thereof.
4.29 To open and maintain account of the trust or its various establishment in the bank or bank for the
purpose of keeping the money for the trust and to operate the same or to authorize anyone or
more of them to operate the same.
4.30 To invest, dispose off, transfer and otherwise deal with trust in such manner, as the trustees find
proper to do in carrying out the objects of the trust.
4.31 To raise or borrow money required for the purpose of the trust on a mortgage or pledge of the
trust estate or a part the roof with or without any security and on such terms and conditions, as
the trustees may think fit.
4.32 To take over the management of any other public or charitable institution, project or branch of
any such institution on such terms and conditions as the trustees may deem fit to manage such
institutions.
4.33 To acquire by purpose of exchange, lease of hire or otherwise any lands/buildings and any other
property movable or immovable of any estate for the furtherance of all or any of the objects of the
trust.
4.34 To do all such other lawful acts, deeds or things either along or in connection with other
organizations, as are incidental or conductive to the attainment of any of the above objects.
4.35 To provide facilities for the welfare of employees of the trust.
4.36 To make rules and regulations for the conduct of affairs of the trust and to ad, vary or rescind
them from time to time.
4.36 All activities financed with idols and objects as started herein for advancement of the community,
nation and mankind, provided that any donation earmarked and accepted for any specific
purpose falling within the objects mentioned THESE PRESENTS, shall be used for such specific
purpose.
4.37. To accept upon such terms as the trustees may think fit any grant, donation or contribution in
money kind or land or other property impressed with the trust to carry out the objects referred to
in sub-clauses, PROVIDED THAT the terms upon which grants, donations, contributions are
accepted shall not in any ways be inconsistent with or repugnant to the objects of THESE
PRESENTS.

5. MANAGEMENT AND CONTROL OF THE TRUST PROPERTIES:
5.1 There shall be a board of trustees to administrate and look after the affairs of the trust.
5.2 The management and control of the trust and the trust properties shall rest in the board of trustees.
The board of trustees shall comprise of not less than (5) and not more than (6) trustees excluding all the
office bearers of the trust.

6. NATURE OF TRUSTEES
A. Founder Trustees:
The promoters of this trust as mentioned herein above, shall be the Founder Trustees of the trust,
who hold the office for like. In case of any vacancy of the founder trustees, then the remaining founder
trustees shall be empowered to co-opt any one as the Founder Trustees to keep the total number of
Founder Trustees to be 5. The Founder Trustees shall be entitled to fill the vacancy of any office-bearer
from among themselves.
B. Life Member:
The Board of Trustees can accept application of interested persons who are prepared to pay a sum
of Rs.10000/- or as fixed by the Trustees as the Life Members of the Trust.
C. Associate Member:
The Associate members of the trust shall be that person whose application is accepted by the
Board of Trustees and payment of a fixed amount per year.
Trustees other than the Founder Trustees and Life Members shall hold office for a period of one
year only and will be eligible for reappointment by the Board of Trustees.
These eminent religious and social personalities who are requested by the Trustees to accept the
office of patrons in view of their potential help and guidance to the Trust shall become the patron of the
Trust for a term of five years.
7. EFFECT OF APPOINTMENT OF NEW TRUSTEES:
Upon every appointment made in pursuance of the last foregoing clauses thereof, the appointed
Trustees shall have all power and authorities of the Trustees under THESE PRESENTS.
8. POWER OF BOARD OF TRUSTEES:
The Trustees shall enjoy the following power pertaining to their responsibilities as the Trustees of
this Trust.
9. POWER TO APPOINT AGENTS AND COMMITTEES:
The Board of Trustees shall be entitled from time to time to appoint with or without remuneration
and on such terms and conditions as they may think proper, persons or agents, to appoint committees as
they may think proper to work under the authority and cooperation of the Trustees for carrying out
functions of the Trust of THESE PRESENTS or the arrangement thereof and may within the limits of their
own powers invest them with all powers including powers to incur all such expenditures as may be
necessary for carrying out the objects of the Trust.
