LEAVE AND LICENCE AGREEMENT
THIS AGREEMENT OF LEAVE AND LICENCE IS MADE AND
ENTERED INTO AT MUMBAI THIS 8TH DAY OF FEBRUARY, 2022.
                                       BETWEEN
MRS. ISHRAT JAHAN MOHAMED ILYAS ANSARI, having residence
address at Royal Garden, Building No. C- 1, 2nd Floor, Flat No. 201, Opp.
Millennium Hospital, Old Mumbai Pune Road, Kausa, Mumbra, Thane,
Maharashtra, 400612. Hereinafter called the “LICENSOR “(which expression
shall unless it be repugnant to the context or meaning thereof be deemed to
mean and include her heirs, executors and administrators) of the ONE PART
                                        AND
MRS. BILKIS FAIYZ KAZI, having permanent address at, D/203, Manjiri
Heights, Yashraj Nagar, Badlapur Gaon (west), Badlapur, Thane, Maharashtra-
421 503 hereinafter referred to as the “LICENSEE”. (Which expressions shall
unless it be repugnant to the context or meaning thereof be deemed to mean
and include his or her, heirs, executors and administrators), of the OTHER
PART.
WHEREAS the LICENSOR is the owner of the flat situated at C-1, 502,
ROAYAL GARDEN, OLD MUMBAI PUNE ROAD, NEAR BILAL
HOSPITAL, OPP. TO SALVA HOTEL KAUSA, MUMBRA, DIST.
THANE, MAHARASHTRA – 400 612 (hereinafter referred as “the said
flat”).
AND WHEREAS the LICENSEE has approached the LICENSOR for the use
of the said flat for residential purpose for a period of eleven months on leave
and       license   as   permissible   under   Maharashtra   Rent   control   Act
1999(Maharashtra XVIII of 2000) under section 24(1,(2),(3) and the
LICENSEE has given undertaking and assurance that she will not claim any
right in the said flat.
AND WHEREAS the LICENSOR relying upon the said assurances and has
agreed to grant the LICENSEE the use of the said flat on leave and license
basis for her bonafide residential purpose only and on certain terms and
conditions, which have been accepted by the LICENSEE and the parties hereto
desire to record the agreed terms and conditions of their agreement into writing
and confirm the same. It is hereby expressly agreed and declared that neither
the agreement nor anything contained herein shall be deemed to create any
interest or estate in favour of the Licensee in the said flat, and that relationship
of both the parties shall always be that of Licensor and Licensee only.
NOW THIS AGREEMENT OF LEAVE AND LICENCE WITNESSTH
and it is hereby agreed by and between the parties hereto as follows:
 1.    The LICENSOR hereby grant in favor of the LICENSEE and the
       LICENSEE hereby accepts from the LICENSOR and agrees to take the
       said flat C-1, 502, ROAYAL GARDEN, OLD MUMBAI PUNE
       ROAD, NEAR BILAL HOSPITAL, OPP. TO SALVA HOTEL
       KAUSA, MUMBRA, DIST. THANE, MAHARASHTRA – 400 612,
       On leave and license basis for bonafide period of eleven months
       commencing from 13TH JANUARY, 2022 TO 12TH DECEMBER,
       2022.
2.   The LICENSEE will pay to the LICENSOR the license fees of Rs.
     10,000/- (Rs. TEN THOUSAND only) per month, in advance. The
     LICENSEE will pay a sum of Rs. 50,000/- (Rs. FIFTY THOUSAND
     ONLY) towards interest free Security deposit refundable to the
     LICENSEE by the LICENSOR when the LICENSEE vacates the said
     flat at the end of license period.
3.   The LICENSEE will pay the electricity bills regularly on schedule and
     will absolve the LICENSOR from such payments. If the supply of
     electricity is disconnected on account of non-payment of bills the
     LICENSEE will pay the necessary penalty and get the supply restored at
     her own cost, without bothering the LICENSOR.
4.   The LICENSOR shall bear and pay the monthly outgoing and dues such
     as water charges, taxes, society charges, etc. in respect of the said flat to
     the concerned authorities.
5.   The LICENSEE shall use the said flat at her own risk, and the
     LICENSOR shall not be held responsible or liable in any manner
     whatsoever for any loss or damage that may be caused to the life, limb
     or property of the LICENSEE and/or their guests, members, employees
     or any servants or invitees, whether by way of fire, rain, leakage,
     breaking or bursting of water pipes or due to electricity or wire
     installation or by any other cause or reason whatsoever.
6.   The Licensor shall not store any business article in the said flat,
     however, all articles required for use as a residential flat are permitted to
     be kept and brought, in the said flat.
7.   The LICENSEE shall make proper use and take proper care of the said
     flat and the fixtures and fittings therein and shall keep the same in good
     working condition during the subsistence of this agreement at her own
     expenses. In case any damage is caused by any reason whatsoever to the
     said flat and/or to any fittings or fixtures therein, the LICENSEE shall
     make good such damage that may be caused, during the license period.
8.   The LICENSEE shall not make any additions, or alterations in the said
     flat without the prior written consent of the LICENSOR, however, the
     LICENSEE shall, at their own costs and expenses be at liberty to install
     in the said flat, electric and other household appliances, furniture and
     fittings of a temporary and non-structural nature, electrical installations,
     lights, air-conditioners, fans, etc., as required for her proper use and
     enjoyment of the said flat, provided the same does not entail any
     structural breakage, alterations, or partitions as are neither nor brought
     by them and as capable of being removed without damage being caused
     to the said flat .On expiry or sooner determination of this agreement ,
     the LICENSEE shall remove such additions, alterations, or partitions
     from the said flat. Moreover, if any permanent fixture is fixed or any
     permanent alteration is made, the LICENSEE shall not be entitled to
     remove the same from the said flat, nor shall the LICENSEE claim from
     the LICENSOR any compensation or costs whatsoever for such
     permanent fixtures/alterations.
