CONTRACT OF EMPLOYMENT
This CONTRACT OF EMPLOYMENT is made on this day Tuesday month of 07 July 2020 between :

(hereinafter referred to as “the Worker”) of the other part.
WHEREAS the Employer shall employ the Worker in accordance with the terms and conditions of this
Contract of Employment and subject to the laws, regulations, rules, national policies and directives of
Malaysia.
IT IS HEREBY AGREED as follows:
1. Duration of this Contract of Employment
The duration of this Contract of Employment shall be for a period of 6 (Six) month(s), from July 21th
2020 until January 20th 2021, commencing on the day of arrival of the Worker in Malaysia until such
time the Contract of Employment is terminated in accordance with the terms and conditions of this
Contract of Employment. Having completed your period of contract, your performance will be appraised
and you will be advised in writing as to whether:
a. You are confirmed in this appointment, or
b. The Company considers it necessary to extend your period of contract.
2. Wages
2.1 The Worker shall receive a basic wage of RM 2000 (excluding incentive and overtime).
2.2 Wages shall be paid by the Employer on a monthly basis not later than end date of the following
month.
2.3 The payment of the monthly wages shall be made through a bank account in the worker‘s name.
3. Working Hours
Working hours shall be eight (8) hours per day in accordance with the labour laws in Malaysia.
4. Overtime
In the event the Worker, upon the request by the Employer, agrees to work in excess of his normal
working hours, the Worker shall be paid of RM 8/hours (Flat)
In the event Rest Day/Public Holiday : 2 x Overtime/Hours
In the event Rest Primary Public Holiday : 3 x Overtime/Hours
5. Rest Day
5.1 The Worker shall be entitled to one (1) rest day in each week on weekdays
5.2 In the event the Worker, upon the request by the employer, agrees to work on such rest day, the
worker shall be paid overtime.
6. Public Holiday
6.1 The Worker shall be entitled to public holidays in accordance with the labour laws in Malaysia.
6.2 In the event the Worker, upon the request by the employer, agrees to work on such public holiday,
the worker shall be paid overtime
7. Annual Leave
The Worker shall be entitled to annual leave in accordance with the labour laws in Malaysia.
8. Sick Leave
The Worker shall be entitled to a paid sick leave in accordance with the labour laws in Malaysia.
9. Evaluations Performance
9.1 The Employer as long as this Agreement is in effect has the right to evaluate the performance,
discipline and responsibilities of the Worker which includes the following matters :
a) Honesty
b) Work discipline and responsibility for completing work
c) Work performance
d) Not committing criminal or disgraceful acts both inside and outside the work environment
e) Compliance with the Employer regulations
9.2 If based on the evaluation of the the Employer, the worker does not fulfill 2 (two) or more provisions
as referred 9.1 of this article, then the Employer can unilaterally terminate this agreement without paying
any compensation to the worker.
10. Termination
10.1 In the event the Employer intends to terminate this Contract of Employment, the Employer shall
give one (1) months’ notice.
10.2 In the event the Worker intends to terminate this Contract of Employment, the Worker shall give
one (1) months’ notice.
11. Restrictions
11.1 The Worker shall not participate in any political activities or activities of those connected with
political organizations in Malaysia.
11.2 The Worker shall not change employment during this Contract of Employment period and shall not
carry or do other business.
11.3 If the Worker is found by the competent authority concerned creating social problems or engaging
in any illegal, subversive or criminal activities, the Worker shall be dismissed from the job.
12. Confidentiality
12.1 The Worker is obliged to maintain and hold firm the information and confidentiality of the Employer,
by not giving information in any form and to anyone as long as this Agreement is ongoing or has ended
about matters that are confidential or should be kept confidential from what is known without written
approval from the Employer unless this is required by law.
12.2 If The Worker violates 12.1, then the Employer unilaterally has the right to terminate this Agreement
without paying severance, commission, incentives or compensation in any form to The Worker, including
making legal efforts against the Second Party, both Civil and criminal.
13. Time is an Essence
Time whenever mentioned shall be the essence of this Contract of Employment.
14. Employees Provident Fund (EPF)
You are required by law to contribute to the Employees Provident Fund and your own contribution will
be deducted by the Company from your monthly salary. The Company will pay retirement benefits to
the EPF on the basis of 11% of basic salary upon confirmation on the earnings of the employee, which
11% shall be inclusive of the company’s statutory contribution to the EPF.
IN WITNESS WHEREOF the parties here to have signed this Contract of Employment on the day and year
mentioned at the beginning of this Contract of Employment.