10. POWER TO DETERMINE ALL MATTERS OF DOUBT OR DIFFICULTY.
It shall be lawful for the Board of Trustees to settle and determine all matters of interpretation of
THESE PRESENTS as well as matters of difficulty, doubt or dispute and all questioning in the court of or
incidental to the administration, management and determination, though the questioning involved may
not be actually raised shall be valid.
11. POWER TO COMPROMISE AND REFER TO ARBITRATION:
The Board of Trustees shall have full power to settle, compromise or compound out of court, all
suits, actions or proceedings and to settle all accounts relating thereto as fully as if they were absolutely
entitled to the Trust Fund and without being answerable for the loss arisen thereby.
12. POWER TO PURCHASE, HIRE OR TAKE ON LEASE:
The Board of Trustees shall be entitled to purchase or hire or to take on lease the property or
properties for the purpose of carrying out the objects of the Trust hereby created.
13. POWER OF BORROW:
The Board of Trustees may from time to time, at their discretion for the furtherance of the Trust of
THESE PRESENTS borrow money and in such form and manner as they find proper and thereupon the
Trustees shall at their discretion, make all such disposition of the properties movable or immovable
forming part of the Trust Fund or any part thereof and enter into such agreements, assurances and
deeds in relation thereto as the Trustees may deem proper for giving to such loans.
14. OPENING OF BANK ACCOUNTS AND ITS OPERATION:
The Trustees may from to time, open and maintain in the Trust, or its subsidiary establishments,
any banking account or accounts with such scheduled banks as may from time to time be determined by
the Trustees and shall forthwith pay or cause to be paid the rents, incomes, profits dividends and all other
moneys forming part of the Trust Fund to the credit of any such account or accounts. Such accounts may
be operated by such Trustees of THESE PRESENTS. In order to operate the central account of the Trust
Chairman's signature shall be essential other joint signatories shall be the Treasurer and one Trustee
nominated by the Board of Trustees and signature of any one of these two shall be sufficient to operate
the central account along with the Chairman.
15. POWER TO MANAGE AND SELL IMMOVABLE PROPERTY:
The Trustees may sell or assign any movable or immovable property or properties for the time
being forming part of the Trust Fund either together or in part and either by public education or private
contract. The receipt in writing signed by the Chairman or General Secretary of the Trust for the time
being of THESE PRESENTS for any income or dividend of the Trust Fund or for any deeds. Papers,
writing documents or other and moneys and effects payable or deliverable to the Trustees shall be
sufficient and effectual discharge for the same respectively as in such receipt or receipts shall be
expressed or acknowledged to or to have been received and the person or persons to whose favour the
same shall be given, his or her or their executors or administrators shall not be afterwards in any case
obliged or concerned to see to the application of the moneys, property and effects therein mentioned and
acknowledges to be received or answerable or accountable for the loss, misappropriation or non-
application thereof.
16. POWER TO MAKE RULES AND APPOINT STAFF OF THE TRUST:
It shall be competent for the Trustees to make rules and by-laws from time to time consistent with
the expressed provisions of THESE PRESENTS as the Trustees may deem proper for facilitating the
management of the Trust, its assets and the regulation and conduct of the staff of the Trust. The
Trustees may from time to time repeal or alter, amend, rescind or add to such rules and bye-laws or
amend the clauses necessary parts and appoint relevant staff on such terms and conditions as they may
think fit for the Trust.
17. POWER TO AMALGAMAE OTHER TRUSTS ETC.:
The Trustees shall be at liberty to amalgamate any other trust or institution of charitable or non-
charitable nature, in any area the objects of which are similar to those of THESE PRESENTS, provided
that no conditions are accepted, involve a charge in the name of the Trust or are inconsistent with or
repugnant to the objects thereof.
18. POWER TO REIMBURSE:
The Trustees of THESE PRESENTS are entitled to reimburse and also to pay and discharge out of
Trust Fund, all expenses incurred by them or on their behalf or about the execution of the Trust and
power of THESE PRESENTS. However, the Trustees may be paid any Salary or emolument for his or
their full-time services to the Trust, if the Trustees so think necessary.
19. GENERAL:
The Board of Trustees would be competent and empowered to do all such things as may be
required for the fulfillment of the objectives of the Trust.
