ABOUT MY INTERNSHIP:
I have been fortunate enough to have been secured an internship at the office of Learned
Senior Advocate, Shri Mahesh Jethmalani currently Member of Parliament . I interned in
sir’s office located at 68, Jorbagh, New Delhi , from 01.07.2021 to 30.07.2021. I was under
the guidance and training of Adv. Shri Ravi Sharma, Advocate on Record at the Supreme
Court of India aswell as the practicing advocate at the High Court of Delhi, High Court of
Kerela and various other High Courts. My office timing was 11 Am to 5 Pm in the evening. I
was also assigned work past working hours as well. This was mainly research and drafting
arguments for the senior advocates for the office. It was really a great learning experience to
be able to learn and enhance advocacy skills.
FIRST WEEK (1.07.2021 TO 09.07.2021)
This was the first week of my internship at the office of Learned Senior Advocate and
Member of Parliament Shri Mahesh Jethmalani, under the guidance of AOR Supreme Court
of India, Shri Ravi Sharma. The office was at 68 Jorbagh, New Delhi. The first day at this
office was a dream come true for me because this internship had really helped me knowing
the application of law. The first week of the internship was very intriguing.
On the very first week I had watched live streaming of the Supreme Court of India and I had
been given to research on the topic “Dialogic Jurisdiction” and my work was to make a
detailed report on the given topic.
Dialogic Jurisdiction is a dialogue between Congress and Supreme Court, neither institution
having a final say with no fixed constitutional principles, according to Barry Friedman.
During my research I came across few case laws : R vs. Mills (1999) , R vs. O’connor (1995)
and Suo Moto vs. State of Gujrat.
First week of the internship was a bit formal in nature as Learned Senior Advocate, Shri
Mahesh Jethmalani was not in the office as he had some important cases which was to be
heard in Bombay Highcourt, I was allotted my Senior Advocate Ravi Sharma (AOR) who
was an intern the Legend Shri Ram Jethmalani and later was his junior. After his demise, he
became a close associate of Shri Mahesh Jethmalani.
By the end of the first week of my internship I had submitted my final report on the topic
“dialogic jurisdiction” and later I was assigned a case study on the case of “ Asif Iqbal Tanha
vs. State of NCT Delhi and Others( W.P.(CRL) 1292 of 2020)”.
SECOND WEEK (10.07.2021 TO 16.07.2021)
The case of Asif Iqbal Tanha vs. State of NCT Delhi and Others( W.P.(CRL) 1292 of 2020)
was assigned to me by my senior. In the case Asif Iqbal was a student of Jamia Milia Islamia
who was booked under Sections 147,148,149, 120B of Indian Penal Code, 1860 in relation to
riots and violence in certain parts on North East Delhi.
He was also booked under sections 13,16,17,18 of UAPA on 16.05.2020 petitioner was taken
to special Lodhi Road and the accused was questioned for 12 hours straight and was
supposedly coerced to sign a blank sheet.
Asif Iqbal Tanha then filed a writ petiion before the Learned Court praying removal of
contents which were published by the Media, as it violates the Right to fair trial and he also
prayed that the media trial destroys the image of the petitioner (claimed by Asif).
This case was heard in motion hearing and was argued by my senior Shri Ravi Sharma and
his juniors. I was told to make a brief report on this case and submit it to my Senior, after
submission of the report i was directed to prepare an argument on behalf of the respondent
and submit it by the weekend.
While making a report on the case Asif Iqbal Tanha vs. State of NCT Delhi and Others( W.P.
(CRL) 1292 of 2020)”. I came across various landmark judgements which helped me in
understanding and researching about the case.
“Manohar lal Sharma vs. Narendra Damodardas Modi” the fact that that three documents had
been published in the Hindu and were thus available in the public domain has not been
seriously disputed or contested by respondents. The right of such publication would seem to
be in consonance with the constitutional guarantee of freedom of speech. No law of
parliament specifically barring or prohibiting the publication of such documents on any of
grounds in Article 19(2) has been brought in our notice”
THIRD WEEK (19.07.2021 TO 24.07.2021)
This was the most important week for my internship, our senior Learned Senior Advocate,
Shri Mashesh Jethmalani had arrived from Mumbai for some official work, I met him and he
guided me and provided me with important professional tips. Later on my senior gave me a
work to make a report on freedom of speech and expression. I made a report and submitted it
to my senior, while making the report i came across various important landmark judgements
like Shreya Singhal vs. UOI, LIC vs. Manubhai D Shah.etc which helped me in
understanding about freedom of speech and expression.
FOURTH WEEK (26.07.2021 TO 30.07.2021)
This was my last working day in the office as my internship period ended, I had received my
internship certificate on my last working day by my senior, before issuing the certificate
learned Senior told us how to be a successful advocate and guided me. He also gave me
some cases which I had to read and present the facts to my senior.
The cases which I was given by the senior was Priyanka Tibrewal vs. State of Westbengal
and Kerela Assembly Ruckus Case. Which I had prepared with full dedication and after that I
collected my Intermnship certificate.
