NOTICE OF APPEAL

DEFENDANTS, through the Counsel de Officio and unto this Honorable Court
hereby give notice that they are appealing the Decision of this Honorable Court
dated January 17, 2020 which was received by counsel on January 31, 2020 to the
Regional Trial Court on questions of fact and law. The parties in this appeal are the
spouses plaintiffs as appellees and all the defendants as appellants.

Defendants are indigent litigants as determined by this Honorable Court,


hence, we pray that they be exempted from the payment of the filing fees in
accordance with the Rules.1 We also pray that defendants-appellants be exempted
from furnishing the requisite supersedeas bond to stay the immediate execution of
judgment in ejectment proceedings.

WHEREFORE, it is respectfully prayed that the defendants be allowed to


appeal the above-mentioned Decision to the Regional Trial Court without the need
to pay the requisite filing fees and supersedeas bond and that this Honorable Court
forward the records of this case to the Regional Trial Court for the disposition of this
appeal.

Indigent-litigants exempt from payment of legal fees. — Indigent litigants (a) whose gross income and that of their
immediate family do not exceed four thousand (P4,000.00) pesos a month if residing in Metro Manila, and three
thousand (P3,000.00) pesos a month if residing outside Metro Manila, and (b) who do not own real property with an
assessed value of more than fifty thousand (P50,000.00) pesos shall be exempt from the payment of legal fees.
