AFFIDAVIT OF DESISTANCE
 
           I, ________________ , of legal age, Filipino, married and a resident of
_______________________, after having duly sworn to in accordance with law hereby depose
and state:
 
1. That I am the same person executing this Affidavit of Desistance;

2. That I am the Private Complainant of the case “VIOLATION OF R.A. 9262 docketed as
CRIMINAL CASE NO. NPS-XIII-11-INV-16G-00077 against respondent
____________________, my Complaint Affidavit is now pending before the City
Prosecutor’s Office;

3. That ____________________ is my legal husband;

4. That sometime on ___________________ , I filed a case for VIOLATION OF R.A. 9262 on


the ground of Psychological Abuse at ______________ Prosecutor’s Office with the
assistance of SPO2 ___________________;

5. That my husband had a hard time and difficulty in adopting the Filipino culture. The
filing of this case was mainly because of marital misunderstanding due to cultural
difference;

6. That I am no longer interested to pursue the said case as it would be to the great
advantage if our marriage is preserved, harmony is maintained and that I don’t want
my child to grow up without a father;

7. That I want to give my husband a second chance since his apology to me and to my
family was done sincerely;

8. That In view of the foregoing, I finally manifest that I am now completely and
absolutely desisting from testifying against my accused husband,
__________________________ , and exonerate him from any liability in connection with
the above-cited case and that I am no longer interested, and I hereby desist, in
prosecuting any criminal case/ charges;

9. That I execute this Affidavit of Desistance so that the above-mentioned criminal case
be immediately dismissed and considered finally closed;
