Scenario: Alleged Theft Incident

At about 9:00 AM of September 11, 2020, Sherlin Liezel Pena left the rented room to her
newly board roommate as suspect named, Kristine Baltazar Rodriguez. The victim asks for
favor to his newly board roommate to secure the rented room as possible while she was
on-duty as pawn shop clerk.

Thereafter, at about 9:20 AM of the same date, Sherlin Liezel Pena received a cellphone call
coming from her close friend as witnessed named, Rosalle Terana Dela Cruz. According to
witnessed, she was on duty as caretaker at Aspire-rented boarding house located at Bayan-
bayanan Ave, Brgy., Conception Uno, Marikina City. When the witnessed start to inspect the
rented room of Sherlin Liezel Pena, she suddenly heard a loud noise inside the rented
room. At that moment, she took a sneak peek at in-front window of rented room and she
saw a woman that wearing trouser pants and black t-shirt with markings “Classy and
Savage” and she identified it as Kristine Baltazar Rodriguez, carrying a jewelry box with
sticker or markings “Fancy Sherlin” and escaped by utilizing the rear door of the rented
room.

Furthermore, the victim immediately returned to her E-7 rented room, where she
discovered that her valuable item including jewelry was took and carted. At about 9:40 AM
of September 11, 2020, the victim immediately reported the theft incident to Pcp-7 station,
and thereafter the victim received a cellphone call from the suspect saying that she’s at
Buba-Lab Tea, located at Bayan-bayanan Ave, Brgy., Conception Uno, Marikina City and
asking to lend money amounted of ₱5,000.000, the victim agrees to be able to track down
the suspect.

That at about 10:20 AM of the same date, the Pcp-7 station conducted entrapment
operation at the aforesaid place. The two (2) Intel Operatives of Pcp-7 station named,
PSMS. Adrian G. Villanueva accompanied by PSSgt. Patrick A. Sapiera successfully
apprehended the suspect. Recovered from the possession of the suspect was the jewelry
box of the victim that contained of the following: two (2) Clover Bracelet 18k Yellow Gold a
total value of ₱8,000.00, two (2) Rose & White Gold Glamira PH a total value of
₱12,000.00. The suspect was duly informed of his constitutional rights in the dialect known
to her and was brought to 66 Lilac St. Conception Uno, Marikina City Pcp-7 for proper
disposition.

Savage” and escaped using the rear door of
rented room took and carted the jewelry box,
taking general direction to the north.

2. WHEN : An Alleged Theft transpired at about 9:20 AM of September 11, 2020,


Monday and referred to this office at about 9:40 AM of the same date

3. WHERE : Inside the E-7 room of Aspire-rented boarding house located at Green-Field
St. Brgy., Conception Uno, Marikina City

4. WHO : Victim : Sherlin Liezel Pena, 25 years of age, pawnshop clerk, single,
native of Bicol, presently residing at Aspire-rented boarding house located at Green-Field
St. Brgy., Conception Uno, Marikina City

Reportee/Witness : Rosalle Terana Dela Cruz, 24 years of age, care taker of Aspire-
rented boarding house, single, native of Bacoor, presently residing No. 93 Jade St.
McDonald Ave, Brgy., Conception Uno, Marikina City

5. HOW : Initial investigation disclosed that on the said TDPO, at about 9:00 AM of
September 11, 2020, the aforementioned victim left the rented room to the newly board
roommate named, Kristine Baltazar Rodriguez.

Thereby, at the about 9:20 AM of the same date, the victim received a cellphone call
coming from the witnessed named, Rosalle Terana Dela Cruz. Accordingly, she was on duty
as caretaker at Aspire-rented boarding house located at Bayan-bayanan Ave, Brgy.,
Conception Uno, Marikina City. When the witnessed start to inspect the E-7 rented room of
aforementioned victim, she suddenly heard a loud noise inside the rented room. She took a
sneak peek at in-front window of rented room and she saw a woman wearing trouser pants
and black t-shirt with markings “Classy and Savage” and she identified it as Kristine Baltazar
Rodriguez, carrying a jewelry box with sticker or markings “Fancy Sherlin” and escaped by
utilizing the rear door of the rented room and taking the general direction to the north. The
witness foreseen the incident that the suspect has anticipated the potential for personal
gained without the knowledge and consent of the owner. The jewelry box with markings
“Fancy Sherlin” was missing and contained the following: two (2) Clover Bracelet 18k
Yellow Gold a total value of ₱2,000.00, two (2) Rose & White Gold Glamira PH a total value
₱1,500.00.
Therefore, at the about 9:40 AM of September 11, 2020, the victim immediately reported
the theft incident to Pcp-7 station, and thereafter the victim received a cellphone call from
Kristine saying that she’s at Buba-Lab Tea, located at Bayan-bayanan Ave, Brgy.,
Conception Uno, Marikina City. Then and there, at about 10:20 AM of the same date, the
Pcp-7 station conducted entrapment operation at the aforesaid place that resulted in the
arrest of the suspect. The suspect was duly informed of his constitutional rights in the
dialect known to her and was brought to 66 Lilac St. Conception Uno, Marikina City Pcp-7
for proper disposition.

AFFIDAVIT OF ARREST

1. We, PSMS. Adrian Guevarra y Villanueva and PSSg. John Patrick Angustia y
Sapiera both members of the Philippine National Police, presently assigned at Marikina
City Police Station, after having been duly sworn in accordance with law, do hereby
dispose and state that:

2. That, at about 9:40 AM of September 11, 2020, we received a phone call from the
victim that she reported the theft incident happened in Aspire-rented boarding house
located at Bayan-bayanan Ave, Brgy., Conception Uno, Marikina City.

3. That, while the victim is in the station, she receives a cell phone call from the suspect
saying that she’s at Buba-Lab Tea, located at Bayan-bayanan Ave, Brgy., Conception
Uno, Marikina City and asking to lend money amounted of ₱5,000.000, the victim agrees
to be able to track down the suspect. The suspect is wearing trouser pants and black t-
shirt with markings “Classy and Savage”

4. That, at about 10:20 AM of the same date, the Pcp-7 station conducted an entrapment
operation at the aforesaid place.

5. That, PSMS. Adrian G. Villanueva together with his partner PSSgt. John Patrick
Sapiera apprehended the suspect in the said meeting place.

6. That, we recovered a jewelry box in the said suspect and it contains the following; two
(2) Clover Bracelet; 18k Yellow Gold a total value of ₱2,000.00; two (2) Rose
& White Gold Glamira PH a total value of ₱1,500.00.

7. That, accordingly one, Kristine Baltazar Rodriguez, the suspect, was only dazzled
by the expensive jewelry entrusted to him that’s why she committed the crime.

8. That, we immediately informed his offense and informing his Constitutional Rights as
stated in the Miranda Doctrine to the language known to him;

a. The right to remain silent and any statement he makes, can and it will be used
against him in any court of law in the Philippines.

b. The right to have a competent and independent lawyer in his own choice. If he
cannot afford to hire a lawyer, the government will give or provide one.

IN TRUTH TO THESE WE HEREUNTO affixed our signatures below to the truthfulness of


the foregoing.

9. That, we executing this affidavit to attest to the foregoing statement and for purpose of
filling appropriate charges against the suspect for violation of Article 308 of the
Revised Penal Code (Theft)
