Spouses Nilo and Aida Pandoy witnessed an incident involving Jeana Alimama and Remonde Alimama over harvesting coconuts from a mortgaged parcel of land. The spouses were hired by Jeana to harvest coconuts but were confronted angrily by Remonde who claimed the land was his. To avoid conflict they left without finishing. Later Remonde borrowed their harvesting tool and the spouses saw him take coconuts from Jeana's area. They reported this to Jeana who filed a complaint against Remonde for qualified theft. The spouses provided this affidavit to attest to these events in support of Jeana's allegations against Remonde.

AFFIDAVIT OF WITNESS
WE, Spouses NILO G. PANDOY, SR. and AIDA B, PANDOY, both of legal ages,
Filipino citizens, husband and wife, respectively, and are residents of Brgy. Buca, Sta, Maria,
Davao Occidental, Philippines, after being sworn to in accordance with law, depose and state
THAT:

1. That we are the same and identical persons who caused the execution of this instrument
in support of complainant JEANA D. ALIMAMA;

2. That we are agricultural workers complainant JEANA D. ALIMAMA who is the lawful
possessor of a parcel of land containing an area of 6.0000 hectares, more or less, located
at Buca, Sta. Maria, Davao Occidental;

3. We know for a fact that a complainant’s brother, a certain REMONDE ALIMAMA


already mortgaged his share over said parcel of land unto and in favour of his sister,
complainant JEANA D. ALIMAMA for SIX (6) YEARS to expire on May 2, 2022 and
until the loan is fully paid. And during that term of contract, JEANA D. ALIMAMA
has the exclusive right to harvest and enjoy the fruits and coconuts planted at the said
land until the loan is fully paid;

4. That sometimes on March 26, 2021, JEANA D. ALIMAMA hired us to harvest the
coconut trees within said mortgaged premises. After picking the coconut fruits from five
(5) trees, respondent REMONDE ALIMAMA suddenly appeared while carrying a bolo
saying angrily in vernacular “kinsay nagsugo ninyo nga mag sungkit nga akoa
naman ni, tistingi ninyo ug sungkit kay panigbason ko na inyo sungkit!”;

5. To avoid further quarrel and complications, we backed put and did not pursue the
harvesting process and immediately left without saying a word and thereafter just saw
respondent REMONDE ALIMAMA collecting all the coconut fruits including the ones
we already picked from the coconut trees to his own benefit;

6. After about two (2) days, we were surprised when respondent REMONDE ALIMAMA
came to us and borrowed our “sungkit” not knowing that it will be used for harvesting
the coconuts of complainant’s area;

7. That after borrowing our “sungkit”, we witnessed him harvesting the fruits from at least
two (2) coconut trees within the area of complainant, the ones within his reach and
collected them to make copra;

8. That after said incident, we immediately reported the details to complainant JEANA D.
ALIMAMA and the latter likewise filed a complaint against respondent REMONDE
ALIMAMA to the Office of the Punong Barangay of Buca, Sta. Maria, Davao
Occidental and had the incident recorded at the Municipal Police Station of Sta. Maria,
Davao Occidental;

9. Accordingly, I am executing this Affidavit freely and voluntarily for the purpose of
attesting to the truth of the foregoing statements and in support of the allegations of
complainant JEANA D. ALIMAMA and pray for the immediate filing of a criminal
case of Qualified Theft against respondent REMONDE ALIMAMA;
