Compromise Divorce Agreement: Abubakar Mustapha

This document is a compromise divorce agreement between Abubakar Mustapha and Bai Sittie Sheena Amolan. They were married under Muslim rites and have two children together. COMPROMISE DIVORCE AGREEMENT

KNOW ALL MEN BY THESE PRESENTS:

This agreement is made and entered into by and between:

ABUBAKAR MUSTAPHA of legal age, Muslim-Filipino,


married and a resident of Ginakit, Brgy. Kalanganan II,
Cotabato City, Philippines, hereinafter referred to as the FIRST
PARTY; and

BAI SITTIE SHEENA AMOLAN, is likewise of legal age,


Muslim- Filipino, married and a resident of
_______________________, Cotabato City, Philippines,
hereinafter referred to as the SECOND PARTY.

WITNESSETH:

That FIRST PARTY and the SECOND PARTY are


husband and wife respectively, having been lawfully married in
accordance with Muslim rites, customs and traditions on
_______date of marriage_______________ at _____place of
marriage________, Cotabato City, Philippines and out of lawful
wedlock; they were blessed with two children namely:
a. ____________________five (5) years of age, born
on the 10th day of September 2009; and
b. ___________________., two (2) years of age, born
on the 5th day of March 2012

They are under the care and custody of their biological father,
the FIRST PARTY;

That due to extreme incompatibility and coupled with
serious misunderstanding, basically personal in nature which
resulted to irreconcilable differences, PARTIES have agreed
and consented to mutually divorce each other in accordance
with Islamic precepts;

That PARTIES finding themselves no longer compatible


with each other and realizing that they would suffer mental
anguish and to avoid physical pain as well as to commit sin
should they prolong their marriage as husband and wife and
after profound examination of themselves, finally decided to
dissolve their marriage vows that binds them together as
husband and wife;

That in order to have peace in their minds as well as in


their dwelling and to avoid domestic bickering so as not to
affect the tender minds of their children above- mentioned, the
herein FIRST PARTY and the SECOND PARTY agreed and
hereby agree to TERMINATE their marriage vows that binds
them as husband and wife;

That the FIRST PARTY and SECOND PARTY agreed


and hereby agree that the care and custody of the above-
named children shall be under the care and custody of the
SECOND PARTY;

That since they have not acquired any conjugal property


during the existences of their marriage, both PARTIES are not
allowed claiming anything against each other;

That after the signing of this Compromise Divorce
Agreement, PARTIES shall be obliged to observe faithfully and
religiously, and anyone who shall violate the terms and
conditions of the said Divorce Agreement shall be Liable for
Breach of Contract;

That pursuant to said decision to end their marriage vows


each other as husband and wife, the PARTIES hereto freely
and voluntarily invoke the provision of the Presidential Decree
No. 1083, otherwise known as “THE CODE OF MUSLIM
PERSONAL LAWS OF THE PHILIPPINES”.

IN WITNESS WHEREOF, PARTIES have hereunto set


their hands this ___DATE OF AGREEMENT_________, at
