Bata-bata, Pa'no ka ginawa?
The analogy behind such phrases becomes more thick and comprehensively practical and logical in
application of understanding SOGIE bill's aims and goals as it reflects in "Bata-bata, Pa'no ka ginawa?"
the concreteness of discrimination in gender and that actually tells the nature of production of human
being but it actually points out the roles of women during the ancients years and of course it
significantly modify the idea of "Child, how will you become when you grown-up?" or the idea of the
conceptions about the infant when he/she born. It illustrated the reasons that, all of us are blank-slate
as what John Locke stated in his social contract theory(1689); he stated that whatever informations and
knowledge we have is because of our experience within our environment- so, Paano nga ba ako ginawa?
One that reflects me between the novel of Bautista year 1998, the blank slate by John Locke and the
SOGIE bill is that it is achored in a way of their environment- a development of society that states their
knowledge, information treatments and of course the discrimination. What I am pointing is, in Bautista's
novel it actually portrays that in society the men has a dominant rights over women as thus
discrimination is rampant and vibrant that leads to the effects pf norturing the child when they grow-up;
when it comes to the blank-slate- the mind of a person is corrupted by the societies pitiful standards,
and lastly when comes to SOGIE bill, it suggests the idea of equality regardless of their societal
identification and expression that reflects 'What is the SOGIE bill goals and "Paano at bakit nga ba ito
ginawa?"
Here, in whatever circumstances, and places gender-biases actually exist. In my family in which my Papa,
my kuya and ate's are either boxers or taekwondo players, leading to a fact that, as gay person, I am
completely pressured about their standards of doing the same thing as what they do- I have to pretend
that I am straight guy, I like basketball, I want to be an army, I am physically strong. I am man. I am
straight as an arrow. And now, i realized and doubt 'Paano kaya ako ginawa?'
I oftenly hears 'Baklaaa! Salot ka! and casting me out because I am gay.' I experienced bullying because
society corrupts their mind that I am like sick person, or possesed by demons as thus I need vodoo
priests to chase the demons out. I completely experienced a lot ever since when I am young. However,
obviously "pa'no kaya ako ginawa?'' the benefits of doubt is not something about the reproduction
system in biology but on the notions of" how does the society mold me into this kind of being?"," Why I
haven't denied myself and changed my identity because I suffered a lot, and so that others will stop to
nag about my identity and further, I cannot be teased, insulted and discriminates by others just because
I have another expression of my identity-this is completely discrimination. Will I agree and to SOGIE bill
or not? But, let me repeat myself, my reflection paper and my stand will not be affected by my personal
emotions.
SOGIE bill first defines and introduces the difference conception of sexual orientations, gender identity,
and gender expression of different walks and levels of life, as well as other terminologies that connects
with the aforementioned concepts. It further lists and discussed the different actions to be considered
as unlawful and discriminatory practices under the said bill and just like what happened in Bautista's
novel (1998). It includes the following forms of action but strictly stated that it is not only limited as how
I, has been listed it: 1) the rights to use establishment and sites services including the property rights, 2)
access to public service, 3) rights to apply in any professional license and jobs just like others, 4) the
differential treatment of an employee of anyone who had rendered their services, 5) revocation or
refusal of accreditation to any groups and organizations, and 6) expulsion of admission or denial from
and educational services due to the facts of individual SOGIE will also be punished or penalized by law
accordingly. It just some of the major grounds of the bill as to why it promotes the slaying of
discrimination.
In this case, it seems to me that the bill itself is somehow punitive or penal it is also counter attack to
those who exclude a person just because of his/her SOGIE. It also reflects that it is preventive. It actually
and significantly orders all the walks of life to be responsible, respectful, acceptance and the obsevation
of socially contsructed "equality." It overlooks the discretion and discrimination, the faces of refusal and
the portayal of LGBTQ+ in the streams of media, public places and transportations and promotions.
Further, this bill is actually inclined in the 1987 Philippine Constitution as it narrates the equal protection
clues in Article III. Sec. 1- it recognizes the aforementioned identities and expressions as ensures equally
just like other people who do not have unique expressions and identity. Moreover, it also dismantle and
acknowledge the international convention of law particularly the recognition of Philippine State in
Universal Declaration of Human Rights- it is as follows the duties of protecting the rights of individuals in
both international, national and local arena regardless of their SOGIE.
However, on the other side, one might argue that this is some sort of 'special treatment'. Partly yes,
partly no. But, I would never be neutral in this manner. I do believe in God, in his teachings in his
conscriptions in Bible, but I also believe that he is fair and just. If one might claims that it is something
that deteriorates the annotations of Bible then, does the other laws are basically achored in Bible too
that reflects the idea of protecting the rights, liberty and life? It does not make sense as this bills reflects
on me that it is anchored also in humanity, humanity that says about Bibles just and fair teacheings.
There are lots of law protecting the rights of individuals including the penal code, civil code, and labor
code- but there ia none that specifies about the dealing in such kind of discrimination. One must note,
that if there is no law punishing to such act then the actions is mere nothing but a legal act. I am
reflecting the idea, that there should be a specific law that could protect the rights of the LGBTQ+
community fully. The strong holds and the strong foundations of the laws are basically the societies
standards if it actually protects ones rights then it is reasonable in application. We states, the idea 'The
Philippines is democratic country, therefore, feel free to act' the action is justifiable but the actions
behind the standards of society is confusing and discriminatory.
Finally, the truth is that there are several laws protecting the rights of individuals just like how we deal
with the violence against women and children that is why we have RA. 9262. If this actually narrates
about women and children then it does make sense that it is a special treatment against men. Where
does equality lie? I am pointing the idea, that since there is specific laws penalizing such acts why cannot
be applied to LGBTQ+ community since they suffered the same or more higher than this. I am reflecting
it, reasonably and logically. In the question of 'Paano ako ginawa? At Paano at bakit ginawa ang SOGIE
bill? It is because societies corrupts the mind of individual. It is not special treatment rather it is counter
attack to those people who feel special just because they had firm gender identity. Thank you.
