MOTION TO REDUCE BAILBOND AND TO
ALLOW ACCUSED TO POST CASHBOND
COMES NOW the accused Allan Buenavidez thru counsel and unto
this Honorable Court respectfully alleges:
1) That for the provisional liberty of accused Allan Buenavidez a
bailbond of P24,000.00 was recommended by the Office of the
Provincial Prosecutors’ Office, however, considering that accused
is indigent, jobless but fortunate enough to have relatives who
promise to help him produce P5,000.00, it is respectfully prayed
that the bailbond for his provisional liberty be reduced from
P24,000.00 to P5,000.00 subject to the condition that the reduced
amount would be deposited to the Office of the Clerk of Court;
2) That this motion was filed to avoid payment of high rate of
interest or premiums being charged by the surety companies and
to avoid renewal of the same every year;
3) That if this motion would be granted herein accused will comply
with all the terms and conditions of the bail;
PREMISES CONSIDERED, it is respectfully prayed that the
recommended bail be reduced from P24,000.00 to P5,000.00 and herein
accused be allowed to deposit the same in cash;
Such other reliefs and remedies just and equitable in the premises are
likewise prayed for.

MOTION FOR PERMANENT DISMISSAL
ACCUSED, through the undersigned counsel and unto this Honorable
Court most respectfully alleges that:
a) On March 22, 2004, the above-entitled case was provisionally
dismissed, copy of said Order is hereto attached and marked as
Annex “A”;
b) The private complainant did not file any appropriate pleading from
receipt of the provisional dismissal of the above-entitled case;
c) Under the rules, after the lapse of two (2) years, the above-entitled
case may be now considered permanently dismissed;
WHEREFORE, premises considered, it is respectfully prayed of this
Honorable Court that an order be issued considering the above-entitled case
PERMANENTLY DISMISSED.
Such other reliefs and remedies just and equitable in the premises are
likewise prayed for.