9.   The LICENSEE shall not do or be permit to be done in the said flat
     anything which would be illegal i.e. against any law, rules or regulations
      of the Government or local authority or which may cause damage to the
      said flat or any part thereof or the adjoining flat.
10.   The LICENSEE shall abide by the rules, regulations/ byelaws of the
      society/authorities in which the said flat is situated.
11.   The LICENSEE and its family members and servants would not cause,
      permit or suffer anything in any way, which may create a nuisance or
      annoyance to the neighboring occupiers or cause any damage to the said
      flat and building/property, wherein the said flat is situated.
12.   It is hereby clearly understood and agreed between the parties hereto as
      follows:
         (a) The transaction envisaged under this agreement is within the
             purview of section 24(1),(2),(3) of Maharashtra Rent Control act
             1999 and the LICENSEE has given undertaking and assurance
             that she will not claim any right in the said flat.
         (b) The LICENSOR are and shall always be in judicial possession
             and full charge and control of the said flat
         (c) The license hereby granted is purely personal to          the
             LICENSEE. The LICENSEE is not entitled to and shall not
             assign or transfer or sublet or part with the possession of the said
             flat, the LICENSEE granted herein to any person or induct any
             other person, into the said flat under any circumstances
             whatsoever.
         (d) By efflux of time or sooner determination thereof, either the
             LICENSEE or servants shall remove themselves as also their
             articles and belongings from the said flat, and shall hand over the
             set of keys of the said flat and the charge/peaceful and vacant
             possession of the said flat to the LICENSOR. On termination of
             the    license, the LICENSEE and servants shall be considered
             as illegal occupants and on their failure to vacate the said flat, the
             LICENSOR shall be entitled to remove them and also prevent
             them from entering into the said flat, as also remove the articles
             and belongings of the LICENSEE that may be laying in the said
             flat, at the risk and costs of the LICENSEE and without the
             LICENSOR being liable for any loss or damage whatsoever.
13.   It is further agreed that at the time of handing over the possession of the
      said flat back to the LICENSOR on expiry or sooner determination of
      the agreement, the LICENSEE shall ensure that the said flat is restored
      at her own cost to the similar condition as obtained at the time of initial
      occupation by the LICENSEE, reasonable wear and tear expected.
14.   The LICENSEE shall keep the LICENSOR indemnified against any
      demand or damages that may result on account of the negligence or
      default on the part of the LICENSEE and/or her family members and /or
      servants.
15.   The LICENSOR or her duly authorized agent or representative shall, at
      all responsible times have absolute right and full liberty to enter upon
      the said flat after giving sufficient notice and inspect the same and in
      order to exercise control in respect of the said flat in accordance with
      the terms and conditions of this agreement.
16.   Now withstanding anything contained herein, if the LICENSEE
      commits any breach of the terms and conditions of contract contained
      herein, the LICENSOR shall give the LICENSEE a written notice to
      remedy the breach within one week of the receipt of the said notice and
      on the failure of the LICENSEE to do so, the LICENSOR shall be
      entitled to cancel/ terminate this agreement and revoke the LICENSEE
      hereby granted to the LICENSEE and claim damages as decided upon
      by the Licensor.
17.   The LICENSEE has inspected the said flat and hereby confirms that he
      has received the said flat and the fixtures and fittings there in good order
      and condition.
18.   The LICENSOR shall be entitled to terminate this agreement by giving
      one months notice to the LICENSEE of her intention to terminate the
      license upon such determination of this agreement, the LICENSEE will
      surrender the said flat to the LICENSOR and the LICENSOR shall
      refund the deposit as mentioned above to the LICENSEE.
19.   The LICENSEE shall be entitled to terminate this agreement by giving
      one month notice to the LICENSOR of her intention to terminate the
      license or in lieu of the said Notice the LICENSEE shall pay to the
      LICENSOR an amount equivalent to the rent for the period of one
      month, upon such determination of this agreement, the LICENSEE will
           surrender the said flat to the LICENSOR and the LICENSOR shall
           refund the deposit as mentioned above to the LICENSEE.
20.        This Agreement has been entered into by the parties under Sec. 24 of
           the Maharashtra Rent Control Act, 1999 and in case the Licensee fails to
           hand over to the Licensor, vacant and peaceful possession of the said
           flat, on expiry of the said period of 11 months, then the Licensee shall
           be liable and bound to pay to the Licensor, compensation per month at
           double the License fee mentioned in this agreement.
IN WITNESS WHEREOF the parties hereto have hereunto set and subscribed
their respective hands at Mumbai on the 08 th day of February, 2022, first
hereinabove written.

BILKIS FAIYZ KAZI, Being the interest free, refundable security deposit
amount hereinabove mentioned in respect of the flat situated at C-1, 502,
ROAYAL GARDEN, OLD MUMBAI PUNE ROAD, NEAR BILAL
HOSPITAL, OPP. TO SALVA HOTEL KAUSA, MUMBRA, DIST.
THANE, MAHARASHTRA – 400 612, to be paid under this agreement of
leave and license.
