CLIENT AGREEMENT
This agreement is between AyiCareConnection, LLC, a Texas organization (the “Agency”) and the employer (“Client”). Child
and elder caregivers are referred to “Caregivers” in this document. The condition and pricing in this Agreement will remain in
effect for 3 days.
I (we) certify that the information supplied to the Agency is true and accurate and that I (we) agree to the terms set forth in this
Client Agreement.
I (we) understand that the Agency is a referral service and will not be liable for any damages caused by the referred caregivers. I
(we) agree that the Agency is not responsible for events beyond their control. Furthermore, I (we) understand and acknowledge
that the Agency is not an employer or representative of the referred caregiver and, therefore, is not in any way liable for any
loss, damage, expense or injury which I (we) may suffer or incur as a result of wrongful acts, omissions, or negligence on the
part of the caregiver placed with me (us). I (we) agree to release and discharge the Agency from all liability for any act of the
referred caregiver, and agree to hold the Agency harmless of any claim as a result of the caregiver placement.
I (we) acknowledge and understand that the Agency, or their designee, will investigate an applicant’s work and personal history
upon my (our) offering of a position to a candidate. I (we) may request that the Agency, or their designee, conduct background
investigations if available, which will include, but is not limited to, criminal history, driving record, sexual offender registry,
terrorist search, Social Security Number, and prior address verification. I (we) acknowledge that federal law prohibits the
employment of unauthorized aliens in this country. Therefore, the caregiver which I (we) have chosen must submit proof of
their employability. Failure to submit such proof will result in the denial of their continued consideration for employment.
The Agency assumes no responsibility for paying or withholding any Federal, State, or local taxes, Workers Compensation,
Unemployment Insurance, Social Security contributions or insurance premiums arising from the caregiver’s employment with
me (us). I (we) understand that it is my (our) responsibility to coordinate all payroll and benefit activities independently from
the Agency.
Indemnification: I (we) agree to indemnify and hold the Agency harmless from all claims, demands, actions or damage of
every kind and description, including reasonable attorney’s fees and all other costs and expenses necessarily incurred, which
may accrue to or be suffered by Client as a result of Client’s, caregivers’, or a third-party’s acts and/or omissions and not as a
result of the Agent’s acts and/or omissions, including, but not limited to, negligence, malfeasance, misfeasance, nonfeasance,
willful misconduct of the caregivers or a third-party, acts of war or government restriction, and events directly or indirectly
caused by any intentional or negligent acts or omission by any caregiver the Client hires.
Scope of Services/Responsibilities:
● The Agent will provide the following services in conducting the search for the Client: understanding the Client’s
requirements, personal screening of prospective caregivers, coordinating interviews, and/or background check / 1-2
reference checks.
● The Client is responsible to thoroughly review documents including information provided by Agency, make the final
decision to hire the Caregiver, and pay fees according to the timeline listed below.
Payment: I (we) understand the total fees are $329 (non-refundable). Search fee is required prior to the start of caregiver search.
I (we) agree to pay the balance via AyiConnection Concierge program, Chase Quickpay, cash or check made payable to:
AyiCareConnection, LLC.
This agreement is between Client and AyiCareConnection, LLC and should not be distributed to any outside parties
CONFIDENTIALITY: I (we) understand that I (we) will not enter into any agreement with a caregiver candidate introduced to
me (us) by the Agent without first compensating the company for their search efforts. I (we) also agree to not refer their name
and phone number for employment purposes to a third party or share the contents of any documents forwarded for Client’s
review. If I (we) fail to keep information in confident about a candidate, who subsequently received employment from the third
party, I (we) will be responsible for the referral fee that would have been payable for that caregiver or other household
employee.
Collection: I (we) further understand that in the event the Agency must seek collections of the above-described fee or any
portion thereof, I (we) shall be responsible for all costs of such collections, including court costs, reasonable attorney fees and
interest of 5% per month until paid.
Governing Law and Venue: This Agreement shall be governed and construed in accordance with the internal laws of the State
of Texas without giving effect to its principles of conflicts of laws. Any actions commenced for any dispute arising out of this
agreement shall have as its sole, proper and exclusive venue the appropriate court within Collin County, Texas.

I (we) have read and understand this Family Application and Agreement and agree with all of the terms and conditions set forth
