SWOT ANALYSIS FOR RESTORATIVE JUSTICE IN THE PHILIPPINES

STRENGHT

Restorative justice has a high rate of success in reducing repeat offenses. It saves the state

money by preventing individuals from becoming part of the criminal justice system. A stronger

community may become in addition to enhancing the safety and well-being of a town or region,

restorative justice centers help to establish a more active citizenship. It gives both victims and

offenders a greater sense of satisfaction that justice has been served than did the previous system.

Compared to traditional criminal justice, it minimizes crime victims' post-traumatic stress

symptoms and the likelihood of retaliation. It lowers crime victims' desire for violent retaliation

against their perpetrators. It lowered because restorative justice has a high success rate in

minimizing repeat offenses, recidivism is a concern. When a community's residents are

reintegrated once the harm has been rectified. The probabilities of People who have offended

have the option to make amends, which reduces recidivism. Correct, learn from the situation, and

put it behind them As a result, they will be able to progress more quickly. Increased safety comes

with lower recidivism, resulting in a safer community. Individuals can use restorative justice to

improve their neighborhoods and communities. It provides both victims and offenders with more

satisfaction that justice had been done than did traditional criminal justice, it reduces crime

violent revenge against their offenders. It reduced recidivism because restorative justice has a

high rate of success in reducing repeat offenses, when communities reintegrate their citizens after

harm has been repaired. The likelihood of recidivism is greatly reduced people who have

offended have the opportunity to make things right, learn from the process, and put the matter

behind them. So they can more easily go on to lead a crime-free life, increased safety with

reduced recidivism comes a safer community.

WEAKNESS

"Restorative justice" seems to have clear political intent to somehow, replace and reduce

the punitive punishment. The wording is a cover to argue against the punitive element of the

justice system. There should never be a link between punitive justice and restorative justice if the

apology is to be genuine. There is nothing wrong with offenders visiting with victims or their

families and apologizing. Many, but not all, murdered victims would undoubtedly feel better. It

will also assist offenders. to take responsibility and possibly prevent him or her from repeating

the offense. However, the terms appear to be clear. The goal is to replace and minimize punitive

punishment in some way. However, if restorative justice is to work, It must be institutionalized

to replace and substitute punitive justice. It will then generate a material. Providing an incentive

for the offender to apologize in order to receive a reduced punishment. If there is such a thing, If

this occurs, it will have no effect on him admitting guilt or restoring the victim's dignity.

Essentially, the criminal justice system is telling you something. There is nothing wrong for

offenders meeting and apologising to victims or families of the murdered victim, many but not

all victims would certainly feel better. And it will help offenders to own up, and maybe prevent

him or her from re-offending. But the words appear to have clear intent to somehow, replace and

reduce the punitive punishment. But if restorative justice is to replace and supplant punitive

justice, it has to be institutionalised. Then it will create a material incentive for the offender to

apologise so the offender can get a reduced sentence.

OPPORTUNITY

Restorative justice appears to reduce recidivism for those who choose to participate. A

few measures can be taken to increase the likelihood of victims participating in restorative

justice. Victims and criminals may participate in restorative justice for a variety of reasons.

Victims may participate in order to meet the offender. Also, if you have any queries or are

seeking for something, In many situations, victims had doubts about how they may receive

compensation for the injury they had suffered. The police were investigating the crime and

needed answers from the perpetrator. These inquiries could be about anything. what transpired

during the offense, why the criminal damaged them, and whether he or she was found guilty She

was the one who had accepted responsibility for it. They expected that through expressing their

feelings and obtaining knowledge, they would be able to achieve their goals. Their recuperation

would be aided if they had more information about the crime. In reality, victims were concerned

in some circumstances. with the offender's criminal future They wished or hoped that their

conversation would be successful dissuade. Victims and offenders can have a variety of reasons

for participating in restorative justice; victims may take part because they want to meet the

offender. And have questions or are looking for a form of reparations for the harm caused, in

many cases victims had questions concerning the crime and were in need of answers from the

offender. These questions can concern what happened during the offense, the reason why the

offender had harmed them and whether he or she had taken responsibility for it.

Restorative justice operates on the principle that justice needs to take place within the

community. It believes that all parties should be involved including the offender and victim. In

cases of domestic violence, it is not always the offender that is the one who does the victimizing.

The issue is that, in light of a key shortcoming in restorative justice in particular, That form of

justice is credited as a feature of crime. By assuming that this sort of justice could be effective, It

does not work in all cases, and in many cases it does not work at all. It's similar to having a

parent. domestic violence survivor, and much of the criminal justice system is tied to domestic

violence. The fundamental issue with restorative justice, especially in terms of women, is

violence. domestic violence and are then arrested as a result of such encounters, such as fighting

back or filing the initial complaint, but not in the case of the first encounter with the police.
