Dear Sir/Ma’am,
We write in furtherance to the examination report and our reply to the examination report
is as follows:

Reply to Objection raised under Section 9(1)(a)

In the examination report, the learned Examiner has alleged that the submitted mark is non-
distinctive and as such it is not capable of distinguishing the goods of one person from those
of others.
I would to state and submit that the mark “AccountMein.com” is a composite mark with a
unique, eye-catching and notable mark that is inherently distinctive and capable of being
registered.
It is also submitted that an ordinary consumer with ordinary intelligence shall easily
differentiate the applied mark from the goods provided. Upon basic analysis when a person
of ordinary intelligence discerns, the applied mark in no ways indicates the kind, intended
purpose or the time of production of the goods or other characteristics of the goods
provided.
It is also a well-established rule of Law that where a trademark consists of combination of
number of features, the distinctiveness must be considered by taking the mark as a whole
and all its letters/integers should be considered in combination.
It is further submitted that the applied mark “AccountMein.com” is a coined word (invented
mark) with a unique combination of words. Further, the applicant would like to submit that
he has used the creativity and ingenuity at his disposal to come up with this novel mark
which has taken considerable amount of time and efforts. Hence, looking at these facts and
furnished information it is proved that the mark in its entirety is absolutely capable of
distinguishing the goods/services of the applicant from those of others.
In view of the submissions made above, you are requested to kindly waive the objection and
allow the application to be accepted and advertised in the Trade Marks Journal. In case the
submissions made above are not found satisfactory, then an opportunity of personal
hearing be granted, before any adverse orders are passed.
