International Organizations have existed since the 19th century, but they increased in number
and importance in the second half of the 20th century.
Small technical organizations established between neighboring states
Universal organizations (ex. UN)
o Established to serve some specific tasks thru permanent organs
International Organizations play an important role in global governance since their expertise
and professionalism is relied upon by States in order to design, decide, and implement common
policies. Such reliance is not without some problems of legitimacy and accountability. But this
are political issues and not legal ones.
Always the result of a free intent to get and act together.
Members are states and other international organizations whose rules allow it
o UN members are states only
o WTO members include separate customs, territory having full autonomy in the
conduct of external commercial relations
The European Union is a founding member of WTO alongside the
European Union member states
Often called as intergovernmental organization
Often established as a result of a juridical act (ex. treaty) concluded between the founding
members
o Such treaty will be the basic instrument of the organization
o Like a constitution for the organization
Membership is made of other subjects of international law
Governed by international law as distinguished from domestic associations like NGOs
and other entities constituted under the laws of a specific country
Established in order to serve specific purpose
o They are based on functionalism, making them specialized.
Ex. An IO dedicated to coordinate the rules relating to civil aviation
Equipped with permanent organs (ex. Secretariat made of international civil servants and
some governing body where the members of the organization are presented)
o It is not an addict international conference set up for a certain purpose during a
couple weeks or months
o Its permanence makes it an institution with its habits, character, and its internal
culture
o They are bureaucracies
They are profoundly rational and central to any modern way to govern.
They move by the law.
When a new task is established, the first question is what legal basis
entitles the organization to carry it out.
They will refer to the international instrument under which the organization is established
which is an instrument governed by international law.
