Rajiv Gandhi College of Law, Malleswaram, Bangalore, which is affiliated
to Bangalore University-."and obtained degree in law. When the petitioners
wan,ted to enroll themselves .as advocates, the Karnataka State Bar
Council informed them that they could not be enrolled as the college
where they underwent the course of study (Rajiv Gandhi College of Law)
has not been recognised by the Bar Council of India,_ The Supreme Court
held that the petitioners cannot be refused enrolment on this ground, i.e.,
on the ground that Bar Council of India has not approved affiliation of
college to Bangalore University. Sections 24 and 24A of the Advocates Act
alone govern ~ritolment and they do not contemplate Bar Council of India,

In Harish Uppal, v. Union of lndia,2 the Court has held that the
advocates' right to appear and conduct cases .in court is not absolute. It
is subject to rule framed by the Supreme Court under Article 145 or the
High Court under section 34 ··of ~he Advocates Act. The Court can,
thus,
frame rules debarring advoca~ s guilty of contempt, unprofessional or
unbecoming conduct from ~ppearing before Courts. Such rules will not be
in conflict with disciplinary jurisdiction of the Bar Councils.
The Rules framed •by the Supreme Court so as to prescribe
conditions, which an advocate is required to fulfil in case he wants· to act
or plead before the Suprem e Court and become Advocate on Record are
not discriminatory and tjolative of Article 14 of the Constitution.~
In a case4 the Supr;,eiµe Court has held that the right°, to practice
which is not only a statutor y right under the provisions of the Advocates
Act but would also be a Fundam ental right under Article 19(1) (g) of the
Constitution is . 1subj~t to reasonable restric~ions under 19(6) of ·the

The Court has held that 'the advocate has no right to go on strike
or give call of boycott. The Court ..will not adjourn cases becaqse lawy~s ,

!he High Court shall make rules for fixing and regulating by
taxation or otherwise the fees payable as costs by any party in respect
of the fees of his adversary's advocate upon all proceedings in the High
Court or in any Court subordinate thereto.
. Without prejudice to the provisions contained in sub-section (1), the
High Court at Calcutta may make rules providing for the holding of the
Intermediat e and the Final Examination for articled clerks to be passed
by the persons referred to in Section 58-AG for the purpose of being
admitted as advocates on the State roll and any other matter connected
therewith.
In the case of Bar Council of India v. High Court of Kerala, 1 the
Supreme Court has 1ade it clea~ that_ the advocat~s' right to practice is
not Fundamental Right. Such right 1s conferred upon him under the
provisions of Advocate Act (i.e. statutory right) which necessarily would
mean that the conditio11s laid down therein would be ·applicable ·in relation
thereto. Section 30 of the Act uses the expressions "subject to" which
would include section 34 of. the Act. Section 34(1) _provides that the High
Court may make rules laying down the conditions' subject to which an
advocate shall be permitted to practise·· in the High Court and the Courts
subordinate thereto.
In Bar Council of India-v. High Court of Kerala, 2 the Rule 11 framed
by the Kerala High Court was challenged. It prohibits the advocates from
practising unless he has purged him.self of contempt. This rule, otherwise
valid, is not hit by Article · 14 of the· Constitutibn for . not having provided
for a further opportunity of hearing to the contemrier advocate.
Within the Court, the right of audience .of an advocate is to be
regulated by the Court itself. The Court can prevent an advocate from
continuing to appear in the matter if it feels that it would be improper
to allow him to appear in the said _matter. 3 . '

or otherwise ceasing to be in service, shall not practise for a period of
two years in the area in which he exercised jwisdiction for a period of
3 years before his retirement or otherwise ceasing to . be in service.
However, nothing in this rule shall prevent any such person from
practising in any Court or Tribunal or authority of superior jurisdiction
to one in which he held office. The Explanation to the rule provides that
'officer' shall include ajudicial officer. Additional Judge of the High Court
and Presiding Officer or Member of the Tribunal or authority or s~ch
other officer or auth9rity so referred to in Section 30 of the Advocates
Act.

Rule 8 of Chapter III of the Rules of Bar Council of India provides
that no advocate shall be entitled to practise, if in the opinion. _of the
Council, he is suffering from such contagious disease as makes the practice
of law a hazard to the health of others. The disqualification shall last for
such period as the Council directs from time to time.