20. INVESTMENT OF TRUST FUND:
All money forming part of the Trust Fund and requiring investment shall be invested on behalf of
and in the name of Trust or the Trustees to be held in exclusively for the purpose of the Trust for the time
being in or open any of the securities authorized applicable law enforce from time to time for investment
of Trust Funds in any scheduled Bank.
21. POWERS AND DUTIES OF THE OFFICE BEARERS:
The powers and duties of the office-bearers of this Trust shall be as follows:
21.1 POWER OF THE CHAIRMAN:
(a) The Chairman shall preside over all the meeting of the Trust and other units. In his absence the
Vice Chairman shall resume his functions and in the absence of both, the attending Trustees shall
choose any one from among themselves to preside such meetings.
(b) The Chairman shall ensure that these rules are enforced and resolutions of meetings are carried
out.
(c) He shall call the meetings of the Trust and the other units through the General Secretary.
(d) He shall exercise general supervision over the affairs of the Trust and may for this purpose issue
instructions to these concerned.
(e) He shall sign all contracts in the name of the Trust.
(f) All important correspondences of the Trust shall be under his signature.
(g) He shall hold his offices as the Chairman of the Trust for life and shall enjoy a veto power in
meetings.
21.2 POWER AND DUTIES OF THE GENERAL SECRETARY:
(a) The General Secretary shall be the executive officer of the Trust and the general official
correspondence shall be carried out under his signature and he shall have supervisory powers of visiting
all the institutions and units of the Trust.
(b) He shall send notices of the Trustees regarding all the meetings on due dates and according to the
instructions of the Chairman.
(c) He shall prepare the agenda of a meeting in consultation with the Chairman.
(d) It shall be his duty to see that proper accounts of the Trust are kept and documents are prepared
pertaining to all the incomes and expenses of the Trust.
(e) He shall submit report of the working of the Trust in its every meeting of other units.
(f) The Secretary shall assist the General Secretary in his functions.
21.3 POWER OF THE TREASURER:
(a) The Treasurer shall be responsible for issuance of receipts and vouchers for the funds received
and payments of the Trust with other office-bearers.
(b) He should get the accounts audited according to the rules.
(c) He should deposit in the bank, all the collections made as soon as possible.
(d) He shall be responsible to submit in every meeting a details statement of incomes and expenditure
and cash in hand and bank balance for the consideration of the Trust and shall prepare and submit
budget for the next term in consultation with other office bearers.
(e) He shall make efforts for the enhancement of resources of the Trust.
22. ACCOUNTS AND YEARS:
22.1 ACCOUNTS AND AUDITS:
The Trust shall get maintained regular accounts of the Trust Fund and get the same duly audited
annually from the Chartered Accountants.
22.2 ACCOUNTING YEAR:
The accounts of the Trust would be closed and balanced on 31st March, every year.
23. MEETINGS, AGENDA AND QUORUM:
23.1 At least 15 days notice of the meetings shall be given for an ordinary meetings and one day's
notice for an emergency meeting provided that in case of urgency if the Chairman so thinks fit a
resolution can also be passed by circulation.
23.2 Decisions at a meeting of the Trust shall be by majority votes, until and unless voted by the
Chairman of the Trust.
23.3 In case the votes are equally divided the Chairman shall have the casting vote.
23.4 One, Hired Trustees shall be the quorum of any meeting.
23.5 The Board of Trustees will hold bi-annual meeting at the beginning of a financial years shall be the
Annual meeting in which Annual Report of the Trust and other units would be presented before the Board
of Trustees for its approval. The same also consider the Annual Financial Report and Annual Budget for
approval.
24. TERMINATION OF TRUSTEES:
Any Trustee shall cease to be trustees on his resignation, demise, insanity, bankrupt, non payment
of membership fee, being not attending meeting of the Trustees for period of two consecutive years due
to lack of interest and activities against the interest of the Trust, for this purpose a resolution of the Board
of Trustees shall be required.
25. DISSOLUTION OF THE TRUST:
If the circumstances so required, the Founder Trustees of THESE PRESENTS jointly or in their
absence 2/3rd majority of the Trust. In such a case the movable and immovable properties of the Trust
shall be handed over to any duly registered Trust or society working for similar objectives, in accordance
with the relevant resolution of the Trustees as specified herein above.
