Legislation in India; Introduction to the new labour codes.

MODULE 2

Right to Form Trade Unions vs Right to Collective Bargaining vs Right to Strike – Are they
fundamental rights?; Introduction to the IR Code; Definition and scope of ‘worker’;
Introduction to The Industrial Relations Code 2020; Preamble; Scope of the Code; Trade
Unions – Concept, History and Development, Registration, Recognition, Negotiating Union
& Negotiating Council, Right and Liabilities of Trade Unions, Adjudication of Disputes of
Trade Unions, Dissolution of Trade Unions, Annual returns; Definitions and New Concepts -
Fixed-time Employment

MODULE 3

Industrial Disputes and their Resolution; Strikes & Lock-outs; Lay-off, Retrenchment and
Closure under Chapter IX and X; Bi-partite forums – Works Committee and Grievance
Redressal Committee, Voluntary Reference of Disputes to Arbitration; Mechanism for
Resolution of Industrial Disputes – Conciliation Officers, Industrial Tribunal, National
Industrial Tribunal; Standing Orders – application, certifying officer and appellate authority;
Unfair Labour Practices – Second Schedule, Offences and Penalties

MODULE 4

The Occupational Safety, Health and Working Conditions Code, 2020 – Introduction;
Preamble; Scope of the Code; Registration; Duties of Employer and Employees;
Implementation Mechanism related to Occupational Safety and Health – Advisory Boards,
Inspectors-cum-facilitators, Powers of District Magistrate; Responsibility of Employer;
Welfare Provisions; Hours of Work and Annual Leave with Wages, Provisions Relating to
