Dear Sergeant Jones:
On February 18, 2020, you were provided a Notice of Administrative Investigation and a Notice
of Administrative Interview. These documents informed you that you were the subject of an
administrative investigation. These documents outlined allegations of violations of Cedar Rapids
Police Department directives involving your conduct.
‘The Cedar Rapids Police Department conducted an internal investigation into these facts and
circumstances. You were advised in writing of the results of the investigation on a Notice of
‘Administrative Hearing document, and given an opportunity to be heard on this matter during an
administrative hearing that was held on May 29, 2020.
Based upon my review of the administrative investigation conducted by Lieutenant Ryan
Abodeely, along with the memorandum of the findings submitted by the Discipline Board, I
make the following findings and impose the associated discipline for the violation of Cedar
Rapids Police Department directives:
1. Violation: CRPD Directive — In-Car Audio/Visual Equipment
To Wit: On January 16, 2020, Sergeant Jones testified under oath that on the
traffic stop of October 30, 2016, he intentionally tumed off his audio recording
microphone to conceal that he was intentional violating policy.
Finding: Sustained
Discipline: Letter of Reprimand

To Wit: On October 30, 2016, then Officer Jones did not impound or arrest the
driver as the Cedar Rapids Police Department required,

To Wit: On April 13, 2017, Officer Jones gave Lieutenant Furnish untruthful
statements during his interview regarding the status of his audio microphone
during the traffic stop which took place on October 30, 2016.
Findings: Sustained
Discipline: Dismissal
To Wit: On February 20, 2020, Sergeant Jones gave Lieutenant Abodeely
untruthful statements during his interview.
Findings: Sustained

4, Violation: CRPD Directive ~ Code of Conduct; Competency & Derogatory Remarks or
Acts by Employees
To Wit: On January 16, 2020, during a deposition under oath, Sergeant Jones
made statements that he would knowingly violate department policy as he sees fit.
Findings; Sustained
Discipline: 40-Hour Suspension
5. Violation: CRPD Directive — Code of Conduct; Deceptive Communications
To Wit: During the February 20, 2020, interview with Lieutenant Abodeely,
Sergeant Jones made continual untruthful statements to Lieutenant Abodeely.
Findings: Sustained

6. Violation: CRPD Directive ~ Code of Conduct; Swom, Rules of Conduct, Obedience to
Laws and Orders & Obedience to Rules
To Wit: Officer/Sergeant Jones violated the rules, regulations, directives, orders,
and policies of the Cedar Rapids Police Department during the October 30, 2016,
trafic stop, during the April 13, 2017, administrative interview, during the
January 16, 2020, deposition, and during the February 20, 2020, administrative
interview.

DISCIPLINE
I find that your conduct and actions violated the rules and policies of our department. This
misconduct cannot be excused or tolerated,
As discipline for this misconduct, I am imposing the following:
* Immediate termination of employment from the Cedar Rapids Police Department
effective June 18, 2020.
APPEALS AND HEARINGS
Asa civil service employee, you have certain rights afforded to you under the provision of
Chapter 400 of the Code of Iowa.
Employees under Civil Service shall have the right to appeal to the Civil Service Commission.
Appeals involving the suspension, demotion, or discharge of a person holding civil service rights
must be appealed in writing with the Clerk of the Civil Service Commission within fourteen (14)
days after suspension, demotion, or discharge.
Within ten (10) days after the notice of appeal, the Commission shall fix the time, which shall be
not less than five or more than twenty (20) days thereafter, and place for the hearing the appeal
and shall notify the parties in writing of the time and place so fixed, and the notice shall contain a
copy of the specifications so filed. The trial of all appeals shall be public, and the parties may be
represented by counsel.
Any specific questions you have related to fringe or retirement benefits need to be answered by
the City of Cedar Rapids Human Resources Department and the Municipal Fire and Police
Retirement System.
‘You have been previously advised that should disciplinary action be taken against you because
of these facts and circumstances that information regarding any disciplinary action as described
in Iowa Code Section 22.7(1 1)(a) may be placed in your personnel record and may become
public record.
